  1. Okay, I printed the VA Form 3288 and will specifically request Everything in the C-File; or the whole nine yards. My problem is after my denial was received the Legion Rep. refused to communicate with me anymore, and since I filed the claim by myself no one really wants to help. I used to get NSC pension before SSDI and a Naval Hospital treated me for "adjustment disorder with signs of stress" and prescribed Buspar medication; I was also recommended for a medical review board for administrative separation. I did not get a medical board hearing after 3.5 years active duty; I was retained in the service for thirteen additional months with my ordnance certification revoked due to documented anger issues/problems and given a lesser menial job just for harassment. Naval hospital records although showing adjustment disorder with signs of stress, and medication (Buspar) prescried may indicate a personality disorder as a way to separate me administratively without benefits; so I refused an article 13 captains mast which I demanded courts martial and they refused. However on the NAS JAX Hospital it says clearly "DNEPTE" meaning did not exist prior to entry. So how can I be denied adjustment dx with signs of stress, because they were pissed off I wouldn't take an OTH so the "system" marked my hospital record with personality disorder and immediate seperation. The seperation took 13 months and I received an Honorable discharge with a RE-4. Question should "DNEPTE" overide the asinine rubberstamp of personality disorder? I only have about 5 months to appeal or ask for reconsideration before my year is up. What should I do? VA Form 3288
  2. I got a copy of my C & P notes and could not believe what I was reading. Every radoligist impression from 2003 to date say post traumatic deformity and post trauma arthritis. The examiner said "...the veteran said it is not painful and does not flare up!" Some of the x-ray reports say "work copy not for medical record."
  3. Thank you bluevet I am looking to get an IME from a psychologist to connect service and current; my issue with misdiagnosed personality dx is that on the naval hospital record it has that acronym top center of the page "DNEPTE" did not exist prior to entry.... once I recover this depression.
  4. Yes I have been followed by VA and private physician for bipolor dx amd mood dx nos and ADHD continous treatment for 8 years, I was granted NSC Penson because VOCREHAB said I was not fit for the program, and SSDI ALJ granted SSDI due to mood dx NOS & ununited fx of dominate hand.
  5. Yes, unknown to me was the active duty dx personality disorder of 1990. In 1998, I filed a claim for fracture of 5th metacarpal (boxer fracture) this claim was due to the chronic pain of post traumatic arthritis’s in my dominate right hand, and being a truck driver jamming gears everyday was painful, so this was no cry baby claim, and it was granted SC at 0%. After Y2K I became suicidal over many things, and was a chronic chemically dependent person until 7/7/2007. After many rehabs relapses and setbacks, I achieved sobriety at the above date in 2007 learning the addiction was a symptom of a condition. I have a "problem list including several labels; however I have the following diagnosed mental health conditions: ADHD, Mood Disorder NOS, Bipolar Disorder, and Anxiety. Physical diagnosis include mal-union fx distal radius dominate wrist, herniated disc at T-9, L-4, and L-5; with a congenital stenosis inoperable. None of these conditions are Service Connected. In 2008 I filed a VA claim for benefits for depression, and increase of percentage of 5th metacarpal, bi-lateral hearing loss, tinnitus, and non-service connected pension. I was granted the non-service connection, no increase for 0% fracture, and SC 10% for tinnitus, the denial stated I was treated for something other than depression, so I got the records to find personality disorder diagnosis primary for previous treatment for adjustment disorder with signs of stress. I also filed for and received SSDI Award for Mood Disorder, and Post Status wrist fracture. I refiled last year for every mental health conditions on my "problem list" and increase of 0% metacarpal fx/arthritis; a psychiatrist wrote a nexus for current mood disorder more likely than not started as an adjustment disorder diagnosed in service. It was just denied. My thoughts now are the claims should have been simply for current NSC Mood Disorder exacerbated by the SC 10% Tinnitus; then list all of my other NSC physical conditions. At the moment this is a depressing denial, and there are no expert local resources to help. Thank you for any opinion. Best regards,
  6. I have also learned I had an active duty dx of personality disorder. However I was retained in the service after the 72 hour psych ward visit for one year; total time active duty 4.5 years. The very document diagnosing PD is contradictory in that the top center margin (top of page) has the acronym DNEPTE I searched for days attempting to learn what this arcane string of letters meant; simply means "did not exist prior to entry." So I finished duty separated honorably at EAOS with codes LBK/RE4. I was granted war time pension, then SSDI, and then dropped NSCP to receive the 10% compensation. Hint; hospital records are located in a different location than medicat record; they do not want you to see them. The county VA service officers are not effective advocates.
  7. From what I have read "personality disorder" is not compensable, however I believe it to be a misdiagnosis as the secondary dx was adjustment with signs of stress. Usual action is to separate on the spot; I was retained over a year of dx separating at EAOS The acronym DNEPTE did not exist prior to entry is top center of Naval Hospital inpatient record. Claim for adjustment dx and acquired psychiatric condition were denied. I am SC 0% fracture of 5th metacarpal 10% tinnitus; however I've had mental health issues since third year of active duty; entered March 1986 separated September 1990. Honorable discharge characterization with codes LBK RE-4 VA has many mental hygiene issues documented, but I cannot find competent assistance locally 35904 Gadsden, AL I understand if re-filed with a NEXUS for the 10% tinnitus exacerbating the current diagnosis of "mood disorder" and ADHD I may get benefits. Can any weigh in with experience or referral to competent liaison near my area 35904? Thank you for any insight.
  8. Berta Well, the big envelope came and it was bad news. I filed myself using VBA findings etc... My county Veterans service office is not effective as an advocate, and frankly I felt I knew more than they did considering they claim to have no knowledge of this site. I joined the Legion, and quickly learned "this claim is a mess!" That service officer has not got with me since getting the denial almost a month ago. I cannot understand how the Navy diagnosed adjustment disorder with signs of stress, VA notes support the military diagnosis, and a had a nexus letter from a psychiatrist stating that my condition "more likely than not" was more likely than not related to the Military diagnosis. Can one appeal "de jure" meaning as a mattaer of law RE: previous VBA remands allow such? Really confused with access to much help.
  9. eBenefits indicated claim complete today 8/20/2015 notification of decision -or- award sent U. S. Mail; no other information under any tabs indicate award Ab8 or Letter of proof of benefits still says 10% and the amount effective as of last month of last year; as always. I will keep everyone posted when package arrives.
  10. Checked eBenefits today and it said pending decision approval; notification letter sent. It went back and forth from preparation for decision to gathering of evidence a few times, and now hopefully this means I was rated pending approval.

