I have searched for months and still have not found a clear answer on if I need to take additional action....
I was honorably (medically) discharged from the Marine Corps in 1994. I was paid severance for a cervical & thoracic injury incurred deployed in the Persian Gulf War (1991). In 2010, I began the VA disability claims process. My VA Combined rating is 50% and I am service connected for the cervical & thoracic injuries and the VA is withholding a portion for "Recoupment of Disability Severance Pay".
I have found many references that imply combat related service connected disabililities are exempt from disability severance pay recoupment.
Am I exempt from serverance pay recoupment since I am service connected for the injuries while deployed to the Persian Gulf?
If I am exempt, what do I need to do to stop the VA's "Recoupment of Disability Severance Pay"?
