  3. If I go ahead and submit it today and they drag me in, try to reduce.......can I still be paid while I am trying to fight it?
  4. Thanks Broncovet and Asknod. They agree I should get it, but not the eed. They both, VSO and his supervisor claim I can only get paid from when I file. The VSO said his boss at the VA hinted I could be dragged in for review as it has been so long.......
  5. Here I am a year later and I have yet to submit 526ez for Smc S. I am attaching all the paperwork for my inferred SMC S. Along with an email I received from my VARO after she was contacted by Allison Hickey. (it did not help in my case) I feel like I am opening my self up for a complete review. I do not go to the VA and have not since 2003. The State VSO that I go to is ok. However he put down an eed of 2002. I told him I only requested eed back to Bradley vs Peake. I am all over the place with this. I received a lot of great advice last year, but when I try to apply it with the VSO and according to the tone of the email from the VARO, they do not agree with you all. Of course I feel that You guys here at HADIT are correct. My big fear is again, being dragged in to have C & Ps I cannot handle it. I am 55, have been rated 90% IU, P&T since 2002. I do not trust that the VA will honor the over 55, over 10 years........ I would like some of you to look at all the paper work I have attached and advise me how to proceed. I also would appreciate any feedback as to my paranoia. Or should I be paranoid.     Thank you Asknod. Do I write that out and attach to the 21 526ez, because the form is awkward.? I am going to copy what you advised, keep it short and sweet. Do I need to mention Bradley vs Peake? Should I attach copies of everything I posted to point it out to the rater? i apologize for all the questions, I hope to do this only one time.

    I need advice on how to proceed in asking do SMC S. I was able to get my c file and have uploaded the award and decision. At the time I knew nothing about SMC. In my application for IU in block 6, I specifically stated my unemployability was from bipolar 70%. When I received IU award they included cervical ddd 20%, hypothyroidism 10%. Then shortly after awarded the SA 50%. i also have copies of letters from my Psychiartriist and a personal letter asking for P&T because of my bipolar, it was granted. My big question is how do I put this info together and lay it out so there is no question and hopefully no re-evaluations. How do I assemble the award 526 ez with this info. I know an eed back to 2001 is a long shot. I would be happy for an eed of 2008, Bradley vs Peake. Any help is deeply appreciated. MI have been sitting on this since last June.
  9. I have been TDIU, P & T for 15 years and the first and only one I received was last year. I didn't receive me this year. As a rule, l never contact VA unless they request something from me.

  11. I have cervical DDD which has worsened after rupturing a disc a few years ago. I had an injection c7-t1 two years ago and I feel great (or as good as can be expected). I also bought an inversion table. The table helps me a lot and not just in my Cspine. I was warned not to go near a chiropractor again.

  13. Thanks blue vet. It has been like this since they closed out my 21-4140 questionnaire. It was not for an increase or a claim to begin with. My disabilities are still 90% and I am still payed at the 100%, p&t. But when I look at the a8 letter next to Service Connected Disabilities it says no. (Which I know is not true, I have been this way since 2001. I called about it back in June and nothing has been done yet...
  14. Does anyone know what "backfill needed to correct corporate record" means? it looks like a claim (that I did not ask for) opened on 6/17/2015. The status is "preparation for decision". I have no idea what this means.
  15. One more thought. Why do I have to file anyway? Shouldn't this be inferred? Now that the head VSO at our Regional VA office knows about this shouldn't he be able to walk upstairs and say this should be inferred? Why don't they know this? These VSO guys are good ones and they help a lot of Veterans that I personally know. It concerning that they do not know These seemingly small but very important "loopholes" or should I say rules.
  16. Update. I spoke at length with my State VSO about filing for the SMC S. His contact at the VA office tells him it is a Sure thing and I should file it. Both of these VSOs are older and very good at what they do. Except for, they say I can only get retro from the time of intent to file which would be June of this year. That left me feeling like I know more than they do........ Because of this wonderful forum. I would never say that to them....however, Wouldn't I be eligible for retro at least back to Bradley vs Peake in 2008? I did ask my rep about Bradley vs Peake and he said, no You are only edible from the date of your intent to file in June 2015. Technically speaking, I was eligible back in 2002. Would I need a lawyer to get retro back to 2002? Does anyone think I could successfully file on my own back to 2008?
  17. John, I realize a lot of vets go to the VA for care and most of you get good care. I cannot go. I have major distrust issues And it triggers me. I have mountains of evidence in my private med records. If and when the VA needs to see Them I will provide them, but until then I am steering clear of the VA healthcare system. It also frees up a spot for Another Veteran.
  18. Thanks everyone! I certainly am not afraid of fraud as it is not in my nature. I'm am still treated for each and every disability plus some. I do not go to the VA as I am blessed with great healthcare. Again, thank you for all of your responses. I will update after I talk with VSO on Friday.
  19. Hi all, Back in June I emailed Allison Hickey for inferred SMC S back to 2002. Well what happened was the director from my RO office sent me an email telling me to fill out the 525? And submit it for my SMC S. This is what I was trying to avoid. I do not want the VA to open up my old claims. Fast forward my State VSO called me and asked if I wanted to file for SMC S and I said no. Because I have a daughter going into her Sophomore year of college. My disabilities are as followed; bipolar 70%, c spine 20% back to Nov 15, 2001. I submitted VA form 21-8940 back in Feb of 2002. In block 6 it asks what disability is responsible for not being able to sustain gainful employment. I answered my Bipolar (which is why I was med boarded out of active duty). I was granted TDIU eff 15 Nov 2001. P&T effective in 2002. Then I was rated for sleep apnea 50%, hypothyroidism at 10% and 5 issues at 0%. All rated back to 15 Nov 2001. Which puts me at bipolar 100% (cause of TDIU) and the rest ad up to 60%. So I submitted the form to withdraw claim for SMC S. Today the secretary from my State VSO office called me to say the top VSO of the state called her to encourage me not to withdraw the claim because it was a slam dunk. I told her I still want to withdraw because I do not trust the VA to order c&p exams and open up all my old claims. She emailed the top VSO and told him my concerns. She also told me he is not the type to imply anything is a slam dunk. His reply was; they would not open up old claims because I am P&t. I still do not trust that the VA would not order C&p 's and open up old claims. I am asking you smart experienced Veterans how you would respond.

  21. Thank you Mrpain7 How do I go about it? I received a reply from my VARO today stating that they did not make a mistake as my award was pre-Peake. I never mentioned Peake. She also sent a 526ez form for me to fill out along with any pertinent privTe med records if I wanted to file for SMC-S. I specifically sent it to Ms Hickey to avoid it becoming a claim...... What do I do now? Why would I send med records?
  22. Ok Broncovet, I will send in the 526ez. But I am not sending in medical records as I am filing for SMC S not housebound. It just pisses me off to no end. I wanted to avoid what looks like a claim, that should be inferred. If they grant this under Peake, can I then NOD it for an earlier effective date?
  23. I sent an email to Ms Hickey yesterday outlining my disabilities which meet the 100% IU, P&t + 60, back to 9/24/2002. I received an email at 430 pm from Ms Hickey's office saying they contacted my RO, in Maine to look into it. I just received an email from the director stating that when I was awarded back in 2003 they did not over look it as it was before Bradley vs Peake. If I wanted to claim SMC s to fill out the attached 526ez form and send it with pertinent private med records. Isn't this supposed to be inferred and why would I send private med records? How should I proceed?
