  1. They shouldn't use an old C&P exam report. Generally they must be current, at the very least within one yr and they need to be the type needed for the type of disability/injury you're claiming. You can put in as many claims as you want, at once. pr
  2. Yes, as I stated previously, all you need to do is send a letter stating: "Dear Sirs, I request an increase in my disability, as my DDD in my back and neck has gotten worse. I also request an increase in my GERD. Signed and dated XXXXXXX They request the C&P exam, not you. No evidence is required but if you have any, it can help. pr
  3. Filing for an increase is easy. Since it is for a condition you are already receiving comp for, the VA must give you a C&P exam. I would apply for an increase in each, provided they've gotten worse. If you are rated less than 70% for PTSD, in itself, I would request an increase, in that no matter what, as the VA usually lowballs PTSD ratings. jmo pr

  5. You have to ask for "extra - scheduler" because if you don't they won't consider it. I helped a vet get an extra - scheduler rating for a skin condition. The max allowed for the skin condition was 50% and they kept telling him he was receiving the max allowed by law. We requested TDIU and they gave it to him. Took about 18 months to process the claim. pr
  6. You can receive both, SSDI and VA comp, at the same time. Social security may go by your VA conditions if they disable you. pr
  7. I'm sorry but I'm going to disagree w/everyone here. I feel the VA should have provided a him w/a C&P exam, as this was his initial claim, otherwise they should have rated him the 40% that the Navy retired him at. They had no basis for any rating except the 40%. jmo You can try for a CUE but I think it was a "grave procedural error," by not providing him the C&P exam. pr
  8. My VA counselor submitted his claim for IHD as a fully developed claim and had a decision in less than 4 months, of 100%, w/P&T and he then took medical retirement. pr
  9. coriemboh - FYI - The ratings you see here, such as Senior Chief, etc., are not true ratings but since tbird, the wonderful lady who started and owns this site was Navy, she has chosen those labels as a means of identifying a members length of membership and postings here. Your rating will change from E-2 recruit if you stick around a while. pr
  10. I would file for TDIU, now, along w/everything else. Be sure to add at the end of the claim that he is "requesting the maximum rating(s) allowed by law." pr
  11. If you just became eligible for travel, they can do retro. They may deny, at first, but if you appeal, you can win. pr
  12. You can. Let the VA know what you intend to do. They "shouldn't" reduce you until you are shown to be successful, about one yr. Your spouse could work and you could be a stay at home dad and take care of the kids but that might be too hard for you. jmo pr
  13. It can take anywhere from 10 days to never. They are required to send it within 21 days(+ or -) but rarely do these days. It generally takes more like 3-4 months. One of my vets just received his from his December request, from the WRJ, VT, RO. pr
  14. You should get retro after the increase award date. Also you should add your dependents, as 30% and above get dependents allowance. pr
  15. I always suggest sending anything you send to the VA, certified, return receipt requested, so that I have proof of mailing. jmo pr
  16. He can work, provided he's not 100% for PTSD or some other psychiatric disorder. pr
  17. It's about time!!!!! Had they been honest, w/me originally, it would have saved them money, as I would have probably gone away and not bothered to help all those others. I'm sure I've cost them a couple of million, which is probably nothing, compared to what you've cost them by helping others. Nothing on your "s" award and the combined ratings table??? pr
  18. You should start with getting a copy of your c-file, as it will have all of your info from your previous claim. pr
  19. You can request it stay or move. Most RO's will transfer your claim when they get your change of address, so as to remove it from their books. jmo pr
  20. First, I'd say, we know more than "most" if not all VSO's. Yes, that would be 90%. I would get the TDIU form and fill it out for when you can't work any longer. When that happens, you should file the form. You should be prepared to do without much money while the claim is being processed. jmo pr
  21. There's a good deal of evidence that sleep apnea is possible w/PTSD and also w/Type II diabetes. I don't wish any of them on anyone. jmo pr

  23. I think you can get them to go back to '09 but it'll probably be a battle. You should have filed a claim back then. I'm curious why they rated your CVA SC?? pr
