  1. If you feel you have good evidence, I would suggest contacting Bergmann and Moore. As a Marine's widow, where other Vet attorneys' turned me down, they didn't. -Seeing the evidence I had. Taking time to read it, although long, and seeing we could win. We did win. Keep fighting.
  2. Hi, I'm in a very similar situation. TDUI was granted by BVA and other accompanying claims were granted in so far as service-connected, while others were basically denied or remanded. What my most excellcent Vet attorney's case manager told me [ on here even, they agree this team is one of the best] Is that it does not go back to RO, since TDIU was granted. ( that part of claim and others granted). It goes to a different office, where my legal team now submits a date, with evidence, the TDUI should have been paid from. It's nothing for RO to decide. They have some kind of interim office set up now, when such is granted, to just get correct date concerning back pay. They told me should be around 4 months or so till actual $ is sent. My Marine husband died 2012 with open claims. And the biggest hug to Berta, cuz before I read her writings here, I had no idea I could, as his widow, do a thing to keep fighting, which he told me to do, on his deathbed...for his sons. He died at 90% which basically meant nothing for me or his sons. Even though I knew the seriousness of it all how VA kept him at 90% I did NOT know I could substitute myself in claims till after his death and just heart-broken, I was reading other stories till I read Berta. You will never know how much you helped me and our sons, Berta for I have no words to tell you. He told me to fight it...the 90 percent and even he didn't know how. I am sure he is smiling from heaven, with rays of light on Berta. And thanking her.
  3. OK, thanks everyone. I'm not sure I want to stay in this state if I win, but can see now I will have to contact each state separately to find out their individual rules pertaining to the exemption. Seems the no remarrying one applies across the board even in states that grant the benefit. But does not apply to chpt 35, va home loans, or champ insurance. Just trying to navigate through this maze. Interesting about Georgia, since that state was not one of the 12 I saw listed. Saw AL, AR, CA, FL, HI, MI, NH, NJ, NM, OK, TX, and VA as 100% tax exemption states. Thanks again.
  4. Thank you, Buck. We were getting a partial property tax exemption based on the then-disability rating, but that home has since been foreclosed. I am not even sure if I am even now eligible for a partial tax break due to the 90% rating, as the survivor.
  5. I am wondering if being granted DIC includes the property tax exemption benefit for the widow or widower? My spouse died at 90% service connected disabled and I am still in the appeal process for DIC and service connected death. I am substituting for undecided open claims at the time of death, also. I read that only 12 states so far offer 100 percent exemption for 100 percent disabled Vets but since my spouse did not live long enough to receive this benefit, if DIC is finally granted to me, will I be able to get that exemption? Thank you for any info on this.
  6. As a surviving spouse, and before I had an attorney, I asked the vamc for certain med recs I thought would be specific to the open claims I would possibly be continuing. When asked why by the records dept. I made no mention of the substitution reason, only personal family history reasons. Med recs on cds were sent to me in about a week. Tried to contact physician who signed the death cert. after reading those records with a request. The nurse I spoke with had full access to the records since when she called me back with that Dr.s denial to my question, and I quoted specific info from the record itself....the nurse asked, "Where is THAT?! " I gave her the date of note and she looked it up right then and there on the computer. Said she would tell doctor and called back to inform doctor still denies my request and kept it short and sweet. So that is when I decided to hire a lawyer. Fast forward to now, that same hospital is refusing to release med recs to my attorney. And just sharing this in case it helps another vet or survivor....the Vamc has to answer to the RO, the med recs are legally under their control when there are open claims. The hospitals privacy office must yield to their request for records which is how my lawyer is proceeding, reporting them etc. I am glad I got some med recs though, when I did. Just in case anything happens to get lost by them now or sumthin. :-)
  7. Hello to everybody here, and to Bob, if he is around. :) I have been reading this forum for a good while now and so appreciate the great information and experiences shared. I had no clue what I would be facing to get DIC approved after my 90% SC disabled husband died. He died with open claims before his informal hearing came up with the RO. He waited a long, long time for that meeting but didn't make it. He was too sick. Two grand children have been born since his death and a third is on the way. I no longer have a home for them to "go to grandmas house." Thankfully, because of this site I found a good lawyer to help with my case. I hope if Bob does read this that he will please do something to improve the wait time for the Veteran's survivors because everything my husband worked for all his life (when he could still work) is now all gone. He died waiting but I am still here, his kids are still here, along with the grandkids he never met. He just felt the first one kicking his strong, healthy legs in vitro.
