  1. 1. I had a formal hearing in Albuqurque in July 2007. As a rule how long does BVA take to make decisions.

    2. The DAV rep I had should be fired. He treated me like a criminal at this hearing. I'll make waves about this after I hear from the BVA.

  2. This may be the wrong area to post this, but for the 3rd time my PTSD claim was denied. I even had a damn letter from an old shipmate as evidence.

    My question is how do I find a lawyer ( Cheap )

    I'm realy get close to losn it. the bank wants my house, truck, everything i spent my life getting is goin down the tubes.

    I found a mathematical error on my DD214's.

    I have 20 years 11 days Active duty.

    I already mailed the forms certified mail to get my record corrected.

    I even talked to the va guy his name by the was is JOEL in the Albuquerque regional office to inform them and this JACKASS wanted to argue with me about concurrent receipt, He said I couldn't do it. I said OK and hung up on the fool. Everyone should call this fool and remind him of the Law.

    Thank Everyone for your support. Now I have to wait to get my record corrected.

    You read it right !!!!!!

    I get my 60% VA money.

    They deduct that money from my Navy pension !

    I fact I'm I'm losing $957 a month because I claimed a disability with the god damn VA.

    I'm pissed.....Realy realy pissed and I can't take it anymore.

    I wasted 19 years 11 months and 2 days defending our government to be treated like this.

  5. I just got a letter today and I'M SCREWED AGAIN !!!!!

    I have 19 years 11 months and 2 days active Service is what I was told.

    They forced me out on a medical disability !!!!!!!!!!!!!!!!!

    I wanna hurt somebody so bad !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    Ain't this country great to treat us this way . I feel like I've been kicked in the head.

  6. It's probably cua viet And Ive been searcing in both area's.

    I've found 1 person thats doing a buddy letter so far. The sailor I talked to when I called the ship was more impressed I was still alive but couln't realy help.

    I wish I knew more about the CORPs but I don't. I made a lot of Marine friends on the Ogden and Tuscaloosa, good memories. I think I will wait and see if the ships log comes in.

  7. I've been Googleing it so much lately my eyes are going googley.

    I've followed everones advice and I just know that out there somewhere is a little known place that I can find proof the USS OGDEN LPD 5 was off the coast of Vung Tau from 16 to 24 December 1969. Maybe one of the Marines out there would have some info of where to look.

    I've been told to get a buddy letter from some of my old shipmates. Is this a standard form?

    Would a regular letter or email be good enough ?

  9. I was denied my PTSD Claim today because they said I couldnt provide proof that I was on the USS Ogden LPD-5 in November and December 1969. We were evacuating the 3rd marines out of either vung tau or quaviet ( My spelling sucks and also my memory ) we were designated as the morgue ship. If anyone has any ideas on how to get the ships logs I would appreciate it. I heard the National Archives would be a good start or the Navy archives. Any help will be greatly appreciated.

  10. I received my brown envelope today and at first I was too nervous to open it, but after an hour of pacing and looking at it I got the courage to open it.

    Herniated nucleus pulposis with radiculapathy/ 60% / effective date Jan 23, 2004.

    They still denied the PTSD but I'll make a post about that later.

    Now my concern is, will I loose money? The letter says I can't draw my Navy pension and the VA disability at the same time. What kind of Bull Sh*t is this. Am I being punished again or What ???????

    I need some advice soon I'm not gonna go postal but I am in the mail room.

    Back to reality I guess.. I did get 60% for now and I will go after the rest of it starting tonight.

  11. I had my very first C&P today with the Ortho Doctor in ALBQ. and I feel I was treated with a lot of respect and professionalism. We reviewed my mediacl reports from 1985 and He tested my motion ranges as he should and when he was done He told me he fully agreed with the findings of a herniated disc ( L4-L5 ) vertebrea and the civilian diagnosis of degenerative arthritis in my spine. He also said in his opinion it was definately service connected. Mostly because of my militery medical record. I was going to ask him why the VA denied the claim 15 years ago when the Navy made me retire after 20+ years for the same diagnosis but he was being very professional and I didn't want to piss him off.

    I have read of so many bad reports about C&P exams I was surprised how well it went. Right now I feel like a huge weight has been lifted off of me because of worrying about today. I just hope my appeal moves along faster and the VA pays attention to the C&P Doc and I get service connected and maybe I won't have to pay for every visit to the local clinic and they will quit billing me for my six week stay at the PTSD clinic in the Denver VARMC last year.

    I am hoping that I don't get my hopes shattered, because I need some good news.

  12. I'm not 100% sure by your post if you are already SC for PTSD or not...it's sounds that you're not, but could be, in which case I would not hold my breath waiting on the VA to evaluate and rate your PTSD.  You will need to open a claim specifically for PTSD and follow the typical guidelines.

    As far as time is concerned, you won't get a definitive answer from anyone here, because every RO is different and every case within an individual RO takes different amounts of time to process.  It is best that you play an active role in the process and follow your C-file from the RO to the doctor and back, getting copies where you can.  It also helps to make some contacts within the RO to expedite your claim and to ensure that it touches the least amount of hands (IE - mailing evidence to general addresses means several other people, including the raters, will touch your file at some point)....my contact in the RO takes my wife's evidence directly from us to the raters via fax.

    Also, you may want to be more specific about your condition so I, or others, can give you some specific pointers on what to expect during your exam and help you to best represent your symptoms (every disorder has a different C&P exam).

    My C&P is for orthopedic. When I retired from the Navy I received a 10% disability due to a herniated disc. Four years ago I was diagnosed with degenerative Arthritis by my a Local Doctor. I have a copy of that report plus my medical records. My initial claim was PTSD, severe back trama and Deginerative arthritis. I have since made a seperate claim for agent orange and have an appointment next week for the agent orange exam. How do I make contacts with the RO I live 170 mi from the Hospital ???

  14. I've been complaining to much and now I need an honest answer on what happens during and after a C&P ? How long does it take after the C&P before you hear the results and I'm curious if They will do a C&P for PTSD since I was in the PTSD Clinic in Denver for 6 weeks. My record from the clinic stated I had extreme PTSD and unemployable. These may sound like silly questions to some of you folks but I've always believed there's no such thing as a silly or stupid question. Except for the one you didn't ask.

  15. The VA decided to give me a C&P in Oct. 14 years after the Navy gave me 10% disability on retirement. I didn't know I had applied for it until I read my dd214 two years ago.

    I did submit a new claim listing my herniated disc when I applied for PTSD and thats probably the one their doing a C&P on.

    I also have an agent orange appointment this month. I'm starting to get nervous when the does something besides stall tactics.
