  1. My lawyer has an employee that handles this type of stuff. When the money first Hit I went and opened a new savings account at another bank and put 10k in it. That way I can't touch it without going into the bank. I don't need the money until mid to late 2020 anyways. Got to wait for the two years to be up after my chapter 7 to use my va home loan. Like I told the lawyer. It's nice knowing there is more money coming that I can't touch right now.
  2. I wonder if this is a HIPA violation as well. I know what this other vet's SC is for; SSN, address, name...
  3. I got mine in record time. Only problem is I only got about half because the VA paid me another veteran's amount and paid that veteran my amount.... I'm beginning to think they could hire people off the street and they'd do a better job than the VA's current employees.
  4. So somehow the VA mixed my backpay up with another vet's backpay. I got his and he got mine.... IDK how long it'll take to get the rest of my backpay now.
  5. My lawyer will be doing that; im sure of that. If i'm owed more in the end at least I can't touch it right now. So no temptation to blow it before mid 2020 when I can buy a house with the VA home loan.
  6. [12-03-2018] Received a letter from the department of Veterans Affairs; Evidence Intake Center. It says.... Entitlement to individual unemployability is granted effective December 8, 2011 Then it goes on to show payment start dates. It shows every date which had a payment change, but the first payment start date is NOV 1, 2013... So the rest is still coming or the VA made another mistake and forgot to pay me another 23 months... EDIT: I did receive a 2nd letter stating the total award amount and attorney fees... Only problem is the VA sent me someone else's decision under my name... Cover letter says my name, but the rest of the paperwork is someone else's....
  7. From the time the 'claim' closed to money in the bank was 2 business days.
  8. According to the BVA award it should be for for 47-48 months depending how they work a partial month.
  9. [11-29-2018] Woke up to a partial backpay payment. I received 30,xxx.xx. The attorney memo is still under review, so maybe that is why I only got 30k? Waiting on the award letter to see what is up with this.
  10. Yes, they will subtract whatever the difference is. So if you had received 1,000 per month from 2000 to 2010 and then they say you should have been recieving say, 2000 a month from 2000 to 2010. you'll get 120 months * (2000 - 1000) = 120,000.
  11. I called Peggy yesterday to check on my backpay and the lady said its there when she checked to see if any payments were pending. She said it there and to give it up to 5 business days. My question is; is there anyway she can be wrong or have misinterpreted it? I just don't want to have my hopes up.
  12. I'm not sure. I actually went from 70% to the real 100% P&T. The IU rating is just now finished.
  13. They only backdated me to the last C&P. But the BVA granted me IU back to 2012. So 2012 to 2016 ill have an adjustment from the 70% I was receiving to 100%.
  14. [11-27-2018] Checked E-BEN and the attorney fee determination is closed! Only claim still open is the attorney fee memo. Does this mean my backpay is about to be released or do I have to wait on the memo claim? [UPDATE] Called peggy and the lady said the backpay is 'in the mail.' She said give it roughly 5 business days to hit my checking account.
  15. My BVA grant was received at the RO on OCT 24th. From what I was told yesterday; It has a good chance of hitting my bank account before Christmas. But my backpay is only for 48 months. Roughly 64k after lawyer fees.
  16. You can be rated for multiple mental health conditions but only receive comp for the highest of them. If you have a family member that knows your condition. Take them with you to an appoint, C&P. They can tell the doctor how your condition really affects you and how severe it is in their eyes.
  17. I'd like to add that the VA will usually try to pull a fast one and only back date to the last C&P exam. So if you're denied, appeal, and then win with a 2nd C&P. They might try to only backdate to the latest C&P. I went through this and am currently waiting on my new backpay. I am no expert and can only give you my experience. DEC-2009 filed for ptsd NOV-2010 granted 70% DEC-2010 filed for increase to 100% or IU 2011-2012 denied and hired a lawyer FEB-2016 granted 100% P&T (given backdate to last C&P; appealed for better backdate) OCT-2018 BVA Grant for correct backpay and awarded IU from 2012 to 2016. (waiting on backpay) My best advice to you is this... Be 100% honest and don't overstate your problems. The VA has a nose for this and it will only hurt you. Do NOT listen to the advice you'll read elsewhere about how to dress, act, what to say to get your way. The last thing you want is for the people helping, judging your condition to think is you're faking it. The first C&P exam I had for the increase is the reason I got denied an increase. I was totally honest and the C&P examiner stated I was still 70% and did not warrant an increase because of my ability to play 'challenging video games,' and my ability to use a computer. So I must be able to hold a job. The examiner was a VA employee and seemed bent on denying veterans. So I guess what i'm trying to say is that it matters how you get to your correct rating. You can lock in your backdate by opening a new claim on e-ben with a computer anytime.
  18. [11-26-2018] I got a very helpful lady on the phone. She says that the computer shows two major steps completed in her system. She then says in her experience; After these two steps, usually comes releasing the lawyer fee then the veteran's backpay. She named those two 'major' steps but I can't remember what they were called. She also said don't worry about what e-ben says, because there is not really a 'pending decision approval' because all they're doing is working a grant from the BVA.
  19. [11-20-2018] E-BEN shows the attorney fee determination back at prep for notification. Attorney fee memo is still at under review.
  20. If he got SSDI for only the ptsd. Wouldn't that be better for him in the long run? Getting SSDI solely for ptsd would support a VA appeal for 100% ptsd.
  21. After days of trying I finally got someone on the phone. They asked if the letter came from Atlanta GA. Which it did. The VA I goto said they'll call me back after they look into it and figure it out. They called me back and said nothing has changed. Only thing I can think of causing this letter to be generated is my BVA grant for a better backdate for IU?
  22. [11-13-2018] #800 says my claim went to prep for notification stage on october 26th. Doesn't sound right to me. Vet.gov and e-ben has it still in the gathering evidence stage. Pretty sure I spoke to a sloth on the #800....
  23. idk where else to post this, but I got a letter stating my primary care facility has recently changed to Springfield-Missouri, MO. I'm trying to contact the facility I go to but can't get anyone to pick up the phone. Any idea what this is? Just a mistake or what?
