  1. If this is a FDC (Fully Developed Claim) you need to file before Aug 5th of this year 2015! VA is Cutting its issues with the 1 year retro its for the FDC program to on Aug 5th 2015 Deadline! Claims on Appeal I don't think is affected. Just letting you know! ...............Buck

  4. Well Everything looks good to me...I assumed you was asking for your EED. And it is possible to get it earlier than what you got! Going back to when your disability first Arose that caused you to be IU. Not when they rated you the IU...BUT from when your disability first arose & Render you totally disable, this is your entailment to your EED. Maybe I am wrong and someone else can be more help...JBasser? Asknod? .................Buck

I am not sure how you would add your father as one of your dependents unless he is living with you? then if you make him your dependent, Iam not sure what the VA will do if he is on SSDI/OR SS Retirement? You should be entitled to more va compensation! Contact Iris ask what you need to do to add your Father as your Dependent! ...........Buck
  6. DC2NAVY, You posted this on hadit 28 May 2015 6:10 pm Hello everybody, I have a question and I will get straight to it. Service connected since the day I got out 1OCT2004. For servical spine injury and for both hands all at minuium 10% ratings and one for a scar on hand at 0% rated @ 30% total. Got into VOC REHAB in 2007. Laid off in 2011 april, and was going thur divorce of 12 years, seperation from my dependents, school was lacking, i knew and was told i had issues and wasnt the same person i was before service. 1997-2004. Sometime in May of 2011 I went to the FT Wayne, IN Va mental health clinc with no appointment. I just showed up one day found myself there I guess. And went and poured it all out basically my in service exeperinces, how i destoryed my marriage over it, etc etc. I left that day with meds in hand and started getting treatment at the local VA for mental health. In July of 2011 I filed for SSDI online, I was deemed unemployable by VOC Rehab and put into the IDLAP program and even had a walk thur of my home from the Lady that ran the program. They asked me my hobbies and what I liked to do, I was giving a laptop, and printer all by Dec of 2011. Was awarded ssdi in like 28 days from online site. Only submitted VA-Military records to them. When I filled my claim with the VA for PTSD I was 30% and on SSDI for service connected items only. County Ser Rep & myself submitted copies of my SSDI to the VA around this time or shortly after. Sep 2013 awarded 30% combat related PTSD i filled NOD Same month. Long wait in June 2014 called American Legion and they recommended a hearing so I went for it. I went to the FED building in INDY. I sat across from a lady Directly invovled with my claim I guess. I asked simply ( What is taking so long?)with my claim? I have been awarded SSDI in AUG of 2011 Deemed Unemployable since, VOC Rehab to IDLAP, not worked since April of 2011. She said i understand give me 30 days. And I think you will be at 100%. Well within 35 days i got an SOC giving me a new rating of PTSD at 70% and the reason states that it was way more disabling then reported during their initial evaluation. Due to SSDI and their is a clear mark in impairment due to PTSD. And Voc REhab records indicate etc etc...Clearly going back to AUG 2011..They made right and awarded 70% to AUG of 2011.. I agreed with the SOC and did nothing for 60 days and then 26k hit my account and I got the award with IU finally attacthed for the first time. Not just Voc Rehab paper work or dependent paperwork. I filled the IU in AUG of 2014 and just over this last weekend my ebenies updated showing me commisary, ab8 and today a back pay amount showed up. Only adding up to IU file date of AUG 2014.. They went back in time and awarded me 70% from AUG 2011 and finally I met the minium requirments for IU. I had told them for 3 years about SSDI on inital 30% rating they ignrored all evidence of SSDI and VOC REHAB. And made that clear in this 70% awarded letter. Did I do something wrong or do I have a leg to stand on. Or is it truly the date you file for IU? Not there fault or am I wrong? I dont want to file a NOD on this at all..I just have an issue with the EED of IU? Everything as far as I can tell, points to AUG of 2011.. Claim date of PTSD, AWARD month of SSDI and VOC Rehab deemed unemployable transfred to IDLAP program. And in AUG of 2014 awarded 70% back paid to AUG of 2011. Please any responses are apperciated. And is this the right place is this a CUE'' I would be happy with this.....unless you want to go back to when your disability first arose? you have to prove that with Medical Documentation as to when you was Actually entitled to! .................Buck

  8. Call your RO ASAP & Ask them what is going on? Ask them why your decision letter is like this and then tell them what Allis wrong with ''The Letter they sent you?.no decision, no evidence to base there decision.no address on the letter head Remember you can't Appeal a decision if you have no decision to Appeal. Or Maybe just ask the VA to Cue themselves. broncovet seems lately a lot of veterans are getting the same type decision letters with quotes mentioning ''your compensation will not change'' ...as mention by pete 92 jmo ...........Buck

It possibly can start of the on-set date you became total disable,(Date entitlement arose) if you have evidence in support of the -on-set date, so when you file for the EED ask for your on-set date if you can prove it. other wise the EED will be the date when you file for the TDIU. jmo ................Buck
  10. I see no decision or no evidence they base there decision on. unless its on another page? The page you posted on here is obviously ''incomplete'! I see No Address from your Regional Office with phone number address or phone. on top the letter head. This is the first time I see a Form like this! Call IRIS and complain about it. Unless they (VA)has changed up things for FDC claim and we don't know about it yet? ................Buck

