  1. Long story short, claim is back in Gathering Evidence... In 2011 I submitted a claim for PTSD... Was denied claim for PTSD and told I had anxiety and thats what I needed to file for. 2013 Filed for Anxiety and this time went to C&P. For previous PTSD claim did not have a C&P C&P last month notes read that DSM-V criteria I do have Chronic PTSD w/ Occupational and social impairment with reduced reliability and productivity!!!! So I sent them a letter at the end of August asking if this would go back to my original PTSD Claim or if it woud fall under the anxiety claim of 2013... I was immediately sent to Gathering evidence and there I have sat... Any insight as to what they are thinking or might do would be grately appreciated.

  3. It is a very strange diagnosis... He said my C&P was for PTSD, but it clearly states in eBenefits that its for Anxiety... To top it off, I had a PTSD claim filed back in 2011 that was denied in 2012 for lack of evidence and they never even sent me to a C&P. SMH
  4. SUMMARY AND CONCLUSION: I conclude the veteran does meet criteria for post-traumatic stress disorder. He does not meet criteria for a mild neurocognitive disorder due to TBI. He is able to maintain activities of daily living including personal hygiene. He has not experienced a significant trauma since discharge, but there has been a worsening of his condition because his PTSD has not been adequately treated. There have not been remissions and symptoms are continuous. He does not have a problem with drug and alcohol abuse. There is not inappropriate behavior. He is in treatment at the current time and on medication but has had many failed trials with SSRI medications and now is having at least an early good response to Clonazepam 0.5 mg b.i.d. to lessen the intensity of his anxiety but not resolve it. His thought processes and communication are not impaired. His social functioning is impaired by anxiety and withdrawal avoidance. His employment has not been impacted by psychological issues. The veteran has continued to be employed despite the PTSD all of this time. No other diagnosis or mental condition was found other than PTSD secondary to a motor vehicle accident while in the service in 1997. He is competent to handle VA funds. SEVERITY STATEMENT: For PTSD, there is occupational and social impairment with reduced reliability and productivity due to such symptoms as depressed mood, chronic sleep impairment, anxiety, panic attacks more than once a week, and disturbances of motivation and mood. See earlier section entitled "SUBJECTIVE SYMPTOMS OF MILD NEUROCOGNITIVE DISORDER DUE TO TBI" for scores related to that issue. See also separate medical/neurological evaluation report for any medical, physical, or physiological effects of TB
  5. Thank Senior... Just crazy that it was in Notifications... Then it updated still in notification to say letters send, etc... Checked AB8 and other form and both said 60% and then it changed back to Gathering evidence and date requested for evidence shifted to 8/8/2014.
  6. Thank you for taking the time to read this. My Major claim is for TBI with MDD and Anxiety with Panic... I went through 2nd Level TBI evaluation and have been seen by Dr.'s for Anxiety and Depression since I got out in 02'. 2nd level TBI said just that. I had a TBI from a serious MVA. I did not receive a C&P for Mental Health. Thoughts? My second compliant is my neck and left leg. During exam Dr said me lookin to the right was just about 60degrees and left was 55degrees... Not sure what that meant, but then she checked my left and right arm and said my left arm had a good bit of atrophy in it and it worried her because of the MVA that I had in the military and she told me to ask my PCP for an MRI because she could not do that. Now, I have not seen my C&P from my neck and leg visit, but my decision has moved forward and I have not had a mental health C&P... Anybody know of anyone getting MH disability with no C&P?
  7. It was never mentioned as being the C&P... Only listed as LOCAL TITLE: TBI SECOND LEVEL EVALUATION STANDARD TITLE: TBI NOTE The Dr. Mentioned that the Eval is not for Compensation, but determintation if a TBI happened... Which in the above post came back as A combination of OEF/OIF deployment related TBI and Behavioral Health condition(s) There were 30 total questions most of them had a,b,c,d add ons to the numbers to include questions like: 16. Please rate the following symptoms with regard to how they have affected you over the last 30 days. Use the following scale (Neurobehavioral Symptom Inventory): None 0 - Rarely if ever present not a problem at all. Mild 1 - Occasionally present but it does not disrupt activities, I can usually continue what I am doing; does not really concern me. Moderate 2 - Often present, occasionally disrupts my activities; I can usually continue what I am doing with some effort; I am somewhat concerned. Severe 3 - Frequently present and disrupts activities; I can only do things that are fairly simple or take little effort; I feel like I need help. Very Severe 4 - Almost always present and I have been unable to perform at work, school, or home due to this problem; I probably cannot function without help. 16-A Feeling dizzy: Moderate 16-B Loss of balance: Moderate 16-C Poor coordination, clumsy: Mild 16-D Headaches: Moderate 16-E Nausea: None 16-F Vision problems, blurring, trouble seeing: Moderate 16-G Sensitivity to light: Moderate 16-H Hearing difficulty: Mild 16-I Sensitivity to noise: Mild 16-J Numbness or tingling in parts of my body: Moderate 16-K Change in ability to taste and/or smell: None 16-L Loss of appetite or increase appetite: Mild 16-M Poor concentration, can't pay attention: Mild 16-N Forgetfulness, can't remember things: Moderate I am just trying to find out what potential disability rating I should receive based off of Dr.s notes if any at all... That way I have someithng to go off of if they try to low ball me? I have also just completed my TBI eye exam and Organizational and memory loss class.
  8. Yes, I went through all of those questions and the results are in MyHealthEVet... the answers I posted above are just two from her Evaluation notes... She is a Physiatrist from the VA... There were ratings I had to answer that ranged from None 0 - Rarely if ever present not a problem at all. Does this help?
  9. Just finished my 2nd Level Evaluation for TBI and these two items stuck out to me 27) Are the history of the injury and course of clinical symptoms consistent with a diagnosis of TBI sustained during OEF/OIF deployment? No 28) In your clinical judgment the current clinical symptom presentation is most consistent with: A combination of OEF/OIF deployment related TBI and Behavioral Health condition(s) I read through myhealthyvet and the Dr. Listed me as having TBI with loss of consciousness and anxiety and depression. I have an open claim for TBI due to MVA (New), Residuals of TBI (New), and anxiety (New). I am currently at 30% for my back and wrists. I am wondering if anyone has any insight on this evaluation and what I could possibly expect and what I should look for... No C&P has been done, but I have been moved to PENDING DECISION APPROVAL. Claim has been since 3/20/13 Thank you for your help
