I was looking thru my records last night, They had the back part of my examination record, in my C-FILE, but not the front part, which is where it has a check mark in the box for ongoing back pain at my exit physical exam, they copied the part they wanted, and probably threw the other part away.. thats ok,, I will send them another copy of the part that proves back pain ongoing at time of exit from service. I will do that today. Thats 2 years after initial complaint. And still ongoing after I got out.

Back injuries are complicated as well. what you all are helping me see though. is that thru all the mumbo jumbo they are trying to call it, a spade is still a spade. I have an ongoing injury that was either cause d or aggraviated by my millitary service. they must pay. u

So now.. how does this all come together, the army diagnosis is pars defect at L-4, Possible spine fracture at L-3, (CHRONIC), according to army doc, CONGENETAL, or DEVELOPMENTAL, , according to VA. and last but not least. civillian diag of L-5 grade 1 spondylolysis thesis. (sir your back has been jacked up for a long time) was chiropractors words. ,, its enough to make my head spin. ,
  4. more notes from same Doctor, Your low back is shifted 12.7 mm to the right , you have a mid low back tilt angle of 5.2 degrees, and a lower tilt of 0.8 degrees. This abnormal position of your low back puts increased pressure on your spinal discs, muscle,s bones and nerves. also this condition may lead to premature spinal arthritis and disc disease. SADD. I had spoke with the doc, abt the curve in my spine, that I usually lean to the right to take some pressure off my lower back and alleviate some pain, and he said its quite common, and peopl usually dont even realize they are doing it. over a long time, it curves the spine,
  5. ok moving right along. Here is the most recent report from a civillian doctor, a chiropractor, a highly regarded, well respected, top notch straight shooter in my area. Your rib cage is positioned 30.0mm backward, relative to your penis, and you have lost 3.2 percent of your normal low back curve. L-5 Grade 1 Spondylolysis thesis with moderate degenerative joint disease.
  6. Why the big focus on whether it was acute or chronic? he is a doctor, not an attorney trying to establish a timeline of when exactly it happened. At that time, I was active duty, just trying to get a diagnosis and treatment. I wasnt suing anyone, trying to get medical boarded, didnt get rear ended by the post generals ole lady, (I dont think anyway).. So I dont understand why this doctor completely disregarded the diagnosis to focus on when it happened. Am I just shellshocked here?> is it me, ? Or does it seem strange to anyone else. ? On one hand he said he didnt find anything , then on the other he admmitied some abnormalities were found on xrays.
  7. ok, heres the notes on the sick call report that the doctor wrote as his diagnosis. under specific reasons for request 24 yo c/o LBP X 7 D s/p mvc. Plain films show selerotic Pars defect L4 and poss l3 spine fracture.Please eval for chronic vs acute. ok now the radioligy report. Limited bone scan dated dec 1993 after IV admin of 26 mci of ppm technetium, MDP, delayed images of the lumbsar spine and obliques of the anterior and posterior pelvis are obtained. These images demonstrate normal tracer uptake throughout the lumbar spine and anterior and posterior pelvis. no abnormal uptake suggestive of acute spondylolysis or of an acute L-3 vertebral compression fracture is seen. Impression : Normal limited bone scan of the lumbar spine and anterior and posterior pelvis. This would suggest that the abnormalities seen on the patients radiograph is chronic rather than acute. now this is confusing to me. I know what chronic means,. and I know what acute means. The way that the report reads to me, is that first he says everything is normal, then he says, that there are abnormalacies,found on xrays, but they are ongoing, and not a sudden incedent. how can it be both? To me thats like saying, sir, I find nothing wrong with you, but, your back conditon has been ongoing, not recent one time injury.. WTH???.
  8. As I recall, the first doctor I seen, told me my back was fractured, and put me in the brace, to immobilize me . I could still walk, but not much else. Abt a week later I was scheduled to see another doc on ft, hood. When I saw him, he said it looked like my back was fractured, but it didnt happen a week ago in his opinion. Thats abt as far as it went. I was kind of in shock, and didnt know what to think. The doctor did not really say too much more, or ask me anything, and I think he put me on light or no duty, and profile for a month or 2. When I joined the army in 1990, I dont recal them ever xraying my back, . they made me walk like a duck, check for flat footedness, hop on one leg, rub my belly while patting my head, yada, yada. but no xray. I am certain there was no knowledge by me or them of any back issues, because I would have known, and I did nt. I dont see how the VA can wiggle out of this anymore, with the evidence that has come to light. Im going to mail in the sick call slip to the service officer tommorow, that I found today, where went on sick call a few months after the accident complaining of back pain, and pain shooting down my legs., (definite nerve geting pinched.). Hopefully the overwhelming evidence, will get someone with half a birds brain at the VA attention, and stop the nonsense. What else could they possibly want, a friggin autopsy?
  9. a buddy I have who just got off active duty, got me on that phrase, I guess thats the current millitary lingo for the limitations I described. probably not the best way to describe if it leads people to think I was bedridden, so I will try not to use that anymore,. I dont want to get into the misleading game, like what has been done to me, I will try and stick with the facts. as far as my medical diagnosis, its just all over the place, possible fracture at L-3, Pars defect with sopndylolysis at L-4. And Latest diagnosis from reputable doctor, is Spondylolysis thesis at L-5. The RO was sure to put in the denial letter, spondylolysis WITHOUT spondylolysis theses, which is either a mistake, or a lie. because I have the same evidence they had access to, stating THESIS., which means the vertebre was shifted. 'I also just found a sick call slip; ,, stating, back pain, and pain shooting down legs. A clear indicator of a nerve being pinched according to my chiropractor, not " muscle strain" as stated by va. // I just want to go Puke, after seeing how bad theyve screwd me for 18 years.
  10. sure, deadmans profile means you cant do anything.physical , cant do PT, cant march, cant lift nothing, cant run,cant sit for long periods, cant stand in formations long, ect. Its basically puts you in a useless state. I dont think they do that for a simple muscle strain as the va is trying to say it was.
  11. Was parusing thru my in service medical records, and I found my exit physical report. Where the box says recuurent back pain, there is a check in the box, indicating I was having back pain at the time I exited the army. There are several slips for sick call from back class in pysical therapy, no running , marching, prolong sitting, . Then several profile updates, where the extended the profiles. So I think I have 3 important things. 1/ my exit pyhsical proves I had ongoing back pain and the condition was not resolved. 2/ I have a in service medical record, proving that the diagnosis VA decided for my back injury, was not correct. 3/ I have a verifyable in service accident, that either caused or aggrivated my back. 4/I am still being treated for back pain at the present time.
  12. there are may things they left out. They left out that my initial diagnosis was a broken back, and I was put in a back brace for a week, they left out that I was on deadmans profile for a month, and had several other sick call occasions for my back, and they left out on my exit physical I did complain of lower back pain. They just seem to pick and choose the evidence to suit thier case, not mine. Now the most recent diagnosis. from a highly respected, chiropractor who took several xrays of my back, said that my conditon is definitley, spondylolysis thesis L-5 . s
  13. I seperated in aug 1995. heres what they put in the denial in sept 95. The condition identified as pars defect L4 with spondylolysis is considered congenital or developmental defect which is unrelated to millitary service and not subject to service connection, Service medical records for the period from 3/89 to 7-95 .. ( incorrect date as I joined in mar 1990. }. . show the veteran was in a motor vehicle wreck. on 12 - 1993 with complaint of pain and decreased range of motion of lumbar spine. there was tenderness and palpatations of muscle spams present. xrays showed a pars . 4 defect at l4 vertebre with spondyloliysis and without spondylis theses. ( this is not correct I do and did have the THESIS as well as sponyloliysis at time of accident and I have a medical slip from a doctor to prove it ). It clearly states , very legibly, (spondylolysisthesis). There was a suggestion of compression fracture at L-3. A bone scan was done, in 12-93 showinf no spondylolisis or fracture, and was said to be within normal limits. The veteran was diagnosed with acute lumbar muscle stain due to the accident. In 12-94 he complained of low back pain following heavy physical activities, and was diagnosed with muscle spasms do to overuse. In 5-95 there was a full range of motion of lumbar spine with all test being normal. (I dont recall them ever checking or xraying my back in 5-95). No seperation examination is on record.

