  1. Ok Berta. I called the VA hotline this morning. it seems like they have my submitted evidence in the system. The person I spoke to also seemed puzzled by the VA dissicion. He said the evidence was submitted in the system August 21. But I have USPS record showing that he mail arrived on July 30. The problem could by the 60 days deadline to submit all the supporting documentation. Well, I think I should do a letter or reconsideration. What do you guys think ?

  3. Well sir, I I probably have saved the IRIS communication numbers. I have to go through my documents today. However, USPS certified mail don't mean anything ? I thank you for the information. I will look for someone to represent me through NVLSP
  4. Hello fellow vets. I just received a decision letter today regarding my proposed incompetent issue. I was so angry words can not describe it. It seemed like one guy just decided to screw me up just because. At least that's how I saw it. Ok here is the story that led up to that I received 100 SC with proposed incopetancy last year in June Immediately with in the 60 day window I sent a letter disagreeing with their proposal and asked the monthly check to continue. Immediately after that I went to a VA neurologist to make an evaluation concerning my ability to handle my finances. She gave me a three hour evaluation and said you are more than competent. She wrote me a letter and I sent that letter along with my financial records as evidences to the VA. ( USPS certified mail) After few weeks I called the VA If the received it and the said yes. To be sure I called the following week and the answer was yes. I waited nearly a year for the decision. Finally, last week ebene confirmed that the decision has been made and to wait for the decision. This morning the decision came in the mail and it was just awful. The letter said "we allotted 60 days to submit evidence to support the contrary. To date, you have no submitted any additional evidence to support your claim. This proposal is now final and you are considered incompetent ... OK gals and guys, what do you do when the VA clearly try to screw you based on lies Sorry there so many VA employees that are very good however, on this particular case someone just said screw this man. What happens NEXT . How do I appeal or get a hearing or some kind. This kind of decision should have been made by a judge and a lawyer on your side. This is just same full That you my fellow vets for hearing me out and vent some anger Than you

Thank you Carie & Sharon Carie, sorry for my misunderstanding and what you said makes a lot of sense and that is what I am going to do Ok this is what I am planing to do As you suggested, I am going to send a letter to the VA requesting a personal hearing ASAP Then within 60 days, send them supporting evidences showing that I am competent.
  6. Hello Carie. It was kind of confusing what to do. There are so much conflicting information floating around the Internet. I recently read someone's suggestion on vawatchdog. This person said to write NOD with the tittle "This letter is a Notice of Disagreement with your proposal to consider the appointment of a fiduciary." So is that wrong? Or I just need to write a brief letter describing my competency.
  7. Hello follow veterans. Your continued support has been a blessing The Va is proposing incompetence and I have a couple of weeks to send them NOD along with supporting documents. Someone already mentioned that having IMO is very important. I am searching for a psychiatrist in my area. I not sure what I need to tell them. Do I need to get a full evaluation? which I think will cost a fortune and I don't have that kind of money to begin with. Does anyone went trough this process? How much does it cost? Is there a specific way to write their opinion to the VA or just a simple letter stating that I am competent or incompetent? Do I need to take my medical document with me? I know I am asking too many question. I will appreciate your help in advance. Thank you!
  8. Thank you all for your great comments! My original RO was Baltimore. However, they referred the case to ST Paul, MN in April. I can't believe how fast they processed the claim. I will definitely appeal the if they find me incompetent. According to Ebenne, they opened a new claim for incompetence. It seems like they are moving that way. You guys take care !
  9. First of all, I would like to everyone on hadit.com. Without your help I don't know it was possible. Today, I checked ebenefits and found out that i have 100% service connection with no further exam. That was great news. The funny part is due to my depression and all, I could not get exited like I wanted to. That was weird. My biggest concern is the incompetence part. During the C&P exam, I told the Shrink that i had some problem forgetting to pay my bills . However, I did not tell her that I make big mistakes when it comes to handling my money. In fact, I survived all of 2011 with a little bit of GI bill income and still my credit card accounts did not go on collections. I do not have any collections to begin with. However, there are a couple of missed payments. That was due to not having adequate income. The second part is I wanted to continue taking college course. I usually take just one a semester and it has a positive impact on my PTSD and anxiety issues. Also, if they find a new treatment for PTSD in the feature, I have something to fall back on. However, doing nothing and VA reeducating the benefit for some reason will only devastate me more in the feature. For those wondering what I did to receive this benefits, I have one advice, Be consistent with your case. Just tell them the truth. That is the only way you can be consistent.   10. Thank you everyone for your great posts. I am not sure if the Va is going to award me more than 60% for my PTSD. At this point all I know is my GAF score is 52, my conditions are SC according to the C&P examiner , and I was declared incompetent for to handle my finances. It would be crazy to get a rating below 60% and letting someone handle your finances. I decided to wait till I get a decision. Thank you for your suggestions!

As always I appreciate your help About two months ago I had C&P exam for PTSD, depression, etc. I am not shure how long it's going to take before it goes to the rating board. currently I have no job, no income and it's slowly destroying me. The last job I had was in 09. Did not last 3 months. I resigned before getting fired ( too many complains about my performance at work ). I started using GI bill to servive, taking one and two classes a semester. However, I was barely living due to depression. That is when I filled for disability because I could not no longer lie to myself that I am ok and get through it. My question is, is it possible to file for TDIU before getting a rating?
  12. Thank you Berta and Pete53 for your responses I have two Combat Action Badges on my 214. I hope that verifies the stressor. I have not received the VCAA letter yet. I will be very happy to send them whatever documentation they need. I recently checked ebenefits and they have a list of items they needed from me. However, they said they can get my medical information themselves after sending them the consent form. I am a little confused about that. Should I go ahead a get this records myself and send them anyway? We will discuss about it on the PTSD forum. thanx
  13. Hello, first of all I thank everyone's willingness to share their experiences with the VA. 9 months ago, I filed claims for PTSD, headache, Panic attacks, and depression. I have been battling this issues for three years Hoping that they go away. However, I became exhausted and lead to the filing. at one point I went the an emergency room(civilian) because I was extremely depressed. They did not know what caused it because i did not tell them about PTSD problem. I just told them relationship problem with my wife. ( I thought PTSD issue will keep me from getting a government job down the road). I also went to the VA emergency room and told the doctor about my panic attacks. He told me it was a natural response to a stressful memory and told me ways to calm myself down. However, I never went on any treatments or seen counseling by anyone because I was just depressed and doing self medication route. Recently I had a C&P examination and here is my diagnosis diagnosis 1: Posttramautic Stress Disorder, Chronic Axis Category I diagnosis 2: Depressive disorder Axis category I Axis II - medical diagnosis : headaches, panic attacks Axis IV: marital problems, employment problems Axis V GAF 52 I was also found incompetent to manage my financial affairs My question is even though the C&P examiner diagnosed me with the conditions, does not having enough medical (except going to the emergency room on two different occasions) and treatment record affects my ratings? It is acceptable to file for PTSD beforehand without being diagnosed ? I haven't worked in three years, I quest a good government job in three months because of my condition also my marriage ended, what kind of evidence should i send the VA about my employment and marital problems? should I wait for their request or I should just send the documents now? thank your for your replies
