  1. Bertha , the DeLuca is not warranted for spine or hip. For my ankle it has been considered and applied under 38 CFR 4.59.

  3. Does anyone know how the c&p exam is done for a sleep disorder due to pain from ankle, back, hip and tinnitus. I have pain at night that keeps me from sleeping. The tinnitus is the most problem, the ringing is just too much at night it keeps me up for hours and when I wake up in the middle of the night from pain the tinnitus ringing starts all over ( it never stops).   4. After 16 mts it got here, 30% is my award. Break down is as follows: 10%-Thoracic spine Strain/T-12 Schomorl's node 10%- Right hip Strain with limitation of extension associated with right ankle sprain 10%-Right ankle sprain 10%-Tinnitus 0%- Right hip strain with limitation of flexion associated with right ankle sprain Denial Bilateral hearing loss I would like to thank everyone here at Hadit for the information has been a great help. I was not sure to even apply because I did not have much medical records from the time I got out until now (17 years). I have had problems for years but did not go to the doctors like I should have but that will change now. The award is fair for now I know the problems will not get any better, but at least I know I can get the help I need. I still need to put in for a sleep disorder due to the lack of sleep (3 to5 a night) due to the pain from my back, hip, ankle and tinnitus. I should have done this when I first filed. It is in my separation physical that I had problems sleeping so maybe that will help. My medical records is what helped me on the first claim they all showed the problems I had when I was active. Thank you brothers, sisters and hadit.
  5. Mark, my completion date has been changed three times I filed in November 2011 had my c&p exam done i think it was in February 2012, My completion date is February 2013 (OK). My RO is in St.Pete,Fl. I hope this time they are right. E-Peggy says they are still gathering evidence. I have sent all my records in, and my C&P exam was in my favor. (Just like the military hurry up and wait)
  6. I had my C&P Exam 7 mts ago it seemed in my favor I am still wating on the decsion. How long are the exams good for, I know their is no time frame before a decsion is made. I hope it is soon.

  8. For the back and ankle is that based on ROM alone or can pain on ROM be also a factor. For my back I do have ROM of 70 foward flexion,50 painful motion begins,25 extension ends,15 extension painful motion begins,30 lateral ends,20 lateral evidence of pain begins, 30 lateral ends,20 lateral flexation evidence of pain begins,30 right lateral rotation ends,20 lateral evidence of pain begins.For the post-test forward flexion ends 70, post-test extension ends 25,right lateral flexion ends 30,left flexion ends 30, right lateral rotation ends 30,left lateral rotation ends 30 . For the ankle ROM is planter flexion end 40,planter pain begins 30,dorsiflexion 15,dorsiflexion pain begins 10,post-test plantar ends 40, post-test dorsiflexion 15.
  9. I got the C&P report from the VA hospital at the ROI. I walked in and Got it released to me. The only letter I have gotten was two stating they are working on it. (No award or denial letter) I dont know how long it will take, hope soon. Do I still need a IMO or what the VA doctor stated be all that I need.

For my back and ankle the opinion states the Veterans current right ankle and back disabilities are incurred in or caused by his active duty service as well documented in his SMR. Separation physical showed recurrent back pain and ankle sprain in 1993. My question is what does all this mean.

  15. Thanks for the reply mine was done at the VAMC I will try to get a copy. If I see that it is not good can I still have a IMO put in before they decide my claim even atfer Six mts.
  16. I had my C&P and Hearing exam back in Dec 2011 how long before I can see the doctors reports,and how can I get them if their isv a chance. I have not heard anything , my exam was done in St.Pete, Florida.
  17. Admin I singed a ROI and I submited the records I had. I also have another doctor working with my ankle can I still send in any reports or IMO sence I have not revived a decision yet. And thanks for anwsering the first and second question that helped.
  18. I have a rep from the state at the VA hospital in St.Pete,Fl He started the paper work for me. I have had a C&P exam. The doctor At the exam said she has seen my medical records she looked at my issues and did ROM test on back and ankle. Does the doctor that does the exam states what she thinks is or is not the problem, my private doctor did test, x-rays ,etc. All that doctor did was look at my back and ankle with her eyes and hands.The only records she had was from when I was in the Army and my ETS physical. My private medical records were not even sent to the VA befor the exam. I filed 12 November 2011 and had the exam 18 December2011. I had thoes problems put on the physical papers before I got out. The doctor seemed ok and even thanked me for my service as I was leaving. Just dont know what to expect.
  19. john999 , am I able to make appominet at the VA with out haveing a service conection yet rated. I dont even have a VA ID card I applyed and they told me the rules changed a few years agoI need to have a ratring to get one even 0%.
  20. oldranger821, I have evidence in my army medical records for treatment and have them at home good point about having them put in my out side doctors records i have done this with my ankle doctor. He said he will write me a letter to the VA stating my ankle problem is related to service. He worked at 3 Va hospitals in the past. This doctor is a new one I just started going to would it hurt to send tha letter to the VA to add to my c&p exam report since I have not heard of their out come of their findings. My C&P was done back in Dec.,2011 and still wating
  21. Pete53 I think I have the evidence from my own medical records it is just i dont have a lot from over the years i have been sucking up the pain. I am able to work but in pain, but at night I lose sleep from the pain and the ringing.
  22. Hello, I am new to this. I have been out of the Army since 95 I have been having problems with my ankle (right) from two Sprains, Back problems, and ringing in the ears, hearing loss I was 12B Combat Engineer. My problem is I think I wated to long to do anything. I have started the process to file a claim, I have had my c&p exams wating on the anwser. My ankle has pain ever since the army I have been assessed with Arthritis,DJD Ankle and Foot,Ankle Instability from my own doctor and I now were a ankle brace. The ringing I was told was Tinnitus. My back has lower scoliosis, DDD. I have my medical records from the army and they show my ankle sprains,back problems and my hearing tests H1 profile routinley exposed to Hazardous noise. My wife has been trying to get me to go to the VA for years. I guess my question is do I have chance at getting approved after wating so long and any Adivce would help. Thanks Sapper101
