  1. Why do The VA treat Mental disability not as serious as a physical disability. Maybe 100% PTSD (mental disability) 100% physical disability . When it come to home repairs or upgrades for vets with mental disabilities we don't qualify tell me what you think .
  2. I meant tipped as in the scale of balancing the information in my favor for PTSD Dx in 2001. I understand the medals and awards not being on my DD214 back in 1975 .but in 2001 the RO requested the the information and the Naval Personnel time stamped and mailed back the information that the RO requested in Oct 2001 Dec.2001 every thing was entered in my file except my awards medals ribbons . My claim is for an EED due to a CUE and a VBA judge will be deciding . All in the information the new Orleans RO used to deny my claim all those years I got a DD215 (correction to the DD214) from the navy with medals added the Texas Waco RO office and was awared 100% PTSD .
  3. in 2001 the RO in New Orleans requested PTSD , furnish pages from the personnel file showing units of assignment, dates of assignment, participation in combat operations ,wounds in action awards , decorations,medals, travel outside the U.S. . The agency in response mailed the information on 12/01 even though the information was mailed my awards medals certificates were not added to my claim file and none was on my DD214 . Years later I contact Naval Personnel about medals I knew I had the I was mail a DD215 which is a Correction to the DD214 with some of the medals and awards added. That being said there were 2 errors the Navy didn't on my DD214 and when the RO received the information the awards and and medals were not added to my claim file . If the RO would have entered that information in my claim file the scale would tipped in my favor .I filed an appeal for a Earlier Effective Date to to CUE and it will be going to a judge . Any thoughts would be plenty help thx.
  4. I file a NOD for a EED for 100% SC for PTSD P&T No Future Exams . VA used the same information that I was twice denied since 1989 to grant me 100% . I filed a NOD for EED.
  5. I didn't ask for a hearing I just asked the DRO to review it and grant or I will start my appeal.
  6. Hey Wayne Waco has my NOD for a EED. I was told that I would soon be getting paperwork or a letter concerning my claim and that's been 14 mounts ago.

  9. I have a NOD to the DRO for an EED for PTSD , Information used to deny SC for PTSD was used 12 years later with C&P exam to grant 100 % for PTSD. Should I wait for DRO to decide or get a lawyer soon . thanks.

  11. I was PT IDU with no exams scheduled and when I was awared 100% for PTSD the IDU was removed and now I'm 100% PT with no exams scheduled. can unemployability be removed just because I was awared 100% for PTSD?.

By TOMMY WITHERSPOON twitherspoon@wacotrib.com A former Waco Veterans Affairs Regional Office employee who concocted a fraudulent scheme that defrauded the federal government out of more than $650,000 was sentenced to almost four years in prison Wednesday. Kristin Galloway, 32, the pregnant mother of two small children, was sentenced to 46 months in federal prison, fined $1,000 and ordered to pay $154,400 in restitution. She pleaded guilty in October to theft of government property. Galloway, who worked at the Waco VA regional office for seven years, apologized to her family for bringing it stress, worry and shame and asked U.S. District Judge Walter S. Smith Jr. for mercy. According to records filed in the case, Galloway, a rating veterans service center representative, fraudulently posed as a veterans’ service representative with a veterans organization and offered to assist veterans in obtaining VA benefits for a fee. VA investigators discovered she used her employment at the VA to gain access to a veteran’s files and unlawfully increased his disability rating to 100 percent service connected, court records show. The change in his status generated a $261,683 retroactive payment. After meeting with the veteran, Galloway created a Chase Bank account in his name without his knowledge. She also created an email address in the veteran’s name and had all VA correspondence intended for him diverted to her mother-in-law’s address, according to court records. She also created a fake Facebook account for “Cynthia Christy,” the alias Galloway used during her fraudulent scheme, officials said. She also used two prepaid cellphones to conceal her identity. Galloway also used her job to submit and backdate a forged VA application for benefits for a family member, records show. She opened a post office box as part of her scheme so she could intercept VA correspondence to the family member. Galloway also fraudulently rated a claim for another veteran and received $154,000 from the veteran the day after the veteran received his retroactive VA payment of $386,753, according to the records. Agents with the Veteran Affairs Office of the Inspector General launched an investigation in the fall of 2012, shutting down the accounts and intervening before Galloway could collect on any more money, Assistant U.S. Attorney Greg Gloff said. Agent Rachel Malone of the Inspector General’s Office testified Wednesday at Galloway’s sentencing hearing that she and her family lived a lavish lifestyle in a $300,000 home. They took an overseas trip, spent $15,000 on furniture and another $12,000 during another shopping spree. She also had LASIK eye surgery, Malone said. “It’s important that the veterans who served our country be able to get the benefits and help they need from the VA,” Gloff said. “When people like this defendant take it upon themselves to defraud the government and use that money for their own personal needs, it takes money away from those deserving veterans.”... My take is that there 's no way others didn't know ...........Lord help us !
  14. VA never asked for anything I initiated the stressor research, 1st, US Naval Personnel Records , CURR , Government internet websites. I asked the rep. at CURR did I need to send a copy of the report to the VA and I was told that they CURR had to send it to the VARO. The VARO thought I was lying, my very first PTSD Exam I was not given any dx of any kind But the VARO still used it . In the nutshell If the VARO would not have influenced the C&P examinations I would have got a dx for PTSD the first time .thanks again.

