  3. . First I would request a hearing prior to the reduction. You only have about 21 or 30 days to request it. When was the original OSA claim awarded?? Can you post the decision w/the personal info blacked out? pr

  6. I would file, myself, and probably get some counseling. Personally, I avoid the meds. To me, PTSD isn't such a bad thing. It means you were a really "nice" guy who was affected by an event and it changed you. Now, if you're working in law enforcement, or some other fields, you may want to avoid it, as it could ruin your career. jmo pr
  7. vet 201060 - You are somewhat protected, because you've had it over 5 yrs. The VA can reduce up until 20 yrs but need to follow a strict procedure. They need to advise you of their intent to reduce, prior to the reduction, and give you a hearing option for you to appeal. Just be sure to read everything they send you, make all your appointments and you should be okay. jmo pr
  8. 38 CFR 4.16(b) covers you, provided you are unable to work due to your SC disability(s). The VA often quotes 4.16(a) as a means to mislead claimants. They used this tactic on me many yrs ago and I almost fell for it. Go get 'em!!! pr

  11. You should apply for TDIU if your SC disability(s) prevent(s) you from working, no matter what your percentages are at present. pr
  12. Good luck, John!! I'm at 20%, taking 2500mg metformin a day, and an a long lasting insulin injection, at night. I think I take another oral diabetic med too. I'm getting 10% for each extremity, for PN, but doesn't raise the 20% for DM-II. I've tried but they keep denying. pr
  13. Your claim should go back to the RO that denied the SC, originally, but could go to the AMC. If you haven't had a recent C&P, for PTSD, they may schedule one prior to any monetary award. jmo pr
  14. Yes, to #1, I agree that it could be an inferred claim for TDIU. I would on #2. pr

  16. They can't lock you up unless you do something dangerous to yourself or others. I started w/30% in '89 and appealed, appealed, appealed, and in '99 I was awarded 100%,P&T, retro to day one. I don't take their meds, either. You might check on Voc Rehab for whether you can be trained or if you are too sick?? pr
  17. The best thing to do is apply and request an expedited service due to financial hardship. A&A can pay up to $3k-$4k monthly and possibly more, depending on the need. I doubt it would cover the costs of a fulltime caretaker, making any kind of a livable wage. jmo pr
  18. They used them back in '89, when I first filed a claim. I recommend that they be written on a "Statement in Support of Claim" form, with signature being sworn & attested to. They carry more weight if sworn & attested to. pr
  19. To the best of my knowledge you can only have one Representative(POA), either the DAV or VVA, not both. Even tho they are working two different claims. pr

  21. Ya can't please all the people, all the time. I agree paying $8k and being given $24k free is wonderful. Anyone wants to give me $32k and just pay back $8k . . . where do I stand in line?? pr
  22. Check with "fee basis." If you were referred by the VA, they should pay but you never know with the VA. They usually give prior authorization before allowing civilian treatment. pr
