  1. Can we Appeal a CLAIMS AUDIT done by the R.O.? Anybody Know? or what applications are used? Thanks in Advance. Buck
  2. I had put up grab bars in the shower and in the commode area...the dang things come off and not secure at all, these are the suction type. ( dangerous)
  3. Well this is for my spouse not me...I am not sure the Veteran spouse is covered for the adaptive assistance /disability-housing-grants ?
  4. Welcome to Hadit Brian360 I agree with brocovet and GB Army Also if you need proof of a in service event or something happen to you while in military that effects you now , you will need a diagnose, but you also can let them know the date and location of the event or what ever happen to you that effects you today, if it was around a holiday say Christmas, or with in 10 days of the holiday if you can remember? then mention what happen in your lay statement that will help they can check out your story and if they find it to be of merit then they will certainly use it. in your favor. Remember a diagnose can come at any time there's no limit for US Veterans to be given a proper diagnose and it can be connected years later to your military service, you will need a qualified Dr examine you read your records that pertain to what your claiming to nexus the two. use something like this as this is what the VA loves coming from a qualified Doctor= '' it is likely as not this veterans disability occurred while he was in the military '' ect,,,ect,,,, Name your unit and location and date of the event & what happen to cause you to file your claim? ,,,,they have a way they can go back and check your unit and if you can give them some information then that will certainly help. .I did this with one of my claims and it helped. REQUEST YOUR C-FILE IF YOU HAVE NOT DONE SO YET? There are valuable records in it that will help your claim. (JMO)
  5. I am not so sure who to ask this questions too but some of you may know/ My spouse was approved for the Veterans A&A ... IT PAYS AN EXTRA 160.00 MONTHLY ADDED INTO MY Comp. She needs the assistance of another person ...which we have 2 people coming in once a week Mondays and Wed. to help her bathe and get her things she needs....ones is a rehab specialist and the other is a R.N. for her medical stuff. I do her IV's 4 TIMES A DAY(two different antibiotics) and I drain her drain bag every night...and the R.N makes sure I do it correctly and if we need more medical supplies ect,,ect,, she checks her tubes in her stomach and cleans the wound area...so for everything has been going ok. Now My Spouse needs handi-Capp fixtures put in our home she needs grab bars and doors wider...that would certainly help, she fell the other night and I had a hard time getting her up I pulled a mussels in my back but I am doing better little sore but my concern is my spouse falling. if she had the grab bars that would be safer. would we file a claim in the VA Independent Living Program? ask for the grab bars /doors widen ect,,ect,,,,
  6. LET US KNOW PACMANX1 IF YOU FIND IT. Thanks Ms T

And being cook chief and bottle washer . Along with my internet acting up....I'll check with the other Mods GB Army and shrektank1 and brocovet see if they can find your post and Ms T
  8. ''Buck, this is what I am hoping for, a positive outcome of my final appeals. ''Since my recently LHI C & P exams supports my original arguments/disagreements, I am just hoping it goes well.'' Roger that pacmanx1 Your a season Veteran and we know you will prevail , just hang in there no matter what it takes, you will win my friend & always think positive. you got this.
  9. I remember years ago I had problems with a C&P Examiner from the VA, HE WAS AN AUDOLOGIST FRO THE VA, Anyway he mention I did not cooperate during the exam which was BS, Anyway this ended up at a R.O. DRO HEARING with a Rating specialist at my hearing ,the rating specialist ask me if I was willing to take another C&P Exam at a different location at a VAMC? I said yes , but please look at my IMO from a hearing and speech expert STATE CERTIFIED and with 25 years of experience in this field of medicine .and this Dr used the VA Guidelines during all testing including the Maryland CNC Word test,....the rating specialist look at the test the Private Dr did and was satisfied with the test and the Dr credentials and used that in her decisions to give me the TDIU P&T This rating specialist called this private Dr's office and ask some questions and they gave her the answers she needed ..I was approve on the spot by the DRO.
  10. I would recommend the Veteran get his hands on his C&P Report ASAP. SO YOU HAVE TIME THE APPEAL AND REBUTT THE QUAIFLICATIONS OF THE EXAMINER. IF NEEDED.
  11. I agree with broncovet but sometimes even if the C&P Examiner in not qualified the Veteran may still get a favorable C&P Report , but the odds are against the Veteran that happening. or the VA goes back and rechecks the EXAMINER CREDITIALS and make the veteran take another exam. which they would call the first exam invalid and not to be used for rating purposes. adding years to the Veterans claims a broncovet pointed out.
