  1. When there is limitation of motion of major joints then they are rated at 10% each. Hands are minor joints. Wrist are major joints and are rated separably. Key thing to remember is when you check for each major joint and it's nonconpensable is when the 10% for each major joint apply.
  2. I found on M21-1, Part I, Chapter 5, Section G paragraph d. It tell what should be done with each BVA decision, including implementing BVA grants. Thanks for the input
  3. Hi all, I have a Remand from the BVA in August 2018 and the VA sent me a letter asking me to opt in the Ramp program. They also called asking if I wanted to opt in the Ramp program. I said no! The main reason I said no is because part of the board decision was a grant of an EED from 1993 til 2013. I''m looking to get a hefty back pay deposit. Now the problem is the RO has not implemented the BVA decision yet and my understanding is they should implement the board decision before working the Remand. I feel if I opt in for the remand they will not implement the board decision until they finish with the remand. My question is do anybody know or had any experience with a grant from the board and a remand and then opt in the Ramp, and how did they work it? Thanks for your time!

  9. Hi everyone, I just wanted to share my success at the BVA. I received my decision in the mail from the BVA and they granted my appeal for an EED back to 1993. I filed my first claim back in Jan 1993 for two conditions. They only adjudicated one of the the two conditions at that time. I filed another claim in 2013 for the same condition and was awarded for the condition. I filed a NOD for an EED and was denied, so I filed a form 9 that I did myself and Won!
  10. Update on this thread. First I like to thank all those who has giving me advice on this particular thread. I received my decision from the BVA yesterday and I was granted two, remanded one and denied one. One of the big grants was my earlier effective date back to Jan 1993. I particular want to thank Asknod for your advice on how to attack the EED. I took your advice and did a NOD for EED instead of trying to get the EED by way of CUE. I wrote my own form 9. I did all the research of applicable regulations and president case that applied to mine. The VA law judge applied some of the same regulations and cases that I had on my form 9. Again, thank everybody that gave me advice! This is money that my family and I really need whenever it gets implemented. I know it takes 3 signatures when it's over 25k. Now the wait again, ugh!
  11. L, I'm happy to hear about your success with your claim for ssdi. I applied the day after I had to retire early from my job because of all my illness. I'm 58 and my illness is well documented and my doctor even said I need to retire because my job will only make my condition worse. I filed the end of June and hope I have a decision by the end of Aug. Keep fighting K!
  12. I separated the end of Dec 1992, but filed my initial claim Nov 1992 before leaving service and was awarded 30% Feb 1993.

  14. Glashuttle- you need a diagnosis of what is causing the pain in your back. Examples are- strain back muscle, arthritis, or injury to your back in service ext. plus the other two broncovet mention. remember pain is not a condition. you must know what's causing the pain.
  15. I would like to echo Broncovet in the way to file your form 9. I did my own with no VSO help. I went line by line with everything they denied and refuted it with either medical evidence or 38 cfr. After I finished with it I took it into my DAV rep for him look over it and fax it to the VA. He liked it so much that he asked me if he could make a copy to use as an example for others. It took a lot of research on my part.
  16. I'm 4 months into waiting on a copy of my c-file. I requested a cd copy of it. The first request took over 2 years.
  17. mrstephens 11, I agree with brocvet because I have the same situation. when I was discharged from active duty I applied for two conditions but was only award for one. The other one they never adjudicated until I applied again for the same condition 20 years later and was awarded for it. Now, the main thing is to get awarded for the unajudicated condition and awarded benefits. that's the first step, now you do a NOD for EED back to when you first applied ( 20 years ago for me ). of course the local regional office is going to deny because you're talking 10's of thousands of $$$ in my situation. My claim is at the BVA and has just been placed on their docket. Good luck!
