  1. They automatically send them annually because when you bought your first one you agreed to their terms, which included annual updated issue purchases. A new one costs only 41 cents a day if you save daily. I think it's cheap at that price. They used to do cheaper supppliments but I prefer the new editions. jmo pr
  2. Yes, your claim should have gone back to '94. I was awarded 30% in '89. I appealed that decision and applied for TDIU 4 times during the next 8 yrs. I just kept putting in TDIU applications, in case I'd missed some deadline or something. At about 8 yrs I was awarded TDIU but not retro to '89. I continued my appeal and I was eventually awarded 100% P&T, at 10yrs and 5 months. The RO tried to short change me one yr of retro but I sent them a letter explaining their error and received the additional $17k within about a month. If the evidence is there they should go back to '94. Your earnings record from SS would be excellent evidence of not being able to work. pr
  3. It's the VA's policy that at age 55 there should be no future exams and that is official. If the C&P office mistakenly schedules another exam, after age 55 & 5yrs, you can request it be cancelled. At age 55 the condition is considered static. After 5yrs it's also considered static. pr
  4. You should. I believe you must be 30% or more to receive monies for dependants. Unless you've just recently been discharged why would you wait to file your claim?? Every day you wait is lost money should you prevail. jmo pr
  5. I think she's saying be true to yourself. It's your decision. Only you can decide. We all have our various levels of morality. You should do what you think is best. I'm generally very honest, however, I'm a survivor, too. If I was starving, w/no hope of getting something to eat and I found a wallet w/$20 in it, I "might" be inclined to take out some of the money, before dropping it in a mailbox, so it could be returned to the owner. I'm the one that must live w/my decision. jmo pr
  6. Again, personally, I don't see a crime. Dave signed the papers, thus swearing to them. They were both involved, however, it's on the late father at this point. Once "Dave" died, John didn't need to pay the mortgage. John could probably never actually "own" the property, anyway. Don't get me wrong, I believe in reporting criminals (ie: being a snitch). However, I don't report speeders unless they are driving dangerously. If I suspect a drunk driver I report it. I guess it's up to you! If I witness a crime I'll speak up. If I see a minor smoking, while I believe they should be punished, w/the parents, I leave it up to the police. I don't think he's a coniver, just using the law to his advantage. When my Mom was alive she received about $700 a month in SS retirement. She helped me, thru her credit, during my 10 yr battle w/the VA and when I won, my credit was shot but her's was excellent. I bought her a house. She got the mortgage and I made the payments, by being on the note but not the deed. We were paying an outrageous 16.9% interest rate. Two yrs later she had a stroke, needed care I couldn't supply and needed to go to a nursing home. I let the house go into foreclosure, as I could never own it and she wasn't living there anymore. Was I a criminal or someone who loved his mother. None of you can judge me. I'm comfortable w/what we did. jmho pr
  7. Do you know or do you suspect??? Have you "seen" the actual paperwork?? The VA should know the vet is deceased and therefore would be unlikely to guaranty a VA mortgage. Besides, it would also be the bank or mortgage company's responsibility to confirm what is being stated, on the application. Why anonymously?? Just curious but why you aren't willing to back your turning him in? Sounds to me like you don't have any facts to back up your suspicions. Just what we need . . . volunteer mortgage police. Personally, unless you are willing to back your accusation, w/your name, I think you should stay out of it. But that's just me. jmho pr
  8. Pete53 - I believe ChampVA pays 75% on prescriptions and the patient ends up paying the 25% balance (or copay). The major drug store chains generally have you pay the 25% at the time the prescription is filled and bills ChampVA the balance. pr
  9. carlie - cute!!! they probably will, now that you've suggested it!! pr
  10. navydoc2 - I was just kidding!!!! Sorry everyone, I just couldn't pass it up. There is no exam. They just take your word for it but they also look at your labs to see if they can blame it on something else. pr
  11. Yup, they do test. It's very much like testing nerves. In this case, they attach electrodes (like used in an EKG) to each testicle and use very low voltage to stimulate the penis. If no erection, you get the SMC "k" award. It's a little uncomfortable but you'll survive. pr
  12. Hey, moderator, I read the word Dems!!! Time to close this. pr
  13. Just answering the original question, which was: "Does anyone knows if we are getting a COLA for 2010?" To which I answered "Yes." ;-) pr
  14. It "can" help him if he can get an IMO or something stating that his symptoms were the same as what is diagnosed as PTSD, now. jmo pr
  15. Carlie, I disagree, in that, I read, the PTSD must be diagnosed while "actually" on active duty(AD). Since PTSD wasn't a diagnosis in the VN era, no one could be diagnosed w/it, while on AD. Therefore, VN vets will still need to have stressor verification. jmo pr
  16. With those axis and a GAF of 45, I would guess, you should be rated 100% but knowing the VA, you'll probably get 50%, maybe 70%. If you're working, probably no 70% or 100%. jmo pr
  17. I seriously doubt anything has been relaxed for VN vets. This rule was just a way to process those w/current war service, while still screwing the VN vet. They still need proof of stressor. pr
  18. You can request the attorney(s) send you a monthly statement of hours and costs. I need to correct a statement I made. The attorneys get paid from the award, if they win. If they lose they can request payment thru the EAJA but they don't always get it. The hours and costs must be reasonable and then the fee must be approved. It's kinda a win/win situation for them. The EAJA usually pays. pr
  19. The court can award, deny or remand. A denial is a loss. An award is a win. A remand is a win because it allows an already denied claim to be sent back and to be re-developed and readjudicated, thus making it a win. pr
  20. I hired an atty for my appeal to the CAVC and he won me a remand. He applied for payment under the EAJA. He did have to submit his hours and costs and then they approved his payment. Without the EAJA I couldn't have appealed, to the CAVC. I believe they get paid whether they win or lose. pr
  21. I would definitely file a claim for it. Hives is usually an allergic reaction to something. Allergies can develop at any time. Be sure to have the necessary service records available, for the VA, showing when it started. pr