  12. Thank you to Tbird, Berta, Mikemmlj, Pete53, I am new to posting, and not even sure if I posted to correct menu choice. I was just really concerned about the quick one hour C & P, because I chose on eBenefit to "Decide Claim now." Thus I had a Nexus, Navy diagnosis, and VA problem List/Progress notes. The Legions officer did not offend me by stating my claim was a mess, because I filed it with no assistance, so in a sense it was throw a lot of issue on the wall to see what sticks; since depression was denied. I also believe having been a NSC Pensioner and now SSDI I will have a reasonably prepared answer less the rushed one hour C & P. I will be sure to let everyone know he outcome.

Okay, I found what sixcents MCPO had to say awhile back the thread is now locked: Adjustment disorders are compensable under CFR 38, but.... as stated by Hoppy it has been MY experience that they do not award under it for some reason. Now this is just MY experience but I firmly believe that the service branch and the VA both use it as a tool to under-rate both medical discharges and VA ratings. Put simply I believe the VA AND the service branch uses the term "adjustment disorder" in place of more specific diagnosis like PTSD, or Mood disorder- depression, or panic disorder. I have seen again and again where they have service connected it at 0%, or simply denied service connection completely. In my case the acronym was used “DNEPTE” literally means did not exist prior to entry... I had no idea what DNEPTE meant, but it sounds favorable to me.
  14. I did read that Chronic Adjustment Disorder was now compensable; on this site. Why I ask did they even preform a C&P if what the military said is not recognized?

"A brief generalized accounting of the trauma…"___At 3 1/2 years into enlistment and one deployment my evaluations went from 3.8 & 4.0 to a 3.2 because of the filing of a UCMJ Article 138 complaint (I placed skipper on report). ___Needless to say the last twelve months of my service was not very pleasant! I was later denied a transfer and demanded a court-martial to clear my name. They sent me for psych evaluation= Adjustment disorder with signs of stress. From what I have read I was supposed to be separated on the spot, via medical review board, but I suppose since I demanded a court-martial some brass would have leave the service with me; so I kept my stripe and spent the next twelve months in 1st Lieutenant. RE4 LBK Characterized Honorable! I have also read this diagnosis is compensable and gateway for acquired psychiatric disorders since the acronym DNEPTE is on the documents. No, they refused to give me a court-martial.