  12. I recently ask for a complete historic Claims Audit of my claims from my R.O. and they came back and said we have did a complete Audit of your claims , we found everything to be correct you are not owed any retro...But I disagree with that, but later on I will file a CUE for EED I know for a fact thats off...so the Audit they did will be incorrect and it only took them a bout 3 weeks to send me their audit decision. i AM WAITING ON MY 20 YEAR PROTECTION WHICH WILL BE NEXT YEAR. GETTING ALL MY RECORDS IN LINE AND SHOW THEM THE DISCRIPIECES ON THE EED. AND THAT SHOULD PRODUCE ME SOME RETRO MAY NOT BE ALL THA THAT MUCH ABOUT 6 MONTHS OF 50% SPLIT FROM 100% OR MORE IF THEY GO BACK TO THE DATE I FIRST FILED? FOR THE INCREASE ,WHICH WOULD BE ABOUT 3 YEARS OF RETRO. Right now I am taking care of my spouse, but checking my C-file everyday and rounding up some records and looking for a Accredit VA Claims Agent in my Area that as access to the VBMS.
  13. Overthere Remember we can file on secondary conditions our original sc condition can cause or be related too...One of my disability is chronic combat PTSD , I got that first try and now I have another condition that my PTSD causes or is related to like Sleep Apnea...I have been diagnose for Sleep Apnea by the VA Doc's and I could file a secondary claim for that.. its 50% with a C-pap machine medically necessary to use, so if you have a service connected condition and it has caused you to have other disabling condition's you can file it as a secondary condition ..You will need a Qualified Dr to nexus the two and mention that it is at least likly as not your new condition is caused by or related to your original service connected condition. with a sleep apnea claim and Doc says its medically to use and it is caused by /or related to your other sc condition that's a 50% rating with the C-pap machine. once you get a secondary service connected for another condition that is disabling it becomes part of your other condition or original condition.

  15. your welcome I agree with GB Army go ahead ands file any claims you have to file the sooner the better. I had been told by one of the upper experts for VA Claims by VA Accredited Claims Agent Alex Graham that he was representing a Veteran with 19& 9/10 months in and he got a proposal to reduce his benefits. I never knew the outcome it maybe still in Appeals? so any of us are subject to get a Proposal to reduce letter.
  16. There's basically only two reasons they can reduce a Veteran with 20 years in One is they can prove freud and the other is he was convicted of a crime and was in prison over 60 days. They can send the proposal out to reduce but the veteran must fight for his benefits. They will need to advise you as what you can do or what your rights are and they must send you to two different c&p exams with different examiners. if you get a proposal letter to reduce your benefits its up to them to force the issue/and you can appeal it.
  17. I believe it mean the VA has requested more medical records and also could mean they requested a C&P Exam and or other medical records from different medical facility's. (private)
  18. I don't think its to late to start you your own business as long as you know the business will fly...(do good) if your in your right mind and have the right people integrity goes a long way. I've lost interest in working again if but I did I'd start my own business
  19. To give you a better example I was 90% combined rating and was given the TDIU P&T due to my condition will never improve in my life time and could no longer work, ok I was getting paid at the 100% rate including all the extra benefits of a 100% P&T Veteran would get. Now a Few years later I applied for another condition that was separate from my original service connected condition, I was awarded a 70% rating for this new separate condition and they have a mandatory duty to award the SMC S Housebound, another 370.00 plus some change extra a month added in on my 100% P&T payment.
  20. Great information from the other members here's my 2 cents. I have two Questions. How do you reach 100% scheduler ratting. Apply for increase if your original service connected disability has got worse. you need a Qualified Dr Medical opinion to state so, not knowing you current r S.C. % IF YOUR AT 90% with or without TDIU you will need an additional 50% rating to cover the 100% scheduler depending on your severity of your condition rather or not they will give you the P& T with the 100% meaning your service connected condition will not improve within your life time Once your approved for the TDIU and you file another separate condition from other of original condition and get a 60% rating then that will get you the SMC S Housebound another 370.00 monthly added in to your TDIU . Do you have to apply for it somehow? YES With the exception of the TDIU YOU NEED TO APPLY FOR IT UNLESS YOUR DR SAYS YOU CAN'T WORK DUE TO YOUR MILITARY DISABILITY THEN THEY SHOULD APPLY THE TDIU FOR YOU SOMETIMES THEY DON'T DO THAT. I know its a combination of 70 + 60 +40 to get there does the VA bean counter juts award you it? The second question is how do you get the VA to move you from 100% TD to 100% scheduler ratting. no the va bean counters never give us anything we have to fight for it and never give up. I wish you the best outcome.
