i Was told by a VA employee that requesting a express appeal could have them take away my 70% P and T rating and put me down to 50%, because he said if they send me to a C&P who knows how bad a day the examiner may be in. Iam 70 years old. Any comments would be greatly appreciated. Iam claiming on appeal vertigo and sleep apnea. Just asking

I just found out from my VA doctor that I have prostate cancer and because of my exposure to the spraying back in 66 and 67 I must get a byopsia to see the stage am in. Am 70% IU but payed a 100%. My question can I claim this medical problem even though I already at max pay??? Thanks any info greatly appreciated

Can some tell me what form do you use to reopen claim. I was denied by BVA but now have Imo which I should have sent the first time from VA doctors????????????

The post started like this unusual decision showed nothing is impossible with the VA and At first the premise seemed to me to be a denied claim but as read on The post was in regards to vertigo and aggravation that the aggravation of vertigo resulted from effect i.e. dizziness of ptsd medication. It also stated that an ENT va examiner physician reviewed the vets records and on his review vet won at board. It was a article or post dated september2008. If I can fine this revie of the vet by the va ENT physician I can use that case to forward evidence to board. I have looked all over maybe some one can help??? Thank You MOJO

well as I promise got EED back to 10/2010 on IU was asking for 8/2012 extra 12 months and the judge threw in vertigo which was denied back in 10/2011 as a gift ???? never ask for it . Soooo sent in NOD for EED with some paper showed effective date was incorrect and they gave me a better deal. So good luck all its been a 5 year fight but its done and now I will chill. Same here chief, remand back too RO on my EED NOD. Its only one item so who knows. My VA decision package look pretty good, the VLJ looked as if she is fighting for me like she did on my appeal which granted me IU. Remand better than a denial. Well let you know how things work out.

You and I chief are at the same date at the BVA. I sent a NOD on the EED. They low balled me 12 months. My appeal was granted but at a higher EED, should have been lower. They gave me from 8/15 but should have been from 8/12 So chief lets see how long it will take us. I just got notice on Eben date of LVJ 5/26/15 judge Alibrado same judge who granted my appeal. Same same here, low balled me by 12 months. Put NOD right away to BVA with evidence, its presently in stage two on E-ben in 14 days. will let all know what gives.

Does SSD have access to to VA file when they are reviewing your file for SSD benefits. What I mean is do they take in to consideration that Iam 70% IU and paid at 100% rate. I just found out they have completed my appeal and are sending me there decision????

Retro on Saturday and officially P/T, Iam not happy with retro so have put in a letter to VA evidence intake Center as per peggie 800 line I was told to fax them my disagreement and they also have sent them a inquiry on my behalf. There fax number was given to me by them and told to do my disagreement this way. Fax number is 248 524 4260 just in case someone needs it. They used 8/9/13 as my date of claim when in fact and I can prove it, it was 8/9/12 which happens to be my birthday. I know I should be happy but after fighting for 5 years I want them to get it strait. Iam still waiting for brown envelope, should get tomorrow 4/13/20015. Too me its 12 months at $1600.00 or so I deserve it. Well any comments will be well taken. Good nite

Done, Iu approved P and T 20 months retro as of 9/1/13. Letter dated 3/31/2015. From remand to grant in 3 weeks. From meeting with VLJ in Nov 5, 2014 too remand back to amc and approval. Good luck all, you can do it without a lawyer just listen to the board. Five years in the making, Iam beat

asknod I have had my VLJ hearing with A. Alibrado VLJ, I hade my advance on docket for my BVA decision, she has approved one appeal and her paper work to me seems to tell the RO too get with the program either you approve or show me why I should not. I have gone from certification to hearing in less then 6months thanks to McDonald, call me bob. I did meet my VLJ Judge Alibrando at The St Pete RO on November 5, 2014. all my ducks are in row. Go back and read my post so far. Will let all know as soon as get a reply. I also fax the judge in formation she request from RO AS SHE REQUESTED. The veteran has the right to submit additional evidence and arguments on the matter the Board has remanded. Kutscherousky v. Wesr, 12 Vet. App. 369 (1999) and in her written statement she states that she wants this appeal be afforded expeditious treatment, and I intend to push this as hard as I can.

It looks good I will not let them deny me my benefits. Thanks for the support, you next.

Rec letter today dated 3/4/15 IU remanded, tinnitus granted. remand is good judge wants RO to get there head out of there assssss and review my case. besides IU there is Sleep ap and vertigo going back to 3/2011. judge mentioned that before she renders a decision which I think will be granted IU or 100% P?T In my own opinion I feel very strong she will grant or RO will grant just to get it over with. Will let all know what goes and I will stay on them like white on rice stink on ship.

Looked at ebennies and it went from with VLJ to decision made ,2/27/15 Pending Dispatch: This indicates that the Veterans Law Judge made a decision on your appeal, and that BVA will mail the decision to you soon. 5 years waiting 4 years retro.

well wait is almost over, rec letter from my hearing judge today dated 2/11/15. I had asked fro a motion to advance on docket and was approved. Letter state they will comply with the request and that sufficient cause has been shown and thus the motion to advance on board docket is granted. So in compliance with this action the board will take prompt action to issue a decision in this case. I will receive a copy of the boards decision as soon as it is issue. Signed by my hearing judge. I know this is not a granted appeal but I feel that all went well at hearing on 11/05/14. I guess I will know by March 15,2015 l let all know outcome , Its been a long 5 years
