  1. Hello I am 100% P&T and on SSDI. In the past I was involved in the Voc rehab program but dropped due to health issues. Not that I am getting SSDI and approved for Chapter 31 benefits will the SSDI benefits be affected if I return to school part time? Will the stipend be considered income?
  2. I was told that I am approved!! I was sent some forms to verify all the jobs that I held since the onset date since 1997. So I guess they need to come up with a new onset date. The case manager said that he was not sure how much retro pay I would get since they found me to be disabled over 10 years ago. Why would they determine the onset date back to 1997 and I filed a claim last year? I want to say thank all of you who offered me help.
  3. Voc Rehab in Sunrise is a total joke. I just filed a complaint against my so called Counseler. The woman is just there for a paycheck. It has been over 3 months and I can not get a hold of her. I keep leaving messagaes on her VM and e-mails and no replys. I contact several other workers there and leave a message with them. I then call the 800 number and explain to them that I am not getting any replys from them.

  5. I'm trying to find a Lawyer to file for SSDI again. I want to find a Lawyer that deals with Disabled Veterans issues since I'm 100% P&T. Most of the lawyers that I spoke with seem only interested in making a buck. I know that is waht they do for a living, but I need one that knows both the VA and SS systems. Where can I begin to try to find such a Lawyer in Miami, FL? I've contacted NOSSCR for a refferal, but when I asked two lawyers they did not seem to know much about Veterans Affairs. Can anyone help? Thanks
  6. Wow that is crazy that you would have to threaten with a lawsuit. My old empolyer says that I have to deal directly with Merill since I no longer work for them. I contacted them and they say I can get 80% and that I'll have to deal with the IRS about the 10% penelty. So do I need Merril Lynch to write it up as a hardship withdrawl?
  7. I have a 401K that I want to withdraw and want to confirm if I can use VA Form 21-0172 to avoid the 10% penelty for withdrwing early ( I'm younger 59 1/2). I called the VARO and the lady I spoke with never heard of VA Form 21-0172. She said that she had to ask a supervisor and got all my info. Has anyone here used this form before? I'm 100% P&T.
  8. I have a question. If I still get treated by my private insurance for service connected issues, would the VA be responsible for reembursing the Insurance company? In other words can I flip it on the VA? LOL
  9. It sucks that I'm 100% P&T and I go to the VA to get treated for SC issues only, yet they are still charging UHC for my treatments. UHC is doing an audit of all my charges hopfully they will get there money back. The Nurse at billing was a total bitch. She got very defensive when I question her why she is charging UHC for SC treatments? Anyhow I notified the IG about it and now she is calling me kissing my ass. I hung up on her. I'm through with the VA. I'll go every three months for my SC checkup and make sure that the Doctor rights SERVICE CONNECTED, or I'm walking. I'll go get quality care at a real Hospital and just take give the VA copies of my treatment records. The Hell with the whole fu&&king system! When I'm ready to die I'll go to the VA.
  10. from this point on I will do my best to stay away from the VA. When I do have to go I will make sure that both the Doctor and the Nurse that see me write " Treated for Service Connected Condition" on all documents or I'll refuse treatment.
  11. Billing contacted me today trying to cover their asses because I called United Health care again and finally they are doing an audit on all the VA bills. The VA billed them for everything the VA did from x-rays to drawing blood for my service connected conditions. They did admit to 1 error out of 36 claims. I spoke with a nurse in billing and she said that getting blood drawn is not service connected. I hung up on her. It is a big racket they have going on to make money. She even admitted that is a way for them to get funding. Yet they hired 4 interior decorators at a cost of $660,000 a year just in Tampa! Ya gotta love the Government. LOL
  12. I just got off the phone with Eliglbility or Finance in St. Petersburg Regional. They check and they show me being 100% P&T. The Lady said that they should not be billing my insurance since I'm 100%. The letter I did get is a EOB. I do not have to pay any co-payments thank GOD. I'm still upset at the fact that the VA is trying to get over on the insurance company. How in the hell do they think they can charge UHC for treating me for service connected conditions? I called United Health Care and they said that they did pay and there is nothing they can do. That I'll have to take care of it with the VA. You would think that they would try to recover their money? ANyhow thanks guys!!
  13. I'm 100% disabled P&T. I get treated at the VAMC for my service connected conditions, but the VA is billing United Heath care for it. WTF!!!!! Is this new? Now I'm stuck paying co-payments to UHC. I thought that the VA is supposed to treat all my service connected conditions for free? If they are wrong what can I do to correct this? Thanks
  14. I understand that I'm not going to get SSDI since I'm working. That was not my question. I can no longer work. I tried and failed. I'm in the process of getting short term again. I'm starting all over again. This time my condition got worse due to work related stress. I just can not work. My doctor said I must stop. Even Voc Rehab turned me down saying I'm not qualified because of my health. So my question is who knows of a good SSDI Lawyer in Miami, FL?
  15. Hello all I just wanted to update you all. I got denied for SSDI!! After all the crap I went through. I was able to make it back to work for 4 months, but I'm getting ready to get fired. My CD4 count is now under 200 and I'm on 4 different Depression medications. Yet I'm still too dam healthy for SSDI. The only reason I'm still at work is because my boss is a friend and knows all the crap I'm dealing with. Anyhow anyone knows a good Disability laywer in Miami?
