  1. The logic of this board is favoring the VA.

    The following quotes are pulled from this thread alone:

    1.  You pretty much have no choice but to wait on the outcome of the remands.  

    2.   Hang tough brother. Have some short term and long terms goals

    3.  Its always good to know the time frame that this type of issue has been spread out over.

    4.  Wait and get  a hobby.  Enjoy it.

    5.   Have something to look forward to.  Its important so you dont go nuts.


    Just about all advise given here is how to deal with the VA on THEIR terms......play the game with THEIR rules.

    The advise here is of great value but the VA dont play fair and dont play by the rules. 

    People here like Berta have forgotten more than I will ever learn and have a special place in heaven.  I dont have Asknod's writing skills and hope I have not offended any of the wonderful people on this board.

    There are a lot of sites popping up like "The Va is Lying"  etc..  where the frustration is starting to grow into anger and possibly violence.  22 Veterans a day are killing themselves and many more die just trying to get into the VA.

    It's not right to wait so long for a claim or an appeal.  It's not right to not be able to communicate with the people that make decisions on your life.  It's not right to be low-balled and denied when you were in harms way so many times.

    I wish I knew what to suggest but my thinking is usually over the line or not politically correct but, this aint working.

  2. The C&P examiners do C&P's every day all day long.  They know more about what you are going to say than you do.  You get one shot and it's over.  If you dont get your point across or forget something because the examiner distracted you (on purpose or not) You are screwed.

    Take a list of your problems/issues to help you stay on topic.

    If you get the good ol boy "I'll take care of you" Bullshite.........refuse to leave until you have finished your list.

    Oh hell Buck......now I cant remember what I was going to finish with....

    Anyway, grab the bastard by the neck and beat the............naw......cant do that can you?  Just a little?

     

     

  3. I had to sign 2 pieces of legal paperwork that I could not read or understand.....but, I signed just to get it over with.

    If I had to do it again I would have requested copies to take to a lawyer before submitting to the C&P exam.

    My examiner was very blunt...got me uncomfortable at the start.  Once you are out of your element they can make you say a lot of things you will regret.  Then, they will use anything you say against you.

    Do some deep thinking .... make notes ... try to record the session ... reference your notes when the questions seem unfair or just plain "not right".

    You get points for showing up filthy and stinky, homeless, suicidal, long arrest record, drug use, violent and paranoid.

    When it's over do not be surprised if you get lowballed.

     

     

  4. I have a list of over 20 "Base-of-tongue" cancers GRANTED on appeal at BVA level. Many more were DENIED.

    It makes about as much sense as having a Wounded Warrior Project. If the VA were doing thier job why would there be a WWP?

    Just to be fair and show that I am not just picking on the WWP, why are organizations like VFW and American Legion NOT raising holey hell about the appeals backlog????????

  5. I flew to St Pete (500) miles to meet with the DRO and he had already made up his mind to continue with the severance. I presented new evidence and the meeting was recorded. They just went on with the severance and I of course NOD'ed and thus was introduced to the hamster wheel. It would be nice to get a SOC and form 9 one day.

    What I have been pondering lately is if I requested a copy of the recording with the DRO say, via IRIS.??????

  6. I get and got treatment for my cancers from civilian doctors on my Blue Cross insurance. My original diagnosis was Larynx PRIMARY. The largest tumor was at the base of the tongue so the Doctors constantly referred to it as "Base-of-tongue" cancer. VA found that by severing service connection and re-naming it "Base-of-tongue" would put me on the permanent hamster wheel.....where I will stay until I die. Slowlane

  7. Thanks for the great advise Asknod. I will try to do as you suggest.

    I was going to write Jeff Miller for assistance in getting a form 9 and SOC out of St Pete. I actually live in his district. I got discouraged when I went to his website and read what he had to say about appeals.

    This is a cut-paste post from his website concerning appeals:

    "How can I get my VA claim processed faster?

    The Department of Veterans Affairs currently has many claims pending for various types of benefits. Because of that, many veterans feel that their case might be overlooked or handled improperly.

