  1. Thank you all very much, the RO asked me on Tuesday to submit a letter requesting another rater to look at this decision and the effective date. They stoled three years from our family. Apparently, at the request of the RO, I put in a reconsideration and they rated me from Oct 2014, when the original date was November 2011 with no breaks in time. The reconsideration now (again), is for the effective date to go to November 2011 (corrected), instead of the 2014. Mr.>>>>> told me that it should be a quick decision, we'll see. I also have a appeal waiting so I can put these contingencies in incase. Unbelievable, how incompetent sometimes this thing can be.... I explained to Mr.... that how in hell can anyone in their right mind just throw three years worth of possible retro....

  3. Sorry to hear that. Keep up with the NOD. Thanks, I will put the NOD right away, as soon as I get the letter. They are low balling three years, that crazy. The claim started in November 2011, they said because of a re-open or reconsideration that it will start in Oct 2014.... that nuts. I know that they cant legally do that. I called the Director of Dirty Waco RO and told her, since she was already aware of who I was. She told me that she was going to get the info to the appropriate people. I hope I can catch them before they finalize my claim, and revisit the effective date. She agreed that three years is "unfair to throw away".....
  4. First off, I want to thank you all for your help in the last few years. I just received my rating: 70% SC PTSD 10% SC Residual Scar 100% P/T IU The only thing that I need to ask you folks, and maybe Berta remembers, is that the RO called me, a VA rep and asked me to pull three contingencies from my appeal and do a re-open. So, I did and told her that I did not want to lose all of the years that I have waited without a break in time. My effective date is October 2014, they did not honor the November 2011 date that the VA rep told me that I would not lose. So, should I put a NOD for a reconsideration on the correct effective date, I also have in writing (fax) stating that the VA rep asked me to pull these contingencies?   5. Yes, I downloaded the results, they should be in sleep apnea results. Thanks for all of your help. I also was rated 50 non service connected until all of the evidence came down. josef7070

  10. True, it might be that I receive migraines SC and not Sleep Apnea, but I will keep posting the decision. I am biting nails, the VA rep called me after posting all of this and told me that I received unemployability and a favorable rating. I am on the preparing for notification stage, how much longer... thank you all josef7070

  14. Hello, first and foremost, thanking your husband for his service, and you for your service to a veterans (spouse) , it commendable. I read your post and I agree with Berta's respond, (Ms. Berta was extremely helpful and critical to my favorable decision with PTSD and other Gulf War contingencies). As I read on, this also does not make to much sense to me either. If I may add, have you requested your husbands C-file and official deck logs or documented (official) military records of his whereabouts and his connections to the incidents. When I first submitted a claim, it was denied several times, even though I was in combat both in land and sea in the Gulf War. I also received 10% SC for a residual scar that was obtained by smashing my head on duty to a call for general quarters. So, even though there was an injury, either physical or mental, it seems that the burden of obtaining records, and a solid stressor letter is on the veteran, in my opinion. Once I received all of my medical records and finally wrote a solid stressor letter, with copies of buddy letters, my claim took a major turn around. Of course, I cant say that will happen to your husbands claim but I learned several things. One, is not to rely on the rater to gather all the informant. Secondly, the more compelling evidence you have with dates of the incident, the whereabouts of your husband connecting him to the incident, and the results of the incident, is critical in my opinion. I also added CFR's to alert the rater that it meet some type of regulation, even though they might know, it is nice to have them (VA) know, that you are also knowledgable of the contingencies and the laws around the what your husband is claiming. Another thing that I was learned because of this wonderful forum, was that I emailed (fax, mailed) the SECVA and other politicians, and even the director of the Waco Regional Office explaining the issues. I am not to familiar with medicinal cannibus, but I hope that this helps. I was told year ago that I was in good hand in Hadit, even though I was not promised miracles, it was still refreshing to lightly and respectfully vent and ask for opinions.     Pension

    I just had my pension finished today, sent notification. Will it also show on the EB8 letter? Or will it show if I was awarded anything somewhere else? It went from Claim received on April 08 to yesterday, when I checked this morning it sent to decision approval needed and two hours later Sent Notification. I was flagged hardship? I was awarded 10 CS, 50 and 30 NSC, and I am awaiting my current claim to be adjudicated by the end of next month? thank you all for the info, josef7070

