  1. @AF1982 how did you win your Sever claim with the VA did you have a Lawyer? the VA is trying to do that to my husband he had a hearing today for the VA to hear his side they didnt even go thru with it because his unit back in 2001 did his L.O.D investigation wrong so VA is going to sever his comp six months from now based on his L.O.D investigation being done wrong by his unit...we also was told that he can go and fill out a DD 149 to summit to the army to get his L.O.D done right..im thinking now is the time to get a lawyer
  2. That CUE was in my husband letter stating that they were gonna sever his comp back in Oct 2012...VA has giving us 6mos to try and get his Line of Duty Investigation over turned which his unit screwed up on my question is will i be wasting my time by filling out a DD 149 or should i just go get a lawyer to fight the Army for me?
  3. Thats exactly what they are saying due to his own willful conduct back in 2001 he was granted 100%TP as an CUE! which is not the case my hubby has not worked and cant work since 2005 when he was discharged from the army.....he cant clap or tie his shoe, groom himself or think clearly he has been to a bunch of QTC and they have granted him percentage increase, this last one for PTSD sent him over now he is at TP with 100%.....The VA is making me crazy with all these big words they type in these awards letters thanks for giving me a little bit of insight
  4. This was my orignal post C& UE was in the letter also they state that it was a C&UE ill post it when i get to my laptop tomorrow thanks for the reply
  5. @Jbasser my Husband was awarded his 100% TP in August of this year and in oct they sent him a letter stating that they are proprosing to severe his comp he has a hearing in Jan of next year to plead his case....he had a self inficted gun shot wound to the head back in sept of 2001 while on active duty in the army his mother had passed in May of that year,he saw mental health on post in August 2001 prior to the attempt to take his life, but for some reason we cant locate any of those records! he was discharged from the Army in 2005 he has not worked since then due to the fact they he has TBI.PTSD and no vision in his right eye and is limited to his use of his right side of his body,he still see his mental health doctor and TBI doctor they have wrote letters to the VA about his condition...is there any other items we need to win our case?
  6. Im trying to get some insight on my husband Service Connection Compensation...In 2001 my husband tried to commit suicide after his mother died in May of that year he saw a mental health doctor on post in August and shot himself in the head in Sept he got of the army in 2005 after serving 6 years in there in 2007 he was awarded 80% from the VA in 2010 he was awarded 100% Unemployment in 2012 he put in a claim for TP well in August of 2012 he was awarded 100% TP the same year in Oct 2012 we recieved a letter saying that they are gonna severe his Compensation due to the fact they found that he was Sane at the time he shot himself...we have a hearing in Jan 2013 to plead his case the rep at the VA told us to get letters from his mental health doctor that he has been seeing since 2007 and his TBI doctor,i didnt know that they could take something back from a seriously disable person? we have been getting the run around with his Mental health records from the army i dont even know where to look...my Husband has a depression disorder,TBI,PTSD and has use of one eye! any help on this matter will help thanks