If they deny me again, I will tell them I did about 10,000 push ups and sit ups at ft. jackson,, no back pain. slept on a hard cot with my rifle pokin me in the ares in desert storm for 6 months, no back pain. worked on the biggest trucks the army has, for 4 years, carrying the biggest tools and removing the biggest tires. no back pain. Marched 100 miles at the nijnemegan peace marches in holland. no back pain. walked up and down the stairs to the 3rd floor of the barracks i lived in in germany for 32 months . no back pain. last year in service, got rear ended at stop light,, Now have back pain. ME THINKS DAT DID IT.

  16. Also I think that the fact that the doctor put a question mark after " old seat belt injury" could go in my favor, because it could be taken as the doctor wasnt sure if it was old or recent. I recall seeing the exrays, and seeing where the pars was broken. I have never had a bad accident or any type of back pain, nor complained of any type of back pain before that accident, but since that accident, ive had ongoing pain, thats gotten progressively worse. So with all of that being said, if they are supposed to give me the benifit of they doubt, I just cant see how they even denied me back in 1995. So I have the service officer checking into a CUE claim. I believe that the VA either used the wrong evidence to decide my claim, or applied the wrong case law to decide my claim. The evidence was there. Hard black and white, in service, medical records. So we shall see, if they do the right thing. Basically the wording that the va used to deny the back injury claim this time around ,was very generic, stating that there was no new evidence . { well what else am I supposed to submit, if the original evidence was more than enough Im thinking)???.. So I went to an independent doctor, a chiropractor,.... who knows bones and backs better than them.? He said, I has spondylolysis thesis .He said he has seen time and time again, where the army and the VA misdiagnose, and ignore back problems. (I live near ft. hood, the largest millitary base in the free world)., So I sent that diagnosis as new evidence in my most recent reopen. hoping that they will reopen the case because that is new evidence. I also sent proof of when the millitary doc diagnosed me with spodylolysis thesis, while I was still on active duty. and not just spondylolysis. so im hoping thats enough.
  17. The doctor who did my GWI exam at the waco va, told me they are seeing alot of patterns in the ilnesses among gulf war vets, and she would be very surprized, if alot more presumptive ilnesses were not added to the list in the coming years. Kidney cancer is one of the more prevelant ones.

