I noticed that back in 2016 but I wrote my congressman and also when my appeal was lost in the sauce reached out via the iris helpline and yes it works, https://ask.va.gov/ I hope its still around was good for accountability. I also even emailed the secretary of the VA and yes they answered as well by flagging my file and speaking with me . Took some digging email the Secretary Email Address Redacted. I emailed the one under Trump and got two calls about the email and an inquiry on my file, just be polite.

  4. If I was you I would reach out to your state representative or congressman to inquire what they could do. Their VA member on his or her staff will speak with you with what they can do in my case they flagged my file for a congressional inquiry never hurts to ask

Correct me if Im wrong but was a DRO review way better I thought i had brought new evidence they took into consideration and they helped me win my appeal they said because they werent allowed to grant such a high costing backpay it had to be done at the board which is why she certified it immediately to the BVA which saved me years of waiting

  7. Well I filed my first high review with a conference just sounds like a DRO appeal at the regional office.
  8. I was exposed to loud noises daily I was a Ch-53 mechanic they even put that in the denial my MOS is on the list, I had hearing loss but was denied. I was confused because they service connected for tinnitus and they said im eligible for hearing treatment at my local VA since Im 100% P and T. It’s because if I would have this service connected it have been made 100% P and T backdated to 2010 and not 2016 which I feel is right. But I know the drill deny deny service connect lowball keep fighting for whats accurate then fight for an earlier effective date …. Victory years later
  9. Well the amount of medical records needed I beg to differ to be eligible you have to show a diagnosis of tinnitus and or hearing loss tests had to be shown during your service. Tinnitus is 10% of course their max
  10. My first cue claim was cut and dry they failed to look at the evidence . But my denial for bilateral hearing loss was met with the same denial in 2010 as was 2020 and 2023. The only difference is Im wiser Ive stated the use of the 3M plugs at every exam I even brought my pair I wore in to show them. I indeed sent them away to my lawyer for the settlement and finally the paperwork next week will be in my hands to sign to take part of the settlement. Thats the link they were missing to my service connection, my question is do I file a cue appeal or just reopen my last claim with the evidence and ask for an earlier effective date when I was originally denied in 2010? Nothings ever easy just has gotten more confusing
  11. my 2010 C and P didnt provide me with my ptsd dx because service connection was denied until 2016 where I was then given two C and Ps for TBI and one for PTSD so I was 90% rated made 100% TDIU but it was still considered P and T Effective the day appeal was granted in 2016 then poof combined for 100% P and T

Agree my claim was actually a CUE claim filed in 2014 and decided 2016 but they lowballed me but I didnt care I was happy with 90% retro for 6 years but after the next year I went to 100% PT made me think why now its always been P and T should have been 2010 when I got out not 2016 when my appeal was granted
  13. So Anyone successful with earlier effective claims? As you can see the original 90% was backdated to 2010 through an appeal I filed in 2014 granted 2016. My TBI orginal rated 70% then one year later made 100% tdiu but permanent and total then another year later made 100% scheduler P and T. My belief it should have been that the day I got out of the military but had to deal with denials for years until my appeal was granted. I feel like they were trying to save some money by waiting until they did to make me 100%. I have so many issues with it the only reason they bumped me up to 100 is they combined my PTSD one year later. Ive waited this long to dive into this question because of the time it takes me away from things that matter like my two young children
  14. If Im apart of this new settlement from the 3M because I have tinnitus and hearing loss and I have two pairs of these plugs in my possession, would that be enough to establish my bilateral hearing loss claim due to service connection? Guess Ill have to get an IMO to review all my evidence.

Yeah I recieve both when filing ssdi dont give up they always deny and deny they aren’t you have a hearing in front of a judge depending on your case that will be if your award is granted along with retro owed. My SSDI claim took me 11.5 months with help if congressional inquiry when I reached out to my states senators office. Never stop fighting for yourself cuz no one else will… on another note SSDI is based on your past work history as well
  16. Not to say all the above means wait wait wait for those in need. I personal know your state legislator contact them email usually or phone if your in a hardship just say to their office explain the situation if you are then your case is flagged as a hardship and you go in the hardship line. Not years but months depending on the case. Im not saying go homeless for your claim Im saying if it truely exists ask for help….

  18. I have filed for a couple increases since 2016 when I was awarded my P and T for my TBI. But the other stuff was lowballed couple 0s and 10s. I filed an increase on my headaches which were rated at 0 and then in 2019 magically 50%, no backpay just wanted an accurate rating and my tinnitus from 0 to 10 around the same time. If I were you I would get a medical opinion from a heart doctor not at the VA, reopen the claim, submit opinion in as evidence. Watch the Va have a deer in headlights look….
  19. Its not that easy to move in Delaware when you have two minor children and your sharing custody with the ex wife. And then you have limits to the location due to the custody agreement. Very cumbersome especially since she was the unfaithful one for years but my kids are happy so I dont mind dealing with a little stress as long as their happy….
  20. With my SSDI and SMC S disability does that make me ineligible for a pension claim. Ive feel so unaware of this mostly because I was married but now divorced still with two kids, feel like I could qualify now living disability check to the next sucks when taking care of myself and my kids? Or am I missing something
  21. Ok finally after years of pain Im finally got an MRI and have a tear posterior labral my VA doc says Im a good candidate for treatment at a real hospital like the Rothman institute because they are no good at the VA in wilmington…. Least he’s honest For now Im just using KT tape just to be able to keep using my left arm
