  2. Once again I am grateful for the concerns and replies......so far I am liking this forum. For everyone info I dug out some recent letters from my attorneys and I also emailed/talked with them. They recently (Nov 20110 requested my claims file and are awaiting on its arrival concerning my NOD of the effective date on my last rating. In a Nov 3rd ltr to DVA regional office they filed the NOD for the effective date and at the same time filed a"SUBSTANTIVE APPEAL" to the "statement of the Case" they received on 31 Oct 2011 for my original case to increase my disiability from 20% to 100% due to TDIU. Looks like a waiting game as everyone knows. Does this sound about right to everyone. Am I looking at 2yrs or more. My contact and contract started with this attory started in March of 2011 and he is at the "SUBSTANTIVE APPEAL" part of my case. Hopefully that is a good thing and I will have my day in court soon. Again. I am grateful and happy with all the replies and concerns....God bless one and all. Wish I had found this site sooner.

    Catch 62

    Seeking advise and any info I can get with this matter. I am at my wits end trying to restore my retirement. Seems that PL97-253 aka Catch62 Law because it kicks in at age 62 allows the Office of Personnel managment to reduce a veterans pay by the number of yrs of service unless he/she pays an amount of monies as determined by congress in to the SS pension fund for the yrs he/she servved their country and they retired from civil service under CSRS (Civil Service Retirement System). I fell victum to this enforcment action in 2008 when I turned 62. I appealed my case to the MSPB and won. They (a Federal Judge) told OPM to make me another offer on the enforcement action....They Did! they sent me they same letter AGAIN demanding payment $11,000.00. They claimed they sent me a ltr in 1983 stating I owed them 3800 dollars to be put in the SS pension fund. They just didn't mention this fact for the next 20 yrs I worked for the FED. So by the time I retired in 2003 with 7% interest per yr the amount being demanded is now about $11,000.00. Seems the only issue we could not come to terms on was the "METHOD OF PAYMENT" I offered payments since I had just filed Chapter 13 bankruptcy to protect my home from foreclosure but they DEMANDED a "LUMP SUM"....said "that is the LAW". I appealed this action all the way through the appeals courts and lost since I had to file "PRO SE" (by my self). So! As of this writing the government has taken about $69,000.00 from my retirement annuity for a 3800 dollar so called debt under the CATCH 62 Law and they would not let me pay the monies back by installments. Any advise, help or information as to what I can or should do to fix this wrong will be greatly appreciated. I have ask several senators and congress persons for help with this matter but all accepted OPMs explaination as an acceptiable reason for doing this to a disabled veteran that, explanation being "LUMP SUM" it's the LAW.
  4. Thanks to all for the replies. FYI I am ok and living in a rented home in WV. All NODs were filed promptly as soon as info became avilable from VA and NVLSP. I received my initial VA Comp ltr and check in DEC 2010 after a long process throughout 2010 with a final rating of 20%. I contacted an attorney and they filed a NOD promptly although I had already filed one. This was to establish the fact that they were going to appeal my case to obtain maximum benefits. The other issue with the EED came late last year (2011) when I got notice from NVLSP that I should look in to this matter. My attorney took this action on also and filed another NOD on this matter. I fired off an email to them today demanding a status update on both issues. My main question is....."am I pushing them??" I know it is a long process. PS: I have another issue coming out I invite all to comment on....this one is unbelieveable!!!Catch 62!
  5. Got rated and comp back pay (???) in Dec of 2010...final rating was 20% (OMG) for Ishemic Heart Disease (IHD) due to AO exposure. Had a triple bypass in 2005. Also, I was already drawing 10% for an in the Army injury. I promptly contacted a law firm and the took my case in Fed of 2011andnthey said they could get closer to 100% since I am totally unable to work. Have not had a lot of interaction other than passing some forms from VA back and forth. I was told at one point by an assistant that I may have a Fed 2012 court date but can't find it on the Appeals court docket. Anybody got any advise??How long with a lawyer does/can this take. Got a letter from NVLSV(?) stating I should investigate the effective date of the rating. I contacted my attorney and he filed a NOD in Aug 0f 2011. Have not heard anything to date about that issue either. Can anyone shed some light on this matter. When NVLSV contacted me they kinda indicated this would not be along process. Any advise and info would be greatly appreciated. I lost my home of 17years in Oct 2011 to foreclosure and am in dire straits.....God Bless America.
