  1. C and P concludes service connection for ptsd, mdd, and tbi. Attorney states mental health issues are addressed as 70%. TBI, C and P addressed at 30%, with confusing and contradicting write up, denied service connection for headaches and any residuals of the TBI, yet service connects TBI? package sent to R.O. for rating.... How long does the rating part take to complete?
  2. Dear Ms. Berta, Thank You for your reply and insight, I value Your skills of perception and understanding of the VA system. The pdf files above are the C&Ps recently done at the Va outpatient center here in S. A.. The remand was from the BVA, addressing the issues and the need for the C&Ps' have been posted earlier this March. I believe Your statement to the 15 pages remanded by the BVA was; " Looks like many steak and lobster dinners in the future", or something to that effect. I wish I was better on the computer but, am forced to deal with learning all over again with a lot of daily issues... The Nexus is not an issue, as the service medical records reflect the TBI, addressed as severe post concussion syndrome, with symptoms of depression and ptsd.... Applied for PTSD, Major depressive disorder, and TBI.. in 1992, and was denied of course. Spent the last eight years at the VA being treated for the issues addressed in the remand, and the last three years the psychiatrist has been trying to turn all of this into a personality disorder. I know it is a hassle but, could you please readdress the remand and the C&Ps here for that data to help you further understand the claim and its peculiarities.   3. C&P was done on 30 march 2016. Does any one know what this means? Examiner, concludes objective evidence on testing of mild impairment of memory, attention, concentration, or executive functions resulting in mild functional impairment. Concludes, judgement mildly impaired for complex or unfamiliar decisions, occasionally unable to identify, understand, and weigh the alternatives, understand the consequences of choices, and make a reasonable decision. Concludes, social interaction is routinely appropriate. Concludes orientation always oriented to person, time, place, and situation. Concludes, motor activity is normal. Concludes, visual spatial orientation is mildly impaired. Concludes subjective symptoms that do not interfere with work; instrumental activities of daily living; or work, family or other close relationships. Concludes, one or more neurobehavioral effects that interfere with workplace interaction or social interaction. Concludes normal communication and comprehension and written language. Concludes residual subjective symptoms or any mental, physical or neurological conditions or residuals attributable to a TBI. Concludes, mental disorder of ptsd, mdd, and tbi... Moca test results, -1,-1,-2,-1. Total Moca score; 25... Normal range 26 or greater.. Diagnosis: ICD code: Z87.820.. Date of Diagnosis, 1991. Can anyone figure this out?
  4. I apologize Sir, my computer skills are weak at best.... My Attorney agrees with you, it also looks like Tbi, will be set at probably 30%, according to the exam. My attorney, is also looking into back pay from the date of 1992, date of initial claim..... Ptsd, adjustment disorder diagnosed one month after service separation at the Vet Center, here in SA.. Attorney states evidence was ignored and all claims were denied, please refer to the remand posted earlier this year..... This will explain a lot of the shabby job done by the VA, since that date..... 1992.....
  5. Forgive the first effort, injuries have a way of making things difficult..... Twenty-four years of dealing with the VA, and the difficulties at hand ensure negative results..... These are the copies of a C and P recently done at the VA, and leaves me to doubt this system is capable of conducting themselves in an ethical manner. Enjoy the insanity, this veteran is tired of paying the piper; Eighteen Years were Enough !!!! (Remand posted earlier.) Still waiting to address attorney with the results of this remand and the Shabby, Disrespectful, and unethical way in which this Veteran has been treated at the VA hands......   10. Sir;  I have a question?  Can VA doctors go to other VA doctors and have them change specific diagnoses?  What are the validity, ethical, and legal issues involved?  Thank You,  Mark

      Just had a C&P finished for PTSD, MDD, GAD, which are now according to the examiner being service connected.  During the appeals process, had this psychiatrist go to a psychologist, who treated me for 5 years for severe, and chronic ptsd and mdd w/ psychosis.  In an attempt to alter the overall diagnoses to a personality disorder, as the psychiatrist was siding with a diagnoses done by a C&P done in 2010.  The Psychologist, dis-agreed and stated he would only alter the diagnoses to severe-Complex PTSD, which is a BRAVO ZULU to the Doctor that treated this Veteran for 5 years!!!

Had C and P done yesterday for ptsd, depression, and G.A.D., TBI, and Back Injury.  Psych. is going to service connect, and apologizes for the long over due resolution concerning my issues and dealing with the VA lack of assistance.  Tbi, was again done wrong as neurological exam was done and not a TBI exam...  Back condition was also done be the neurologist?  The 23 year battle rages on, any questions, concerns or comments would be greatly appreciated....  Mark

  12. Interestingly, today called C&P and was scheduled appointments for all of the below stated issues in the remand...   Mar 30, 0930; and 1300, should be an interesting day....  Claim has been in progress since 1992, any comments?

This remand has not been followed up on, by the VA since date of receiving the packet.  Attorney made inquiries as to expedient remand processing and a week later received another packet from department of veterans affairs requesting all information concerning case be sent to Evidence intake center Janesville?  What should attorney be doing now to expedite the remand.  I believe this new request has something to do with, the claim for TDUI sent to them march 08, 2008.  Please assist, claim has been going on since 1992 and is still unresolved.  30% no contest from VA concerning;   joint syndrome and fractured ankle still fractured.....

