  2. iraqx2....Thank you for your input & suggestions.....At this point, I am pretty much in a holding pattern irt the VA's decision on my claim......Up to this point, the VA (VBA, VHA, local clinic, etc...) has been nothing but helpful and supportive of anything I've asked of them......I will caveat this by saying that I am not a rose-colored glasses individual.....there are definitely issues that need to be fixed w/in each area/dept of the VA; however, I don't believe that I (as in me) qualify to raise the BS flag because I haven't felt any injustices/unfairness that most of these veterans have, and are still going through.....I hope I do not, but if I do it's great to know that fellow-Vets, Spouses, friends & family members have my back......and vise-versa.......   3. Hello, Berta..... No. However, the examiner does point out, throughout the report, which disabilities/diseases are already S/C......Since this C&P/TDIU exam is part of my initial claim (my BDD claim), I have only submitted SMRs and signed Release of Rcds permission to the VA on any medical treatment rcvd since retirement. So, the only info submitted thus far are what I've stated above + my input to the VA as to why I am asking for TDIU.......I'm not sure if I answered your question & I didn't mean to "ramble on" (good song, BTW).........Thanks again, Berta..... ras
  4. Good evening, All..... A few weeks ago, I had a C&P exam for 2 remaining medical issues that had been deferred from my initial Disability Claim ~ Oct 2011. The issues were deferred for further testing…COPD (PFT) & CAD (Interview based METS testing, EKG)….When these 2 issues were deferred, I was still awarded 80% for my other medical SC disabilities on this initial claim……I filed for TDIU a few months after the awarding of 80%, so this recent exam was to cover the additional testing for COPD/CAD & TDIU.....The exam took place at a VA Center, per my VARO… The exam took ~45 mins with the Examiner….This was followed by a PFT, EKG, chest and lower back x-rays within all the respective departments throughout the facility….I never saw my Examiner again after the initial 45 min apt…..I received a copy of the exam (titled “General Medical – Compensation Disability Benefits Questionnaire *Internal VA or DoD Use Only*) after it was marked “Completed”. In Section I, #6 (remarks) were the following: “Veteran is not employably related to the following conditions: 1. Decreased concentration and impaired cognitive. Diminished ability for social interaction 2. Migraine headaches: At X-X per week, ma have unacceptable amounts of absences with diminished concentration 3. Back pain requires opiates: limits functioning of standing, sitting, walking, heavy lifting, inability to drive related to opiate use. 4. Diminished stamina and exertional level, varying due to symptoms related to COPD and CAD My question……Is this the Examiner’s own statement or is the Examiner stating what I may have said as a reason why I am filing for TDIU?…because I did not say those things......your inputs are greatly appreciated.... ras

Pete53, Berta, 71M10, Chuck75, broncovet & others…… Thank you all for the responses to my question……First off, I did not know that M21-1MR Special Considerations Docs even existed…thanks Berta, I’m going to have myself a good read tonight…. When I received this “initial” Award Letter, they awarded me 80% on my med issues, except for COPD & CAD (IHD), which they have deferred for more tests (PFT, METS, etc…) I cannot say if VA will consider these 2 diseases as SC, although they’ve been documented in my SMRs as SC…….so, to answer Berta’s question; I’ve been awarded 80% thus far…… 71M10…..I’m not sure if this is the new and improved decision letter….How will I know? Chuck75….There wasn’t any further explanation to the VA’s statement on my Award Letter, but I believe I thought it was because they (VA) hadn’t completed my initial claim……(2 deferred claims)…… As broncovet and the rest of you brought up, there are several special considerations & I just need to mosey on up to M21-1MR and do my D. D……. Again, thank you all very much…….There are other questions that I cannot find answers to…..I promise not to over-inundate any of you…..promise! ras
  6. Hello All.... I received an Award Ltr for an initial claim...In the "INTRODUCTION" section, there is a statement as follows: "Based on a review of the evidence listed below, we have made the following decision(s) on your claim. In respect to all SC disabilities, a review of the evidence does not show that your claim warrants submission for special consideration." Has anyone received a stmt like this on their Award Ltr? Does anyone know it's meaning? Appreciate your thoughts...... ras