Ive felt all along that the health problems im having, to include kidney cancer, adrenal gland cancer, sleep disturbances, joint pain, short term memory loss, fatigue, all are contributed to the sarin gas. over a period of abt a week, the chemical alarms kept going off, there was a sandstorm I recall, that was really windy., and they went off alot that week, probably the wind pushed the gas near us. we got into mopp4 so much, they started calling false alarms, and we didnt even bother anymore. The Va seems to take a lacadaisical attitude, and discount the facts that we were exposed to sarin gas,. I guess they will deny, and delay as long as they can, like they did the vietnam vets with agent orange. They swould not have even admitted that if not for the big legal action that got it mandated. If this country keeps screwing its veterans over, like it has been, it will soon have a drafted army, becasue no body will want to serve voulentarily anymore. I myself and doing EVERYTHING i POSSIBLY can to get my son into college, and will do anything to keep him out of the millitary. So he doenst have to go thru the same thing im going thru. Ive spoken with many other vets who feel the exact same way.
  19. Troy I would like your opinion on a claim. I was in an on post car accident while on active duty. The civillian wife hit me in the rear with her car, into the back of my car at a redlight, she had break failure. her husband had did a not so good break job on thier car the day before. I was in alot of pain, and went on sick call. I was diagnosed initially with a fracture pars and spodylolysis and put in a back brace and put on a dead mans profile . I went back in a week, saw another doc, and he said back was broke, but not in accident. He put on the medical record . " old seat belt injury " with a question mark behind it. like he wasnt sure. So ok, I was on active duty for abt a year after that. with frequent visits to sick call with back pain complaints. all documented. So when my tour was up, I filed for several different contentions, with back condition as one of them. The va deny me in 1996 said the back condition know as pars defect, with sponylolisis is a congenital defect, and no related to millitary service. I didnt think to much of it at the time, burt recently started research. I looked thru my active duty medical records, and another doctor diagnosoed my back condition as spondylolysis thesis. I recently went to a chiropractor, and his diagnosis is L-5 spondylolisis thesis. He showed me the xrays and told me my back had been jacked up for a long time, and would take years to get results, and there basically were not alot of good options. He told me what happens is the pars bones, that hold the vertebre in thier proper alignment, can fracture from either blunt force inpact such as car accidents. or if they are weak for whatever reason. Then it lets the vertebre shift forward, out of alignment. Then u start getting nerves pinched an pain, such as I have now, and have been having since the accident while on active duty. So I sent the chiropractic diagnosis to the VA. I also sent a copy of the in service medical record where the doctor diagnosed me with spondylolysid thesis. Which is alot different that just spondylolysis. I had never had, nor complained of any back pain, or problems anytime before the on post car accident. I have had pain and problems with my back ever since the accident, and recieve pain meds from the va for it even now. So my questions are, being I filed for a back condition as a generic term, and the VA assigned the wrong diagnosis, and denied me on that wrong diagnosis,. do I have grounds for a CUE claim. ? if not, should I at least win my current appeal? 2. How can I find out, exactly what evidence the Va had at the time they adjudicated my claim , in other words, how can I find out if they had access to the medical slip where the doctor clearly wrote. " sponylolislis thesis. (I have sent the va a copy with my appeal, so they have it now, but I want to know if they had it then.
  20. you need to go see a chiropractor. I thought it was all hokus pokus, but they can be a big help. A friend of mine had a similar neck problem, turned out it was a bone spur, pinching a nerve. And a chiro found it, . They know bones. for 60 dollars, u can get a real good idea whats going on inyour neck. I was mis diagnosed for lower back problem by va, for last 20 years. Now I know whats wrong, thanks to chiropractor.
  21. if the va keeps cutting people off, alot of folks will just say to heck with it, they can take thier pills and shove them, then people will just start smoking marijuana to relieve thier pain. I would think then, the va would start denying care, or denying compensation if one tests positive for marijuana.. we just cant win.
  22. Once the va cancels the prescription, lots of vets dont have a reason to go to the va anymore, because they were going just to get the meds to sell. Something else va should if they are already not testing for, is if veterans who are claiming PTSD and depression fradulently are taking thier medications,. No meds, no compensation.
