  1. A VA CUE does not mean "clear and unmistakable error" in the normal sense of the phrase. You need to check the VA's definition of CUE. Very similar to their math. pr
  2. Always appeal!!!!!!!! Never ever give up!!!!!!!! Apply for SSDI, now! Also apply for Voc Ed. If they deny it's good evidence for TDIU. pr

  7. Depends on your disabilities and your evidence. I do know that Allsup.com only takes the easiest of claims, that you could probably win by yourself. As to the time frame, I don't think using a lawyer will speed up the process. jmo pr
  8. I'd reapply. Sounds wrong to me. I just added a medicare supplement at 67yo. They check to see if you had insurance at the time and the VA is considered that you had insurance. Mine costs me about 120 a month and I've had medicare since '92 and VA since '89. Appeal thru medicare. Never believe anything they say, as they can't be held responsible for errors. Always get it in writing. As a friend once stated, "If it can't be read, it wasn't said." pr

  10. At 70% you could be awarded TDIU but they generally require that you fill out a TDIU form, first, so I doubt they gave you TDIU. They may enclose the form w/your 70% award letter. jmo pr

  12. That's great to hear, John!!! When they started the court they wanted to make it impossible for old claims to be redone. I helped a friend win his claim for prostatitis back to 1955. He ended up w/about $35k, retro. They didn't pay much back then. pr

  14. Sorry but 4yrs, over 500 jumps, that's roughly 10 jumps a month, for 4 yrs, highly unlikely in my book! With that many jumps he'd probably be a master blaster, also. But thanks for helping him, even if he embellishes his history. jmo pr
  15. Additional benefits come w/being Permanent & Total (P&T). They are Chap 35 for spouse and minor children and ChampVA insurance for them also. pr
  16. With TDIU you have a lower rating but your VA disabilities are severe enough that you can't work, so they pay you at the 100% rate. With 100% schedular you meet the requirements of 100% rating. pr
  17. You want a De Novo hearing. It can take a couple of wks, at some VARO's, for mail to get to the proper location. It's possible they didn't have your evidence at the time they made the decision. Don't expect this to be resolved quickly, as things take time w/the VA. Even tho they stated you have 30 days, you really have a yr. Whatever you do don't give up. I'd also pursue a PTSD claim, as the military/VA is trying to downplay how many cases there really are. jmo pr
  18. If you have SSDI and it's all for SC disabilities you should win. But knowing the VA they may deny you a couple more times, first. I believe the VA is required to consider the SSDI, when deciding your claim, and if they decide against it, then they need to thoroughly explain why. pr
  19. Jim - there is somewhere in the regs where it is spelled out. Payment starts accruing on the first of the next full month, after the effective date, and starts actually paying on the first of the next month. In your case June, 2013, is nothing, July, 2013, you get paid for but not until August 1, 2013. pr
  20. Yup! You said it was awarded in 8/2012 and I think you meant 8/2013. If the claim date is June 10, 2013, your first check should be 8/1/2013, for July. June doesn't count for money, at all. July gets paid 8/1/13. I'm guessing the award date is 6/10/2013. pr
