  1. I don't see my post from yesterday, lets try it again. Fast run down, on my post back in 2014 on my denial claim on a cue and appeal. I have seen a VA judge 3 months ago (March) got denied again. I know thru my DAV rep to pursue this further I must hire a VA lawyer. And I got to do this with in 120 days. My DAV is telling me it's over his head or pay grade was his words. Can anyone on here recommend a lawyer with a good track record. Also what perc entage is the going rate they charge. thanks

    The evidence is there, here in short. I was discharged 1970, Ft.Dix NJ. MY discharged physical is showing I have a better hearing than when I went in. Doc show my induction physical showing I had slight hearing loss, but not enough to stay out of the Army. My discharge physical is showing 0'S in all frequencies range showing my hearing was perfect. I asked for a hear test in 1983 and was denied, So not being smart on this I dropped the claim. I asked for reconsideration and was given in 2008 and was awarded a rating after I had a civilian audiology to give me a hearing test and wrote a letter to the VA. Then the VA gave me a hearing test and I was rated for service connection. I have copies of internal memos note telling to cancel my C&P, the reason was not given, just cancel. This and the fact my discharge was fraud and that along could have prevented a C&P, I JUST FELL MY CIVIAL RIGHTS WAS VILOLATED by the VA for not giving me a Hearing test in 1983 and I could have been drawing benefit since then. I hope this put a better under standing about my CUE.

  3. I filed for a CUE many months a go, more like years now. I even went to my congressman and still no prevail. Last week I was looking at E-Benefits and saw where my case was closed as of 1-6-2015, Saturday I got to brown envelope that contained the official notice. To day I went to my VSO and he was pissed, he said next we should ask for a face to face meeting with the rating officer and have him to explain this rating. So here is my questions to my vet friends. What should I expect at the meeting.2. how should I dress. 3 Should I challenge him and just how for should I do that?

  4. Well John I have to agree with you 100%. I retired civil service and the Govnt. never put a dime in my SS, but, yet they are taking over 1/2 of it. It called the WINDFALL TAX. To me it just one way to rob a vet one more time. But even the SSA has turned me down for disability this picture just isn't right. JMHO

  5. yes she has ins, and Medicare part D, however, Medicare said they will not cover it anymore because it is the name brand and not the generic brand. She has tried the generic brand, but she had 2 seizure while on it. Carlie she take 400mg one night and 500mg the next, and that is rotated. The key is that can not take the GENERIC BRAND.

  6. Thanks for all the congratulations. I had a meeting with my VSO Tuesday and he went over some benefits that are available to me. The one that got my attention the most was the prescription that are available for my wife.

    So here I am to ask those who really knows. My wife just got a letter from Medicare that they will not pay for her Dilantin for her seizures. The meds is $449.00 for 3 months supply. So will the VA pick up her meds now that I am 100% P&T?

  7. Thanks for the info Georgia papa, I am aware of the Ga. benefits offer to 100%vets. Also I am 67 YO. But I will go Tuesday and show them my papers and start the paper work.. thanks again to everyone

  8. I was denied also, they said I made to much money I challenged that and ask for and repeal. The second time I was told I did not have enough credits. Now I don't have 40 credits so they say. I asked being a 90% disable veteran have any bearing. They did not answer my question. So my question here is,, DOES THE 40 CREDITS WEIGH MORE THAN BEING A 90% DIABLE VET?

  9. Georgia papa Don't worry. I will keep on top of this. I know how important this is. I have read to many horrible stories about us VN veterans who was exposed the AO and this is a major killer for us. Thanks for your incouragement.

    Strectch, that is something I hope I will do. I will have to be in a hospital and can't go. C&P is a must for all of us.

  10. well the last 2 days has been hell, sort of, Yesterday went to the VA Hospital in Montgomery AL. I did not know what this was about till I got into the Doc examining room. Well it was because of my primary VA doc . Anyway it was about my prostate to be examine. It seem my psa was a little high, The chart was showing over 4 is high, mine was 5.6. The Doc said that was normal for my age, and no other visit needed and to do the test again in 6 months.

    Today was my new C&P hearing test, If you remember it was lowered from 50%( hearing loss and tinnitus) to 20% . It wasn't to my surprise that they pull the chart from 2011 hearing test and compared it to today test, wow I am now one whole decible lower on my hearing. I asked the hearing Doc what he thought after I told him why I was there, he said this should in his opinion get it back up to where it was or more. So now I will sit and wait.

  11. Yes Barbamatt I will be able to drive there it's only 120 miles from home. So I will get up early and hit the road and be there on time. With the rating I have now the total comes up to 90.4= 90% but if I get back to 50% for my hearing the number will be 93.4 still be 90%, but anything else over 20% will give me the golden number of 100%.

  12. well I like boomer2 saying, But I know that not going to happen. I got and increase in my rating a few months back, But my hearing was down graded from 40% to 20% and I asked for reconsideration, So I guess this why I am going to FT Rucker for a new hearing test. As of now I am 90% disable so even if I get 50% back it will not go over 95% so I still be 90%. but the overall numbers will be higher. I will post back once I have the test and get a reply back from the rating person.

  13. Well here I am sitting here and got my mail today and I got another C&P on my hearing. Now that not the problem, the problem is where I will have to travel to take it. I live in Midland Ga. and my test is in Ft. Rucker Al.. I live about 30 miles from Ft. Benning Army Base and maybe 45-50 from Tuskegee AL. where I normally would go since that is where it all started. So can anyone tell me why I have to travel well over 100 miles for this. And the appointment is at 11:00 AM.

  14. Well here is my up date: I went to the SS office for my appointment, not what I expected. Any way sat there and let the lady ask me questions, that she already knew the answers to. Well about 15 minutes into the interview she stooped mad copies and the told me I did not quality for SSI or SSD. This time it wasn't because I havn't worked in 5 YEARS. It was, I have not paid enough quarters into SS to get disability. I asked just how many quarters was required she said 40. then I asked how many I have paid in, she went to another statements. over all I think this is just BS . They even counted my VA disability as income and the IRS don't when I file my taxes.

    Ok that enough for me, I think they have won this one, just so tired of it all.

  15. yes I did apply for TDIU and was denied, Also I am drawing SS now. I KNOW I CAN'T DRAW BOTH, but, I was thinking, and maybe I am wrong. If I had SSD would that has help on my TDIU. I think I have read on here where someone had SSD and it help their claim. I don't know, this is so confusing. But Monday week , 28 July I shall see just where I stand. It just seem unfair to a person who get disable 5 years after they retire, they aren't eligible for SSD. OK, this my vent for today. everyone have a great day.
