  1. Hello, I went to the VA complaining about the loss of vision in my right eye. I was given an exam, testing to take pictures of the inside of my eye. The optomotrist told that the test came back normal and that everything was fine. She increased my glasses prescription by +1 diopter and said goodbye. I had my wife make me an appointment at her eye doctor. They found what they thought was just a detached retina, but after several more visits at specialists they found out that it was occular melanoma causing my problems. My ocular oncologist helped me get the VA to pay for the surgury/radiation treatments. I got home form Memphis and got an express letter from the VA RO risk manager with some papers telling me that I needed to contact them, and a couple pages about my patient rights and 1151, tort claim, and that I could take legal action against her personally if she was contracted by the VA. My question is this: is not catching the eye cancer enough to file a claim? At TDIU how would that benefit me? If I file a claim would they open up all of my current service-connected disabilities in a C&P exam? I'm trying to recover and hadn't even thought about seeking anything from her mistake. Thanks for any ideas on this.

I went down to my county seat, and to the tax collector's office to see if they received my VA form for tax exemption for last year...my title company paid out of escrow, and then they told me that they need a new VA form EVERY YEAR for the 100% T&P State Tax Exemption... Is this SOP? Also, I want my taxes paid since I was awarded 100% T&P back to 2006...has anyone successfully done this, if so how...what form, or letterhead did you use? The tax collector told me that in 28 years she had never paid anyone's taxes back, I asked if anyone had pursued it...she got so angry when I asked who her boss was...she there was no one over her, it was county by county...I told her, everyone has someone over them even the Gov. of Arkansas...did not make a friend, I hate that, but if there is a way to get the taxes back I want the$...if a benefit is available to a disabled veteran, then we shouldn't have to fight local government for it too! I can not get a HUMAN at the VA 800# to get the print out I need...my taxes will be paid in March..gotta go and drive to Little Rock and deal with the mess over there...I guess the battle is not only the VA, but with local government too...I'm being polite and nice, as I am able, to all of them, don't want to burn any bridges...
  3. The VA gave me a form to take to the revenue office, I got the DV tag...what's the difference between DV and DAV...I'm 100% T&P showed then my DOD ID with DAVPRM on the back...still cost me 3.75 per auto...did I get the correct tags?

The 1996 decision was based on diagnoses of the symptoms of PTSD...I wasn't diagnosed until AUG 2006, that was the EED of my recent win; the VA denied the 1996 claim for mental conditions due to nothing in my SMR of being treated for any anxiety, depression, etc...I was treated 8 months after discharge for all of my symptoms of PTSD...just not the diagnosis of PTSD. I will try to black out a copy of both decisions 1996 & 2009 rating when I have time here in the near future. If the stressor going back to 1984 and symptoms mentionmed in the new award stating the treatment back in 1989 (8 months after discharge) and treatment ever since to award me 100% a few months ago, I thought it could be used to prove the EED should go back to the 1996 claim that I filed with all of the current symptoms... Appreciate the input...that would give me something to work on for the next few years...just have that fear of loosing what I've got. A NOD should cause a new set of C&P's should it? I'm actually doing worse now than at the time of the MHC C&P used for the recent rating. Thanks, Boon

  7. The 1996 claim decision is final, so I will just drop it. The symptoms that I had were the same as what I have today...just wasn't diagnosed PTSD. I had a diagnosis of severe anxiety/depression, social phobia, etc. and finally a VA Psych's started talking about my time as a Corpsman, and I had flash backs in His office...something I've hid from everyone for years, so He knew what was going on, and gave me the diagnosis and began treatment, which is pretty much the same as before knowing the diagnosis. I appreciate the info. from you all! Boondoc When you were denied in 1996 did the decision become final? If so you would have to file a CUE. That you might need help with since it revolves around legal issues. If the claim was in the appeals process since 1996 then maybe you could get EED. I would go for it. I think the worst thing the VA will do is deny the EED. You need to make up your own mind about this. You have to deal with the consequences if there are any so you be the judge.
  8. Navydoc2, I have a sleep study scheduled myself. The psychiatrist wrote a consult and the cut my Xanax dose in half...she said it was dangerious for me to be taking so much with symptoms of SA...I'm a nervious wreck now, I plan to cancel the appt. the agoraphobia is not under control with the regular dose of Xanax... Hope you arte getting some good sleep...I sure need some! Boondoc
  9. Hi all, I am wondering about NOD's on EED. I am 100% T&P ( recently got the decision ) going back to 2006, the date of most recent claim; 50% PTSD. I had filed a claim for IU/TDIU with the same symptoms that the VA used in determining that I had PTSD back in 1996, but wasn't diagnosed with PTSD at the time, just exhibited all of the symptoms. I was denied any SC for any psych. problems for that claim in 1996. Would it be possible / realistic to get my EED and award back to 1996? My stressor was back in 1984, and I showed treatment of PTSD symptoms since the event. My wife thinks I should let it go, but I think if I have a reasonable chance of getting the EED changed to the first date that I first filed a claim for the symptoms of PTSD, I should do it; I think she's afraid the VA might take away my benefits, and start back at where I was. Any input and info on people who have filed a NOD on their effect date of SC compensation would be greatly appreciated. Thanks, BoonDoc

I agree with the two other replies...if you can make money, then you don't need IU, at least if I were able to work, I wouldn't put myself through the VA BS...barte3ring might be a way, but people love to talk, and if they think your doing better than them they will make a call to the VARO...happened to my ex-grandpa-in-law and He lost 50% and bragging rights. Checked the bank account this morning...okay I'm smiling now (: Ultra Classic, Viper...all great ideals, but vetoed by the CFO...mortgage and debt paid off..."tabula rossi" kind of like my mind sometimes! I want to post some of the reasoning behind their decision, so later I'll black out the personal info. and get it up for those at the beginning of the journey through the VA maze. Hope everyone is having happy holidays, and may we all see more wins in 2010!
  14. About an hour ago my wife brought me a "big white envelope" from my VARO. TDIU 100% P&T with no future C&P's scheduled. Back Payment goes back to AUG. 2006. I thought that I was 70%, but I was 60% going into this claim. So now I'm Scheduler 80% - 100% TDIU T&P. I got all of the forms for benefits of being TDIU 100% T&P: My wife is so excited, I feel depressed as hell, I don't quite understand why...I was happy when I got a call from the VA back in November 2009, and thought that when I got the "big white envelope" I would be screaming and jumping up and down, as high as I can. Maybe after I process this, I will get excited again. I know that I could have never got it without Hadit.com, and all of you who give advice that can be backed up with the CFR. The letter said I will get the backpay in 15 days from 15 DEC 2009, we'll see...I'll be watching that online checking account every morning for sure. Thank all of you who help people like me to get through this maze of red tape! Oh they denied a bunch of the claimed disabilities I claimed SC for; right now I can't handle dealing with them...maybe I'll mark the calendar for 3 months away and then re-think my strategy...or is it even worth it? Lady-T, thank you, blessings and peace to you for this site, and all that you do for disabled veterans!
