  3. Berta I tried to scan the denial and other info several times. As I said in the past I am not very savvy at Technology. It just would not work. My brother says it is the "Operator" not the scanner. This is the claim That was denied. The SME did this on February 13 but my evidence was not uploaded into the system until February 19. So my question to them is how can this be fair to the veteran if a decision is made without Reviewing ALL of the evidence and how can they do this without notifying the veteran. My oncologist is The one that wrote the Nexus letter, but as I stated earlier he refuses to write another one. I have no idea how this will turn out and I am very nervous but I will do the best I can Thanks Berta
  4. Berta you are correct, I did not have to pay for the Nexus letter from my oncologist. I have thought about What you said about who owns the benefit of the doubt. I have made up my mind to get through this hearing and whatever I need to do if I am denied again I will get it done as long as I have the strength to keep going. Thank you for your time and all of the information. Will let you know how it turns out.
  5. Berta he did not speculate or add a rationale. I was lucky to get what I did get from him. None of My other docs would take the time or just Flat refused. I have asked again and he says that this is All he will do.
  6. On Thursday oct. 6 got a call from Louisville. The person wanted to know when would be a good time to set a date and time for a hearing. They wanted to know if I wanted formal or informal hearing by phone. He said informal DRO can make immediate decision and informal would take 2-3 months. Got another call today time and date was set. I requested informal hearing. This hearing is on an appeal for Camp Lejeune from 2014. I hope I made the right decision requesting informal hearing. In the initial phone Call the person talked briefly about some of the evidence that they had and I brought up the Nexus letter from my oncologist. She stated that the word could was used by My oncologist. I felt that she was trying to tell me that the word could is not very strong. The dictionary defines "could" (To show a possibility.) Can anyone comment on this? My original claim was rated and denied by an SME. I found out that the SME is only a PCP.( Primary Care Physician) who is not an expert in oncology. As I have never Been through a DRO hearing I am asking for any advice as to what to expect. Thanks to all of you
  7. Gastone you are right about the doctors. They stated in their reports that I have Dementia. I do not have Dementia I have APHASIA. As miss Berta pointed out in an earlier post there Is a big difference between the two. The Only doctors that said this was the VA doctors. True I can not carry on a conversation that makes sense to anyone but my family. My wife has to Tell the doctors what I am trying to say. They don't understand why I can tell them my date of Birth without any difficulty, but cannot answer their questions in a sensible sentence. I have Never been asked any questions about who pays the bills in our household. Maybe you are right The VA had some reason for this. I just don't like being labeled incompetent when I believe I am Not I was told that the fiduciary is not required to submit periodic accountings to VA. Maybe I Should just let this go and accept what the VA has proposed. Cannot remember exact date of Notification but it was in March. Thanks for your reply and your time.
  8. I am so confused about the proposed incompetency and my C&P exam. I finally got a copy of my C&P exam for PTSD. How can the VA propose Incompetency when the examiner States "Can veteran manage own affairs" Answer YES. Is it possible to get this proposal reversed with this Information? If so what would be the next step to get this done. Thank you to all of you for your wisdom and guidance.
  9. Thanks for info. I was at 30% for 7 months. Now at 100% but it still does not add up. Under rated disabilities it shows PTSD 100% SC effective date 5/12/2015. Under Historical claims shows Submitted 1/11/2016 Closed 3/29/2016 What happened to the original effective date and the retro?
  10. I was contacted by field examiner and he quoted a figure of retro pay that was waaaay below what I had figured was due me. Does the VA not pay retro Pay from the effective date in the award letter. Letters States effective date May 12 2015. Will the amount of retro be what I will be receiving x 10 Months. Effective date may 12 2015 claim closed March 29 2016. Any suggestions or advice would be welcome.
  11. Navy04 thanks for your information. I am very anxious about this fiduciary thing because I have Heard so many bad things about it from vets in my hometown. They make it sound as if you will Be audited every time you turn around and that if my wife is appointed she will have to keep up with Every penny spent. Does your wife have to keep all receipts and keep a logbook of some sort? One more thing I do not understand is I got a call from a VA field examiner to set up an appointment To meet with us. My effective date was May 12 2015. He quoted the amount of retro that was way Below what I thought it should be. Can you tell me if I am correct in figuring the retro amount starting from The stated effective date?

After I received this I decided to take this to the limit, and I did with many hours of research And the advice from the hadit members.

  14. Dot09 no offense taken. As I mentioned earlier my nuerosurgeon diagnosed the Expressive Aphasia in a Follow-up appointment. My previous speech therapist also stated that I have Expressive Aphasia. These statements have not been sent to the VA. I was just trying to make up my mind to fight or quit Before I turned these documents in as evidence. Thank you for taking the time to inquire about the Expressive Aphasia and helping me along with my decision to fight.
  15. Thank-you Navy4Life for your encouraging words. Deep down in my heart I don't believe I have Dementia. I feel as if I am trapped and can't get out. I tell myself over and over Don't feel sorry For yourself. Self-pity is not an option I have to live for today and try not to dwell on the things That I can do nothing about. My family has no history of dementia. I think that the VA drs were Just looking for a way to make me go away but from all of the support from the hadit members I am preparing for battle as I have a wealth of information among all of you.

