I was being treated for a back sprain which they called not significant down playing the severedy which caused spinal stenosis which is breaking down the joints that lubricate my back from constant working after complaining of pain and neck problems when if I was being taken Care of properly the MRI would have been done along time a go I wouldn't have been forced to work and run which caused spinal stenosis
  2. Along with the fact the VA did no Pryor testing but diagnosed me with a back sprain instead of finding out What it exactly was

Today I got results back from my MRI stating I have spinal stenosis, arthritis and advanced degenerative facet changes in my spine which cause neck pain knee pain that is documented that I complained about and are symptoms of What my MRI showed I have and only get worse do you think these findings would be enough for a ftca?

  5. Beta how about this statement to prove it is comorbid... The back sprain is Comorbid with spina biff da because I was never notified in service when I complained of back problems that I had spina bifida which caused a secondary condition which is the back sprain which I am rated at?

I'm rated at 50% post 10% tinnitus and 10% back sprain for 60% but they have yet to rate my wrist condition which I called my base and they destroyed the files with my base record so I explained that to the VA as spoliation which would be them destroying my medical record and I have a claim for head aches secondary to my tinnitus so hopefully I get both of those as well How long does a DRO review take?

The VA found I had spina biffida in july of 2013 after knowing this they diagnosed me with a "back sprain" in august of 2013 in my disabilty claim at 10% so I was going to the VA and the doctors didn't look in my records and see the finding of spina biffida and kept giving me muscle relaxers and never bringing up the spina biffida and as far as an IMO I'm looking for one in Los Angeles ca because I have all of my medical records I requested them before I started my fight because I heard about how things disappear but with my evidence and me being a fire fighter carrying the gear it aggravated my spina biffida

I will check into all of this thank you soo much I have been dealing with this for 4 years now but been in pain since 2006 as far as the spina biffida that was my argument. ..If i wqs born with it i never had any issue with it until i joined the military would that constitute pre existing prior to service?..I have been complaining of back pain since 2006 and that's in my records and I was a fire fighter who had to carry the fire suit and the breathing apparatus which would cause me sever pain and my back is permanently slouched from wearing the suit also I filed a complaint with the EEOC but heard nothing back
  9. Yes the vocational rehab counselor gave me a letter stating that my "back condition" so saying whether it's a back sprain or spina bifida which ever the VA decides along with my PTSD that I am rated at 50% make me unemployable
  10. Sc for back sprain but if it's a birth defect than it could have been aggravated in service
  11. I was fou d to have spina biffida but was not treated or even given knowledge that I had it. Sever back pain which aggravates other parts of my body. They gave me pain medication for wait the regional office called a back sprain in my disability award and the 2 conditions are not the same. They did not provide the proper treatment for my spina bifida which caused me to be fired. I would go to my supervisor about back pain and not being able to work and when they found I had to miss work for appointments they let me go.

Need help so I'm going to shorten my story....I have a service connected disability which prevents me from working that the VA did not inform me of and treated me for a different condition any other doctor would have seen that I had an actual medical condition and treated it instead of assuming it's something else...I went to vocational rehab and it was found my disability prevents me from working is that enough to win a tort claim on the fact that the VA found me unemployable?

  14. Where exactly did you move it to I can't find it lol? And I have an update I file the sf95 on Jan 3 2014 with stating the medical negligence of the named dr. Not telling me I had spina bifida (if they say the spina bifida is something your born with than it was aggravated by service and should have been caught at MEPS or while in service when i got x rayed) which affected me at work caused a secondary neck condition and resulted in me being fired (not being consistent at work due to my sc disability and having to go to therapy, my small company job didn't like me missing work even saying no one told you to join the military and made my life hell eventually telling me to go be treated on a Wednesday and had my termination papers and last 2 paychecks delivered in the mail the day I returned.) I contacted the VA and was found entitled to vocational rehabilitation, during vocational rehab it was found my disabilities prevent me from completing the program and maintaining full time work. Therefore proving my point that my service connected disability regardless of name or what it is found to be caused me to lose my job.
  15. Berta Can you give some advice if I have a SF 95 claim. I was found to have spina bifida in July but the va diagnosed a back sprain to fit the 10% they gave me in august. I was not aware of the spina bifida but complained of symptoms ( uti's, loss of feeling in legs and neck pain which caused a secondary disability . The non treatment of the symptoms affected my work performance and caused me to miss work which caused me to be fired. Since the va was aware of this but did not treat me because they assumed it was a back sprain would this miss diagnosis be considered mal practice?