    I am always glad to help in these situations. At my request, the VA will "flag" a particular case and keep me updated throughout the process. However, it is important to know that I cannot act as the "representative" on a person's VA claim. You may still want an attorney or veterans representative to help you with this. My actions will not affect the work done by the person you select as your representative."

    Pretty bad when the Chairman has no power.

  8. You haven't specified what type of Appeal your waiting for, that could make a big difference if it all comes down to #'s and your place in line. If you're waiting on a BVA Hearing, how would the transfer affect your future Hearing Date place in line? If it's a DRO Hearing, same question? PR's experience would indicate careful consideration is necessary before just putting in a change of residence. You may want to be proactive and request in advance that your appeal stays at your original VARO. I don't think you can determine with certainty what the effects of a transfer would have on the future Hearing timeline.

    I'm waiting on a BVA hearing.......already had DRO hearing with no luck and no SOC......still waiting (14 months now) on SOC and form 9 to go to BVA......I think St Pete has buried it on purpose.....If moving to another state will get it out of St Pete, I would move tomorrow.

    That is your door to an appeal right there...How long ago was the C & P by the OBGYN done ?

    You needed on oncology opinion........I recently knocked down a ludicrous C & P opinion on my 1151 HBP claim.

    I called CUE on them And they reversed within a few weeks....

    We have to start fighting back right away when we get these quack C & P opinions.

    In no way does a OBGYN have expertise , as far as I know, in the field of cancer.....

    I thought it was outside the lines myself.

    She even got her degree from the Philippines........Forgive me if I have gone politically incorrect here but if you are going to sever someone's service connection at least use a US doctor and trained in the right field.

    I really really really believe she was coached by St Pete......This could never be proved.

  10. I haven't contacted anyone......I have no faith that anyone can do anything with St Pete.

    Right now, I am beaten down and discouraged. It's not easy to wage a war with the VA and cancer at the same time.

    I know this sounds like I'm fishing for sympathy.......I don't play that card.

    I gotta go thru this stage of my life for a while. Just sitting on the sideline trying to come up with some useful ideas.. As Arnold said: :I'll be back.

    I dont have STS.

    I started out with "base of tongue" cancer because that was where the main focal point was. Original paperwork from the ENT that performed the surgery stated "161.0 Larynx, Glottis Primary". Granted by VA for 2 years at 100% as larynx cancer Agent Orange presumptive.

    I should have never moved to Florida but I did as I needed to get out of the Alabama woods and nearer to large hospitals and numerous Doctors to choose from.

    As soon as I resettled in Florida, St Pete re-opened my case and got a local OBGYN VA Doc to find that I had "base of tongue" PRIMARY. Totally ignoring the Board Certified ENT's five (5) reports that said "161.0 Larynx, Glottis Primary". I flew 500 miles one way to St Pete to present all 5 reports to a DRO at a recorded hearing. 30 days later they severed my service connection and put me on the hamster wheel and are dragging their feet to give me my SOC and Form 9. All iris inquiries have been rubber stamp jargon answers.

    That was 14 months ago and now I have lung cancer to add to the pile of stuff they deny and ignore.

    I live in Jeff Miller's district so you can see how scared the VA is of him. I would write him but he has no power in St Pete.

    I hope I live long enough to see the VA go down, get farmed out, fired and if they could embarrassment. That would be my 100%

    Bet they come after me now because they sure as hell aint working claims.

  12. It appears that my lung cancer has been officially tied to my 4 1/2 year old head and neck cancer via metastasis. The local pathologist's report says it metastasized from the 4 1/2 year old head and neck cancer that has been denied and sitting in appeals for over 14 months.

    If I add this to the existing appeal it will just slow it down even more and wont make much difference in the long run.

    >>>>> I could file on this new lung cancer claiming that it is a new primary but, it will be easily denied as a secondary. I could reference in my claim that there are studies on the internet that argue that metastasis are unlikely to occur at 4 1/2 years out. This might give me the "as likely as not" consideration.