  16. Thanks for your help Berta and any others. I just don't want to waste time with the EED if there is a CUE and if so how do I switch from a DRO hopefully EED award to a CUE ? Thanks again. and talk about Buffalo, the VARO in New Orleans are like mobsters.

Still looking but they did mention the BOD rule but it wasn't applied and said the 2 examiners didn't give me a PTSD Dx and that it out weighed everything else and due to inconsistencies on my part . But I get a reply from Was DC VA now I get a C&P and all the info that was no good a decade and a half ago is now good enough for 100% rating .Thanks for all the help from everyone .
  18. I was self medicating while on active duty. I was named in a undercover (NIS) Naval Investigative service sting . I never used any kind of drugs before I came to the Navy. I was a SH Barber which is in the supply Div. The Officer over the Supply Div. introduced me to drugs. When it was time for rescue operations and evacuation assistance I had do a different job being a former Boatswain mate manning utility boats was not a problem for me. And the Drugs took the fear away, regardless to whatever the VARO may think,, the evacuation of Saigon was no cake walk. Long story short. the Officer in charge of my Div was arrested and I was named as a user and had a choice of the wrath of Captain's Mass NON Judicial Punishment that consisted of a lost of present and coming rank dock 1/2 of my pay and 60 day restriction and Honorable Discharge or Court Martial and a chance to be Dishonorably Discharged. So years later of not knowing what was wrong with me I started PTSD treatment in the mid 1980's I didn't know what DSM IV was or what it meant or was I suppose to ask for the exam. Anyway the VARO used my in service drug problem to influence the C&P examiners saying I was a trouble maker even telling that I had no medals , So over 30 yr.s all my medals, ribbons, and awards I never knew I had caught up with me and all or on file now. Closing if I stand a chance of a CUE back to the year of my discharge tell me thanks for all help.......

Berta sorry they gave 100% for PTSD after a C&P in OCT 2014 But effective Jan 2014 and after I got That retro and SMC retro I filed a NOD for EED for PTSD for 2003 the year (CURR) Center for Records Research verified my stressor I get a Monthly comp for 100% PTSD and 60% SMC. Berta I was 60% PTDIU receiving 100% comp. when I was awarded 100% for PTSD they stopped the IU and now I'm at a single rating 100% rate for PTSD and 60% for unsuccessful surgery on my lower intestines. I will get the paperwork to you so you can advice me . sorry for not being as clear.
  20. First of all Thanks for all the feed back. first I was 60% Totally Perm. Disabled Due to un-employability with no scheduled physicals. So by e-mail Pres. Barrack Obama contacted me for Veterans Day so not thinking it was him I went along with what I thought was a bogus e-mail . I was asked how was I doing and I went on about the VA and how I was tired fighting for my PTSD Claim after being treated for PTSD since 1989 BY the VA and I said that if the VA would focus on getting claims right the first time the backlog wouldn't be as bad. And I thank for not forgetting Vietnam Veterans. About 4 months later I get an e-mail from the White House Dept. Veterans Affairs and it had the White House Emblem on it and I was shocked .This is Official response in reference to your e-mail , If you have any new evidence to file again basically and when I filed I was granted 100% PTSD without knowing , when I found out 7 months later so I had to file for retro and SMC and the local VA to me if I had a problem I should deal with them on the local level.