  17. I have been fighting the VA, Waco RO for the last two years through re-re-opens that they have initiated. After reading several posts, it seemed to me that there really is no cooperation with these folks. So, I have to make noise and contact the Secretary of Veterans Affairs, the Undersecretary of Veterans Affairs, 5 Congressmen and Women, 6 House Representatives, the Chair of the Committee of Veterans Affairs in both houses in Congress. Finally, I wrote an email to the Director of the RO. After an exhausting, both emotional and physical wear down, two weeks ago, the RO finally was wiped in shape. The Director ordered this mess to be fixed, and when I called to speak to him, his secretary told me that "I know how you are, and there are numerous inquiries about your claim, I am sure he has ordered someone to do something". I was contacted by a congressional liaison and I have my C and P's next week for my claim, I have my Appeal in two weeks with the remaining contingencies, and I was promised that they would adjudicate my claim before my Appeal to the BVA. I also recorded every conversation that I had with the liaison. Now; I am not recommending trumping your lawyer or even advising to make noise, but maybe being a bit more proactive yourself and requesting answers to your questions would be a start. They also have a DRO working on my claim and has extracted two more contingencies to be considered. Reminding that it has been five years, so there was a build up to this madness. I am keeping my fingers crossed like Detal, who wrote above as well, Just remember you served, it is your claim, no one else's. Keep posting in what happens, I hope that fellow sisters and brothers will chime in to give their advise. Good luck. josef7070
  18. I truly appreciate all of your information. It has been a long drawn out process. After two weeks of Congressional Inquiry and SECVA interfering and inquiring, the Waco Office advised me that the rater can rate me but, I have "potential for more money" from the liaison working with me after the Director was contacted the the above mentioned. I have very strong medical evidence and my VA Dr. connected my PTSD Anxiety and Depression with my stressor thoroughly last week. So, I feel confident but I also do not maintain any trust after pushing the RO to do what right. Where can I get a copy of the VA PTSD DBQ? It the change to the DMV V a positive or negative major change for or against veterans. I will look into the 38 CFR 4 today. I truly appreciate all of your help and keeping the tradition of camaraderie. Thanks Gastone. Josef7070
  19. Finally, the Waco RO, after having spent hours writing the SECVA and others, gave me a C & P for May 6 and May 8th. I have strong medical evidence and a strong stressor ltr. Can anyone let me know, if any wishes to chime in, what type of questions they will be asking? How long will it be? Stuff like that, I am diagnosed currently, so just curious? Thank you all for your help in these last trying months and months. josef7070

  23. Update: Within two weeks, there has been some sort of movement and misguidance. After having my Claim targeted by a rater in Waco, I wrote the VA Secretary and dozen of Congress folks and the Chair of the Committee in the House of Rep. Apparently, all of those communications were addressed and the secretary of Director in Waco told me by phone that there has been numerous inquires about my claim and it will be addressed. Now, my appeal is in five weeks in Waco, TX after waiting three years. My claim has been been given to a DRO, according to Larry in Waco who has been ordered to communicate with me to "work with me" by the director of Waco. After spending some time on the phone, as he went back and forth between me and the rater, he informed me that my claim was very strong in evidence and I needed some more C andP's. I told him that I never minded C&P's, but why so late in the game and why so close to my appeal when I could have had those contingencies before a judge. So, he told me that I just need on exam in Temple, and that the director was going to pull some strings to get it ASAP. Come to find out that the rater has ordered four exams and they are three days prior to my Appeal date, coincidence, I think not!!! The rater told Larry that she needed to connect my other operations to my disability medically with a doctor. First he advised me that my doc at the VA was good enough, so I scheduled an emergency appt. Then he calls and tells me that the rater was it in temple as well. I went to my doctors and both of my physicians called Larry and wanted to know why? when notes in 2012 were explaining all of what they wanted. Well, my doctors did exactly what the rater asked as I showed them the FOIA, and of course they have been treating me for years. I was promised that they would adjudicate my claim ASAP, now it looks seems as though they dont want me to bring these contingencies (claim) before the judge. I regret ever agreeing to the C&P's Thursday when, I was asking them to rate my claim. Now, my claim reads Gathering of Evidence, I am going to call on Monday and have them rate my claim as promised and, I will refuse to take those C&P's because VA doctors connected the nexis with my whereabouts in the Gulf War. Good thing is after reading all of these discussions, I recorded all of the conversations I have had with Larry. This has been ongoing for four years. also my doctor and a TVC rep, advised me that my three buddy letters who were Supervisors attesting to what my claim is and the changes are lay people and they CAN be considered evidence. Something is going on. Sorry for the longwinded write up. I needed to write this down and get some opinions's from you all. I hope by the end of the month this will be over...   24. I got off the phone yesterday with 1 800 bennies, and as I was asking questions concerning my claim, the rep told me that my approximate completion date was now, March of 2016. I finally got through in the early evening, and the rep advised that the VA has now pushed the completion dates far in the future. He also told me that there is a new system in place as of yesterday, and he is not sure it this is a glitch, but he can't understand the year push on claims. WOW, what was changed? What new system is he talking about? Why are dates now being pushed one year? I told him that I hope earnestly that we don't go back to the old regime and have to wait 500 to 600 days for a completion of claims, no answer. Has anybody received the same info?
