  2. Yes! This is the problem here thanks for pointing this out. The C and P exam for the VA the dentist never asked for a rom with pain and this where the va got the reduction from. The recent DBQ I did earlier this week the dentist done it . I think Using this DBQ along with a sworn statement from me and my wife saying how the bad the condition was from 2010. To present should be enough evidence To convince them to change the effective dates to 2010 and change the current rating to back to 30% at least putting me at 100-% total. What do you think? I checked my exit exams. I don’t have anything for dental stating rom
  3. My appeal was closed due to failure to response to Statement of the case with 90 days of letter. Which I did and I have proof ( signed recipe and tracking number which was printed at the bottom of paper ) So I had to prove I did and it took a while for them to reopen my case. So this is why I think something is wrong with the effective dates. Plus if you read the letter that I posted it says I have records and exams dating back to 2010. The problem was just as serve as it is now then back in 2010. That’s why I filed. I know for a fact that I have records that goes back to at least 2013 of me being seen and treated for tmj. These condionts started while I was Active duty. Can I write a sworn declaration stating all of this for proof if I don’t have anything else to submit for 2010 to 2012?
  4. Been trying to get a straight answer to this but no one seems to know. Maybe you guys can shed some light on this and what I should do. I Recently won an appeal for Headaches and TMJ. I originally filed back in 2010. Since 2010 I've been having multiple symptoms of these conditions. In June 2018 I received the case decision letter in the mail. I was granted 30% for tmj backdating to 2015-2016. and 10% from 2016 to present. I didn't receive any back pay because the BVA altered my dates so it wouldn't be any backpay even though I've been treated for these conditions since 2010. My question is, can I file for a NOD asking for a DRO to take a look at this, along with a sworn declaration explaining whats going on and why I think these conditions should be backdated to 2010, not 2016? If I did my math right it would be a backpay of well over $100k.
  5. Hello, I found out why the effective dates are what the are. The Va is saying that the BVA are using the date of exams instead of using the date of when I first file. The Va rep said it's up to the BVA to decide which date to use. With that being said. I'm just going to file for an Increase for TMJ back to 30% which would put me 100% if granted. However, I just recently took new DBQf for TMJ and i think it may be enough for an increase. Should I used the legal format template for a Lay of statement (Sworn Declaration) when I submit my claim along with the DBQ?
  6. I don’t have a VA Neurologist. Just a Orthopedic doctor. He’s wanting to do a MRI and X-ray. So when everything done. I’ll only have my med records from active duty, and treatment records from the VA PCP( Which I used to for the back claim ) and a New DBQ.
  7. How did this go? same questions, currently getting 10% for tmj. I have a lot of ringing in my ears now and would like to file Tinnitus secondary to TMJ. I just dont have any current medical records of being seen for tinnitus .
  8. I'm already getting 20% for the Lower back condition. Wanted to file for numbness and tingling in legs and foot ( radiculopathy). But the only thing I have for Evidence is a DBQ and prior health records that I used for my initial back claim. My Question to you guys is what else do I need for me to win the Claim?
  9. That’s where the confusion comes in at. I don’t have any evidence from 2010 Other than me filing for it while I’m was on active duty.
  10. Hello, Not sure if I’m posting in the right section. i filed for tmj and headaches right before I got out in 2010. I was denied, I appealed, it lasted for about 7 years. During those 7 years I submitted a DBQ for tmj from private dr. In 2015 For tmj. The Va sent me to a C and p in 2017 for tmj.  I had to go in front of the board in December 2017. I won the case. Last week I received the final decision. From 2010-2015 I was granted 0% for TmJ. From 2015-to 2017 I was granted 30%. From 2017 { the date which I did Va C and P} to now I’m granted 10% my question to you is, shouldn’t the VA backed my 30% from 2010, the day I originally filled ? I feel as if my condition is still at 30% and I can prove it with a new DBQ When I was at 30% In 2015. I was at 100% but since they bumped me down to 10% now I’m at 93%.  At this point what should I do? Appeal? did the Va mishandled this?  Or should I just fill as a new claim stating that my condition is worst and provide the new DBQ ? If the VA would backdate the 30% from 2010 it would be retro pay of over $100k. For this reason is why I think the Va did it this way ! hope all this make sense

  12. In my opinion. I’m seeing they raised me to 30% then dropped me back down to 10% and just 30% for the headaches
  13. Finally got a response today. But I have no idea to make of this letter. Can you guys please explain. I thought when you appeal something it automatically goes back to the original date that you files. So what is the total amount granted ? Its so confusing
  14. Hey how many C and P’s did you have to do. I’ve only did one for each condition prior to the appeal. the headaches and tmj was the only conditions they didn’t granted me so I went in front of the board. Would I have to take anothe c and P even thought I won the appeal ?