  17. Thanks to all of you for your time and all of the information that you have given me. Berta the Aphasia is Due to a brain tumor that I had surgery for. The only doctors that have diagnosed me with Aphasia is VA docs. My nuerosurgeon wrote in my follow up description that I have Expressive Aphasia. He has not written the Word Dementia anywhere and neither has my oncologist or radiation oncologist. I am waiting on a copy of my C&P exam so I can go forward with this. Can you tell me how the denial for PTSD the first time may be a basis For cue in the older decision? I can read and I know directions when I am riding in a car. The brain surgery Left me also with right side weakness, so I cannot drive anything but a golf cart that belongs to my brother In law.This is my therapy. I cannot write very good since the surgery, I have had speech therapy and the Speech therapist told me and my wife that I have Aphasia. I stopped this after about 6 weeks because I felt So depressed each session that I could not make the words come out that she wanted to hear. I was to the Point of tears in each session. I just decided to not go back. With all of you and my faith I can do this.
  18. Do you really think that I can convince the VA that I am competent when they ask me a question and I Cannot answer in a complete sentence? Your confidence is very reassuring and also helps me find the Strength to take on the va again.

  20. Had a c&p exam March 8 2016. March 29th claim was closed. Received the BBE and was Happy about decision until I read VA finds you incompetent To manage your VA benefits. Such a big letdown. They based their findings on the c&p docs opinion. Examiner stated I have dementia, I do not have Dementia I have Expressive Aphasia which is the inability to speak a complete sentence so it can be understood. I know what is being said I just can't Reply in a sentence that can be understood due to my Aphasia. My wife and my family can understand what I am trying to say with no problem. I was Awarded 100% for PTSD and p&t with no future exams. I was denied the first time I filed for ptsd. So I took it on with a vengeance. I had to research and Get the proof that the incident did occur and in the exact month and year. Believe me this took many hours to gather and complete. VA claimed there was not enough Evidence that the incident happened to turn it over to the Army to investigate. But when I sent in a certain article written by an officer in the Army, it was no time Before ebenefits showed preparing for decision. I need any comments or suggestions as to what I should do next. File NOD or take what VA dished out. Thanks to all of you on this forum you made my journey easier to get to the information I needed for success. Marinevet61
  21. Berta I do not have a copy of the Drs letter from the c&p exam in September 2015. I checked my Health evet and could not find anything about the exam. I am married and my wife is my total caregiver. Yes the aphasia is a residual from the brain tumor surgery in 2013. I have balance issues and speech issues plus a DVT in left leg also a residual from the brain surgery according to my doctors. The camp lejeune claim was filed in 2014 and denied. I currently have an appeal going on to dispute the decision due to a pcp in Asheville NC doing a c&p exam without notification or not having all my evidence at the time of the exam. Examiner was not an oncologist toxicologist or hematologist. This was unjust and unfair. Just waiting now for decision on the appeal. Ebenefits states under review
  22. First I want to thank everyone for their help and encouragement when I needed answers and suggestions.Thank you tbird for this site. I filed a FDC claim in May 2015. Did a lot of research before sending this claim in. IN September had a Real C&P exam with va appointed Dr. October I received the famous Brown Envelope stating that I was Service Connected for 2 conditions. This was a great day in my life. After i calmed down i read a sentence that upset me. Va has Proposed that i am incompetent due to a doctor statement. I do have Aphasia not dementia. The aphasia is due to brain tumor surgery in 2013. Granted i Can not remember Everthing, this is no reason for an appointed representaive. Can anyone offer any info about this. Can i get this incompetent label Removed. Also i currently have an appeal for a claim that i filed in 2014. Waiting for the va to decide the Camp Lejeune claim.

Good advice Gastone,I am not the most educated person, but I can feel that there is an urgency in the air when I am in VSO office as if I am being hurried along and I forget to ask ALL my questions. I still don't understand why I received a letter from RO stating that in Order to file a claim I needed to fill out the correct form. I have not filed a new claim. My VSO faxed in a NOD to the regional office on April 13 2015. On April 18 I recieved this letter About filing correct form. Maybe I need to email ms Hickey? I did call my VSO about the letter And he said to give the RO time to get it all together. I don't know how they could mix up a NOD Statement.I only have 60 days to get this done. Denial letter was dated March 30th 2015.

For those unable to attend in person,a live stream of the meetings will be available at [url="http://www.atsdr.cdc.gov/sites/Lejeune/capmeetings.html I had camp Lejeune claim that was denied,sent in a NOD with help of VSO and the RO got Everything all mixed up. The RO sent a letter saying I now had to fill out the correct form To file for benefits. I have not sent in a new claim, only the NOD. Still have not heard anything from email I sent to RO about c&p exam that used term tremor The correct term is Tumor.