  14. Thank You, Ms Berta and Mr RUREADY. I have the complete packet from SSA, concerning the award for SSDI for PTSD and MDD, would you both care to review it? I am not to good at computers, but will do my best to send a copy here once omitting the personal stuff. My attorney, has submitted that evidence to the VA, which is pretty strange they the VA claim they don't have. Please let me know if you want to read it and I will do my best to post it for the both of you, again thank you for the incouragement and best wishes.... Mark
  15. Copy Sir, did not have any pre-service mental health issues. Issues did not arise until witnessing the death of a pilot I knew well in 1975, at Randolph Air Force Base. Attorney, set up a mental illness examination with a doctor who worked for the BVA, in Washington. This was the straw that broke the VLJs' back as stated, " having a propensity of acquiring a personality disorder does not minimize that same propensity of PTSD and Major Depressive Disorder manifesting during well documented service stressors... Since this is now remanded back to the Houston regional office, how long will it take to reexamine, diagnose, and finish the claims for the above illustrated remand? Sincerely, Mark

  18. medical records state service member undressing in ops berthing and was attacked from behind, diagnosed with classic post concussion syndrome...personnel records before injury were evaluations and conduct in top 10%, rated overall 3.9-4.0...six months after concussion evaluations dropped to 3.0 and was admin separated for high year tenure.....master at arms conducted no investigation for the personal assault, due to lack of evidence, ie: no witnesses or weapon found.... medical records in file shows treatment for Ship power cable exploded in face. shows neurological blindness for 27 hours.... Have extensive mental health history during 19 years of service, diagnosed w/ neurotic character disorder, personality disorder-passive aggressive, depression during service. Post service ptsd, depression, dysthymic disorder, major depressive disorder w/ psychosis, so on so on. Regional office will not service connect. Personality disorder manifested in service and was aggravated by service....Committed suicide in 1979, while in the U.S. Air Force and was resuscitated back from death, one week later honorably discharged. Joined Navy three months later in 1980, one third of my life was spent in the military and the record verifies what I have stated here, have attorney, but feel she is overwhelmed, please advise....
  19. Was first diagnosed in 92, with ptsd, and adjustment disorder one month after separation from the us navy. Refused assistance and treatment at VA hospital because events did not happen is combat....12 years later dragged to VA out-patient center in San Antonio and diagnosed with PTSD, and Major Depressive Disorder. Received treatment and meds for these conditions for six years, until psychologist moved to another state. Was then placed in the star program and stepping stones program for PTSD and Major Depressive Disorder w/ psychosis...Overall gaf during this period of time was 35-40, diagnoses stated as severe, and chronic...Social security disabled for ptsd and depressive psychosis in 2010, at the same was examined by C and P psychiatrist as having a personality disorder, while I was being treated for PTSD and Major Depressive disorder at the out patient center...received nexus letter in 2012, stating ptsd and depression direct result of two extremely traumatic experiences. one- electrocution and explosion of the ships power cable, two-personal assault. Now, I am no longer allowed one on one therapy. am not allowed to take PTSD classes, and must seek one on one therapy at a Vet Center. SSOC denied all claims, and stated my trauma experiences were not persuasive, that the six years of therapy and nexus letters was nothing more than hear-say. What now?
  20. submitted my complete claim c-file to social security in 2010, two weeks after was sent by social security to be examined by a psychologist and a medical doctor. two weeks following the examination was disabled by social security for ptsd...The VA diagnoses was personality disorder.......
  21. the regional office in Houston was unable to verify a personal assault, that resulted in a full blown concussion and drastic changes in personality and conduct six months after. the navy then discharged the veteran for high year tenure. one month post discharge the veteran was diagnosed with ptsd, and assistance was refused by the VA becaused the injury was not combat related. why will the VA not use its own regulations and laws to assist this veteran? which states clearly that in personal assault injury cases a stressor may be confirmed using this regulation, M21-1MR..... please advise
  22. Yes Mam, This is understood. Yet, this documentation and all the other evidence of record, should provide the VARO with proof of non-combat related stressors.
  23. In 1991, was assaulted on board my ship and left for dead. At this time I had just been selected for E-7, and had one more year until retirement. the head injury left me with a tbi/concussion, and a 180 degree change in performance and behavior. Six months later honorably separated from the navy for high year tenure. Was diagnosed w/ ptsd and depression in 1992, from the veterans center in san Antonio, one month after service separation. went to the VA outpatient hospital, was told to put in a claim. requested medical services for residuals effects from the concussion, and was denied assistance from the VA hospital because injuries were non-combat related. Ceased seeing any one else for 13 years, and used alcohol and pot to self medicate.. In 2007, due to inability to work, went back to the VA for help. was told to submit a claim, and received a VA id card. Tested for ptsd, results severe, chronic ptsd.... At this time started treatment for ptsd, and major depressive disorder, continued treatment for six years. In 2010, put in application for social security benefits at the request of my Va psychologist, he assisted me w/ six diagnostic summaries and a complete nexus letter, stating the personal assault in 1991, and near fatal electrocution and explosion in 1982. Are the specific stressors that caused the ptsd and major depression. Social Security disabled me 5 and a half weeks later for ptsd, and a copy of my C-file was all I submitted. Varo states they cannot verify the stressors, yet medical records and personnel files not only verify the injuries, but the changes in behavior and conduct after the injuries.....
  24. first question, submitted c-file to Social Security Administration, they disabled me 6 weeks later for ptsd. appealed original claim in 2008, after the VA denied service connection. Status on the initial claim, still being processed at the regional office, along with the Form 9, submitted in 2010.