  21. I think it depends on what you claim that was caused by or related to your TBI, There are a lot of different effects the TBI can cause years later on down the road that may not be present today, they can do a brain wave test and see the matter separated inside your brain I am unsure what that test is called,?? but if you have any systoms that maybe related to a TBI check with your Dr, PTSD /DEPRESSION is some DISABLEING CONDITIONS we have a RATED 100%PLUS TBI Veteran here on Hadit that maybe able to help you, he gets the SMC (SPECAIL MONTHLY COMPENSATION) I AM NOT SURE WHAT ALL HE IS RATED FOR but he has been put on the list that the TBI can cause later on (jeifri) I think is is hadit screen name he is young and has a youg child age about 1 or 2 now. GO see theVA MH clinic CHECK WITH A VA LICENSED CLINICAL SOCIAL WORKER they can help you and ask to see a Therapist they are some social workers that are trained certified therapist . iT IS STILL UNCLEAR WHAT ALL TBI can be related to or What are caused by the TBI..THERE SO MANY DIFFERENT CONDITIONS A TBI CAN CAUSE AND SOME TAKE YEARS TO MANIFEST. Sort of Speak
  22. i GOT A 300.000 $$$$ VA LOAN, WE LIVED THERE 4 YEARS AND PUT UP FOR SALE DID NOT LIKE THE HOA THERE WE DID NOT LIKE TO BE TOLD WHAT WE COULD PLANT IN THE BACK YARD AND ON THE SIDES AND FRONT OF THE HOME, ALL CHRISTMAS TRESS HAD TO BE FACING THE FRONT IN THE SAME WINDOW AND EVERYONE HAD TO USE THE SAME COLOT MULCH...NO STORAGE BUILDING OVER 6FT HIGH FROM THE GROUND UP TO THE CENTER OF THE BUILDING GABLE. WE SOLD THE HOUSE AND GOT ENOUGH TO GET INTO ANOTHER...NO DOWN PAYMENT BUT THE REALTORS FEES WILL KILL YOU IT COST US 17,000 TO RESEL THE HOUSE AND 9,000.00 TO GET INTO ANOTHER ONE THIS ONE COST 244,000 WHATS WERID IS THE tITLE COMPANY DOES ALL THE WORK PAPER WORK THE REALTORS JUST SHOW YOU THE HOME AND COLLECT THE EARNEST $$ TO GIVE THE TITLE COMPANY, THOSE POOR PEOPLE AT THE TITEL COMPANYS DOES MOST OF THE WORK AND AT CLOSEING TOO. THE REALTORS MAKES THE $$ THATS FORSURE. THE REALTORS HERE IN TEXAS CHARGE YOU A PERCENT TO SELL YOUR HOME THEY CHARGE A 5% COMMISSION FEE WHAT EVER YOU SALE OR BUY A HOUSE FOR FIGURE 5% OF WHAT THE HOUSE COST THATS YOUR REALTOR FEES. I NEVER HEARD OF A DISABLED VETERAN PURCHASE A 2 MILLION DOLLAR HOME BUT I GUESS IF YOU MARRIED JENNIEFR LOPEZ YOU CAN & JUST ABOUT WHAT EVER PRICE YOU WANT. IF SHE FORKS OVER THE $$$ .....LOL.....> JUST KIDDING.
  23. I think the VA Home loans have nothing to do with your VA Compensation as for as to be worried about them taking your benefits away or proposal to reduce ..the lender may count your income as to decide rather or not to loan you the $$ but I have no I deal about a 2 million dollar VA Loan, that's between you and your lender, VA only A 'guarantees '' a percentage of the loan and its fairly small like BROKENSOLIDER MENTION. Our VA Compensation is protected for taxes and in law suites.and from the IRS
  24. I had read some where that the VA Home loans only cover 750.000.00 if you got a 2 million VA Home Loan it's the first I ever heard of.
