Good luck trying to fix the VA.  Trump couldnt.  Biden hasnt.  Congress tried.  None of the other presidents did.

There are "secrets" in the VA:

    1.  There isnt enough money to pay all the Veterans for disabilities.

    2.  Whenever congress gives VA more money, the VA finds a way to squander more, and give less to Vets.  Its actually pretty easy, there are contractors who are friends of politicans and they get mega contracts, collect money and do almost nothing.  Example is the VA's IT system.  Congress poured billions into it, multiple times, it remains unfixed, ebenefits is lousy, and VA.gov is ebenefits except with more glitches.

    3.  VA is a giant corruption machine, on purpose.  When someone helps with an election, they either get a high position in VA, or a big fat contract.

    4.  Trying to fix the above, is like trying to stop it from raining.  It stops when it stops, and we cant do much about it.

    5. To insure this corruption continues, VA has its own police force, the VAOIG.  Its the fox guarding the hen house, and the VA looks the other way when chickens and eggs disappear into corruption pockets.

Lowell, it is not new money. Only a small percent is. Its a race track. it goes around and around, Someone gets off, someone gets on. The issue is how they are handling the money and claims. Its deeper than that.

  2. Be advised that the VARO's are experiencing mail delays of 30 days or longer (Much Longer in some cases). Some of these documents are time sensitive so read them carefully and call the VA to explain you received it Late. Otherwise if you miss a deadline, its too bad. Next week, I am asking  Congress to get the VA to send time sensitive documents / Letters with reply by dates via Fed Ex until this mail fiasco is solved and as long as this COVID scare is around that seems to be a long time.

  3. In addition, if you have to go to the BVA Dr Bash will go with you. Not many other docs would do that, but you have options, If you are on a tight Budget, other entities are available. Valor4Vet is one.  Here is a link to her interview with Exposed Vet Radio. It is a good listen.

  4. Great Post Lowell. We tend to ne eager for information. Everyone's disabilities are different regardless of how they appear familiar. Bad advice and a Moron DAV rep cost me 14 years of fighting,

Informed, accurate information is the goal. There are a whole lot of resources out there to help veterans with their claims.  Facebook has some groups that have 50K plus members.

The bottom line is this: Evidence wins claims and a good medical nexus will only help. The more complex claim a veteran has the more complex the nexus will be needed.

  5. The Contract company and examiners have access to the records. Do not give out your information to anyone. I had a c and p exam last week and we discussed the file. The examiner had it pulled up and said the file was very large, 9000 pages. He went right to what he needed to write the opinion and I watched it all take place. If they ask you for your information it is because someone is not doing their job and this needs checking in to.

  6. Buck if you file anything I would suggest you would file for an increase of the Tinnitus. If you win the effective date should can go back to a year or the date of the onset of the secondary either by diagnosis or symptomology. This is regardless if the Tinnitus rating carries a 10 percent max rating. I also suggest you go here https://www.index.va.gov/search/va/bva.jsp Search your issue and put secondary to Tinnitus into the exact phrase section. It should show you what others have done and results either good or bad.

I was denied for scoliosis, lumbar spine but under "favorable findings" in my decision letter it says "you have been diagnosed with a disability".  During my C&P exam the examiner told me "I cannot service connect you for scoliosis, you need to re-file your claim for lower back pain".  It was at this moment I realized my VSO did not listen to what I was telling him to file.  It was obvious he was not paying attention to me since my appointment was cutting into his lunch break...  I have refiled for lower back pain but I will lose 15 months of back pay.  Is there any way to appeal my decision for "lumbar spine scoliosis"... Any ideas or advise?

Hey Todd who was this VSO, Don't need his name just his Organization.

Congratulations, Proudvet (George).  I was also a PO2 (Second Class Petty Officer..E5).

Dont forget to get your free (no cost to you) 10,000 life insurance if this is a recent decision (within 2 years).

    That makes 3 of us.

The recently passed bill Hr 7105 raises the Amount of Supplemental life insurance to 40K in Jan 2023.

I was recently awarded 20% service connected disability for right shoulder rotator cuff tendonitis.
My MRI shows I have interstitial tearing of the supraspinatus tendon with moderate tenderness of the supraspinatus with a posterior superior labral tear and some initial tearing of the intra-articular biceps tendon as well as mild degenerative changes of the glenohumeral joint and the AC joint.

My question is should I submit a separate claim for tearing of the intra-articular biceps tendon or the other injuries or are they all covered under the tendinitis.

    Your assistance is greatly appreciated.

    Rick

I just got rated for the same thing, same percentage. It is all considered as one Segement. If you have surgery, ask for temp 100 percent if you are not already 100 percent.

  10. The only thing she needs from the school is proof she attended and her status as full time back to 2017 the effective date of the award. Ask the RO to retro the chapter 35  benefit back to the earliest date on your award letter. Chapter 35 pays the student directly and not the school. As far as ChampVA you have 18 months to submit bills or recipts for each eligible dependent back to the effective date of the P and T award. Also keep in mind Champ VA is slower than a turtle on a treadmill when it comes to these claims and can take several months.

  11. Once a veteran gains Housebound status either by actually being housebound or by Statutory Housebound with the total plus 60 rating, gaining Aid and Attendance is a big step. You have to require the need for Aid and Attendance. That actually means you have to have someone assist you with the Activities of daily living. Dressing, Eating, Bathing or to protect you from yourself or dangers in the home.  That would be at the SMC L or L 1/2 rate.

Once you attain that rate the door to the higher levels of SMC are opened. Asknod has a very well defined SMC explanation on his site that humorously explains it in detail.

  12. The VA did not ban them they just simply took them off line. The excuse was vets were getting High powered IMO's from hired guns and cleaning their clocks at the higher levels. Do not worry, they will be back soon as the House veterans committee has already addressed the situation. In the mean time here is a link to the For the forms via NVLSP.
