    Berta, thank you. So,if I understand, if I die for reasons other than my S/C diability:1) I wouldn't fall under the 8 year rule it would have to be 10 years. 2) upon my death,my wife would go to my VSO and ask that he file the DIC claim,and 3) She would receive the compensation I'm getting now if granted.     Dic Question

    Berta, I'm 100% P/T. On the new (12-1-11)DIC rate sheet it shows my spouse can get this compensation if I've been 100-p/t for at least 8 yrs.even though I didn't die from the S/C. Is that a change from the 10 yr. deal? Also, would she get my whole 100% or the lesser rate they show in the table of $1,195 + $254 ? If she had to fill out the DIC forms,who would she go to in order to do that? Jeff
  4. Waiting 5 months for determination on 100% I/U,but stumbled onto an inexpensive franchise opportunity in case I don't get the award. What exactly is the rule in regards to employment if I do get the I/U and the have the franchise going too? Is "buying a job" (franchise)considered employment by the V.A.?I need to generate income pretty soon or I will be facing some dire consequences. Any advice? jeff10
  5. I guess I'm trying to say,at least here, there is no "form",procedure,etc. so as to insure payment by the V.A. or to make the fact known on record. What I found hard to believe was that the ambulance service makes the judgement where to initially take you.Once in a private facility a day or two can really rack up a bill before they transfer you to a V.A.facility. jeff10

My wife has worked for a major hospital in Mpls. for over 10 years in the admission dept.There is NO question asking anything about Vet. status or if you are under VAMC care. 2nd: The VAMC told me it's up to the EMT (ambulance) if they decide to bring you to the V.A emergency or go to a local hospital ED once you're in their vehicle. jeff10

  9. After she opined it went on to say that is why they are not awarding the 100% with IU.

  10. They awarded the 70% and the CP doc "opined" that she felt I could find gainful employment in my previous field (truck driver) Sorry it took me so long to answer,just pulled up my e-mail now.

  11. Carlie, I think you did say I needed something written (can't find the post on forum). But the VSO said he wants to talk to the doc to tell him what needs to be specified. I also asked VSO about attor. today. He said I could if I wished because there is no appeal filed at this time.He said VA does frown on it though and could stretch the time out. What is it you think could prevent me from going that route at this time. I hate to make the move and find out they put it on a back burner. To answer rakkwarrior,VSO never had me fill out anyVF21-8940. As far as last employer goes they contacted them already. jeff10

  13. Just wondered if many people get frustrated enough with VSO's and head to an attorney who practices V.A.law. Or..maybe that is what I should be doing. VSO filed for 100% IU in Feb.2010. I recv'd 70% in fall of 2010. VSO has sent me to my V.A. doc twice since then to get him to call VSO and give opposing opinion to CP examiner. My doc has said sure both times and called my VSO to ask what he needs exactly. VSO has ALWAYS been busy and says he will return docs call..but can never get a handle on how to hook up with him!! My VSO told me he's going to wait till Aug.2011 to appeal or disagree or whatever it is he does,because that's 12 months from Decision. Does this sound a little dicey on his part? Any advice from anyone on forum who has taken the step to use an attorney,? downsides? jeff10
  14. Thanks for all the replies to my question.jbasser, I have asked several attorney's who they could recommend as far as specialists or doctors that they use for such opinions. They all said they couldn't give me any info unless they are representing me.,no one was less than $4,500.! Only 1 of 7 of these guys was familiar with the achronyms IME/IMO. Should'nt I be able to look one of these Occ. Med. doctors up somewhere myself? jeff10
  15. I was turned down in Sept. for 100% IU because of the the VA docs opinion. My VSO said if I could get an opposing opinion from another VA doc it would even out the first and we could claim again. I went to my regular VA doc and he said he would absolutley give an opposing opinion. The doc got right on the phone to my VSO but he got voice mail cause he was tied up in a meeting. Months went by and I never heard back.I called the VSO again. He said I should get another appointment and get the doctor to call him. I had an appointment on Thur. 2-10-11. The doc said sure,again,and ASKED ME why he never heard back from VSO.I said I didn't know. So he got on the phone again and Voice mail again. Left his number with VSO. I went home and called the VSO. He said he got the doc's message and will continue to try him back but I" must understand how difficult it is to reach a doctor at the VA Medical Center" I'm starting to feel like I've got an incompetent VSO.You would think he'd have this figured out by now,especially when he's got an agreeable second opinion that could turn the tide in my favor.Has anyone ever run into this? Isn't there some form that could be sent for the doctor to sign,etc. Jeff10

WHY does no one ever rebuff these suggestions with the question of how much We (taxpayers)can cut first from ALL elected officials Compensation(tax money) and Benefits(more tax money) during their term and especially after they leave office!!! I think it was Glenn Beck who first said if these people truly want to "serve" the people of this country as ou8r representatives, they should be paid no more than a PFC until they serve time and gain rank. Man, would you see PFC pay go up ! jeff10
  17. I'm sorry. I've been going through the forum topics to find this thread. I finally just "searched" my screen name. Anyway, my VSO called me in to file the CUE. Then the decision was sent where V.A. said yes there was CUE back to 2002. Sorry if I was not very clear on this. Jeff10
  18. I have been going to the V.A. for all medical since 2000. I would assume they have the record of my hearing aids since they sent me to the contractor for them.My County VSO must have seen the records and that's why he called me to come in and file the CUE. Jeff10
  19. V.A. gave me a letter saying they found CUE back in 2002 decision for hearing. They want to check if it got worse since then so they called me with and Audiology appt for next week. Could this mean any change in my 10% compensation? I've lost all hearing in that ear since then. They even gave me hearing aids 5 years ago. Jeff10