I agree with John, get what you deserve Bud you should have been awarded back in 2008 when they granted the 30% & and it tip your rating up to 60% it was then they should have mention to you ....>you were eligible for the smc and heck yes you will get some retro! I'd file for it and mention possible CUE if they denied you then Appeal as a CUE. I don't much think they will bother you about your almost 10 years you have past the 5 year mark. jmo (just my opinion) ..............Buck
  15. You will be ok DejDan, Relax...in the mean time you need to keep going to VA mental health. If you get denied get on here (hadit) there's a lot of good people that can help. ...& (remember when you do win your claim it should give you more retro pay) and that's ALWAYS a good thing! if your denied for no STR's as required evidence..You will need to Appeal that decision with a Notice of Disagreement (NOD) I See No reason you can't win this claim Bud! .................Buck

Well maybe you should get an IMO with a certified board spelizeing in your disability and ask the Dr to say your disability is'' likely as not'' happen/caused while in the military while serving in Iraq(be honest with the private Dr and let him know what the VA wants that you don't have, try to find a Private Dr That helps veterans and is veteran friendly. Private Dr' are expensive but it may be worth every penny, If the VA believes you served in Iraq with the DD214(they should)...but still needs STR'S To prove this disability happen and you were treated for it. but actually was not treated for it because of the surrounding circumstances. You could use Reasonable Doubt & with Explanation account along with the IMO& Buddy statements from the unit you served with during this time of question even though you or the VA can't produce your STR'S (write a letter of explanation for that) You need to stop worrying about this and wait and see what there decision will be? they will give you a reason they denied you...if they do? Its hard to say sometimes what they will do? depends on who your rater is and if he/she is having a good day. Did you get a denial? or Your claim is in Appeal & your VSO sent you a letter saying they need your STR'S? ........Buck

As for as prices at the Commissary We went to Barksdale Air Force Base in Shreveport/Bossier City,La (Where they took the President during 911) Anyway we didn't find the prices on Food Products to be cheaper than Wal-mart other than the no tax. It basically was not worth the trip from Dallas. Wife was disappointed. .............Buck

I was wondering as we all gain knowledge about the claims process over the years is it possible to go back and catch errors that were made after the claim is closed? say go back 15 years or so? or would it be worth the trouble? Mostly about EED Dates? .................Buck
  20. What Exactly is it that you need? Do you need medical evidence to support your claim for Service Connection? And you can't find your STR's to support that? Is this your first claim? or is in on Appeal from NOD? They could not find all of my STR'S from Vietnam and Especially the one I needed to support my claim and I was deined. I appeal that and wrote out in detail what happen and there should be a record of it because I did report it to my CO at the time unfortunately they could not find it it either was destroyed or was blown to smithereens Your DD214 Should have it on it that you serve in Iraq as a combat veteran & where you served. I am not sure what the CFR'S numbers are? but a veteran can give an explanation of account what happen and that in fact it did happen with Buddy statements from your unit& unit commander...This is what I had to do. if no Records found but you have proff of serving in Iraq then you have the benefit of Doubt. Separation orders should have whom you served with in Iraq and when you were transferred back to the states. with dates of separation. ............Buck
  21. :smile:Oh the wonders of our C-File. I agree Asknod is totally correct about the VA left us a Rand Road Map...we just have to decipherer it. Asknod is one of the best veteran advocates there is in my opinion. This is what I LOVE about hadit and When MsTird started it in 1997 for all of us to get on her raft. The Knowledge here on Hadit that we all learn from can never be replaced or a put a price tag on! All because of a wonderful nice caring lady Ms Tbird. its changed the world for many many veterans. I am very Thankful for HADIT and I am glad to help support hadit with funds sent in every year. ..............Buck

When I go see my VA Doc he might say hello how are you today I say Well Doc I seen better days, or if I am in a lot of pain I say not to good, when the normal thing to say is I'm good Doc & you. Usually my Doc just says how can I help you today and I just start telling him/her how I been feeling and things about how the pain meds are working or not working like there suppose to and any other issues I have medically. The Dr. sits there on the computer and looks at your lab work/reorders meds...while you just sit there...its that way for me anyway. These Appointments are far and in-between for most of us veterans, for me its every 6 months So I make my time during these Appointments count big time! Its during the exam is when the veteran needs to say how he is feeling and the problems he is having. I never did like that BS when they ask you on a scale from 1 to 10 what is your pain number? To me that's a useless question to ask a veteran, all the veteran knows is he is in pain usually severe pain & that's why he is there. Its up to the Dr's to check us out.. I agree with PUREREADY about waiting hours for your Appointment, Labs early am then two hours wait to go check in with your clinic then its anyone guess how long that wait is. I Dread going to my VAMC its usually at least a half day wait and some time an all day wait. When your at your VAMC its best to keep the conversation with the Nurse & Doc about your reason your there & let the Dr do most of the talking you just answer his/her questions the best you can & let him/her know about any other medical issues you may have. if the Doc gives you a new diagnosis ...then wait until you get home and ask here on hadit about it if it could be secondary to your existing disability's...to qualify you to file for an increase, Do not Ask your VA Doc that question. Unless your on good terms with your Doc and you been seeing him/her a long time & he /she suggest you should file!...but still do be careful asking the clinical tech or Nurse & Dr's about compensations questions...We can ask those questions here on Hadit. REMEMBER everything you say when your at your VAMC Appointments is put into the computer and later filed with your M.R's that could come back to Haunt you. just some more of my 2 cents ...................Buck
  23. I would say go for both, if your awarded a % they usually pay retro from that date. you have a good chance according to what your last C&P Examiner Stated. go get a copy of that particular exam. unfortunately a 0% rating does not qualify for compensation jmo ..................Buck
