  1. Oh they so ignored and refused me on this and I even called the VARO complaining, no new exams nothing, they just were out to screw me. If I had a penny for every request and or docs that I have telephoned, sent, faxed, or emailed over the years which were plain out ignored and or missing I could probably buy a small tropical island. I rather believe to be able to record the C&P examiners with a witness videoing the whole thing. It should be a law that witnesses are allowed to go with you.
  2. I want to know if any of you have been forced for movement in your c&p exams by an examiner? I was. In fact, at my exam the examiner went through with me my MRI and showed me MS spots all over my lower spine and all sorts of other problems, I just had surgery for blown discs and paralysis... a several moths prior, it was hard for me to even drive to the exam not being able to hardly feel my feet and I had severe arthritis since it was winter (nerve roots all clumped together), I got around with a cane. So, the examiner had me do the motions and pushed me down, and at the sides, etc... it hurt (she literally threw her hand and pushed me and caused nerve damage, my back was extremely swollen from arthritis), I had no idea what she was doing and because of my problems I had some incontinence which was embarrassing. I had developed this from exposures to certain things in OEF (spots on spine). I was so mad, how bad the VA was screwing me any way they could and hell I just got back from war a year prior and this is how I was treated for sacrifice to the country. I left in tears and dirty drawers. I had no idea what to do, the VA hospital refused me c&p records from this and the VA only used it against me and then ignored as the exam didn't exist and the service reps with DAV, American Legion, all didn't give a damn and since I was a very young guy-they didn't care either; being first wave of guys back from war it was sparse to see young vets since not being in war for a long time-I am sure-but they didn't give a damn-USELESS SERVICE ORGANIZATIONS. I tried to fight back, I got nowhere, the VA was against me, in a demonic way. THIS WAS A VERY, VERY, VERY BAD EXPERIENCE I WANTED TO SHARE WITH YOU. I realized the examiner was puppet for money, the VA and some demonic people within the VA wanted to screw me and that VSO's are worthless and YOU are all on your own. By the way, why is it if you have pieces of your spine removed it isn't considered like a loss of a body part is, losing a leg or an arm is paid out SMC, but if your missing parts of your spine how in the world is that now considered a loss of a body part and not entitled to SMC? It would be like saying, oh you use a prosthetic leg, so you leg is fine, no loss. Hence, segments of spine removed and replaced, fused, etc. I wonder why this topic hasn't caused more fuss in the VA community as range of motion is a joke, and that just all that is used to rate.

The basis for this discussion is prior to the 2004 effective law; military individuals would purposefully find ways to make sure (under their command) injured or otherwise to receive no VA compensation when they got out because in their eyes, at that time, you would get out and would receive more than them (and I am talking the Senior NCO's and Officers here at retirement), and did everything in their power to make sure treatment wasn't provided, etc. because of the jealousy factor $$$$ get people wrongfully off Medical Boards etc. it was an epidemic. Now, since that has changed (the law) the military care and recordings has improved dramatically since this jealousy factory had been about solvent. Now, anyone who was in prior to 2004 would share to comment about how these veterans were treated prior to such effective law because of the jealousy factor. I think the commentators so far have took this the wrong way. When I got out, I had shrapnel from a round in my back, a busted spine, partial paralysis, PTSD, hearing loss and headaches from explosions/IEDs.......and a bunch of other stuff prior to the 04' law/ OEF. I am trying to relate to others who got banged up, even while in training, and got screwed by your command because they in their eyes only saw you getting compensated, not your injuries (and did not treat you because of this properly). So, shouldn't veterans be able to prove that they deserve full retirement from the military plus VA compensation too. Not just the other way around. In my case, shouldn't it be streamlined where I can show, hey I have all the documents conditions right after I got out and had bunch of surgeries, etc. and my command where a bunch of jerks who got off on screwing peoples lives over and look here is the proof. -------------------------------------------------------------------------------------------------------------------------------------------------- I have also revised this in the original post to clear up any confusion.
  4. This is a general question. One that has been fumbled around in my mind for some time, as I opinion this myself here. Do you think it is fair that retired military (with the exception of those who went through Physical Boards and Medically Retired, under 20 or 30 yrs.) should be able to also keep full retirement pay, plus VA Compensation? For me, this is what invokes this question, and quit literally nerves me and I think it has become an epidemic. Military service person (as example), goes on to complete full retirement and then all of the sudden near retirement has all sorts of medical problems (buddy system helps out, let's be honest here, wink, wink) and therefore receives both retirement pay/VA compensation (often near 100%) without reduction (not saying there aren't some legitimate cases). SO, IF YOUR SO DISABLED, how were you able to stay on Active Duty? I think the only exception should be for people who were in direct combat with combat injuries and or people in a uniform role were injured right before their retirement. If you were so disabled, like myself, you had to get out. This didn't used to be allowed, CRDP until 2004; the dual payment. And in fact, was used as a tool to torture people who were too injured or disabled to stay in as a jealousy factor would kick in, my own USMC experience (being that their retirement at 20 would only reach max close to 60-90% VA rating) and my opinion was tort (saw a lot of it with tons of young Marines, and dealt with it myself, even while being severely injured in OEF, blown spine, shrapnel in back, priapism for over two-weeks in war and on ship and nobody/command cared, how could this be, how could this exist, it did, and only because of the jealousy factor). Now, it seems like near retirees have been riding this boat, collecting CRDP/retirement. As illustration, I used to work for the Fed. Gov't, people would come in right before their civilian retirement and claim disability, they were working full-time (40 plus overtime) I remind you, and now, all of the sudden they are too disabled to work. Now, why, because SSDI over SS Retirement Pay is often twice as much as it kicks in a higher amount and you receive it decade or more earlier (plus your pension), if awarded, and likely with an atty. So, to me, this is one thing, for you, I am not asking you to defend or argument for yourself and become exploitative, compulsive, or vulgar-AFTER ALL, it is current law. I just want you to give me a clear conscious how and why this dual payout should be in receipt, and remember, if you are SO DISABLED to work, you shouldn't be on active duty, period. It is one thing for a disability to be caused or aggravated by military service, it is another things for this to effect your ability to work with such conditions through retirement, and if you have had such conditions they would be no severe enough to impact your service length, think re-rated for us who have been through hell with the VA's irate C&P's, rating downgrades, re-reviews, etc. It is kind of like the girls who have fun their entire enlistment/commission with loads and loads of guys and then cry wolf and say they were raped and receive compensation.   5. We'll, not really a poster here. Pls. bear w/me. Marine combat Afghan vet. Part of orig, task force. 01-02. enemy planted explosives in metal, they triggered/blew up (huge IED, still see it, the pieces of hands and fingers way in the air, all too graphic), I was near blast, suffered TBI, never treated for it. I was also in the blast areas for large detonations by EOD, daily everyday, some would even knock you down, yeah there was a lot of stuff, ground would shake like an earthquake. I was then curious why I would often get dizzy spells and feel like I am moving in place (I had no idea what TBI or PTSD was, these things were not mentioned of or about that early on in war or until several years more). Later in life, I have learned this to be vertigo. I also had bits of sand and shrapnel in me, all over during this time from explosions, I used to sit and pick it out. So, finally I went to get treated and help and hopefully rated for it (there is such a thing as a TBI clinic, never knew existed and no docs ever cared to get me seen, eyes roll :/ Chinese kid in lab coat (turns out to be a Physicians Attendant, PA), high fives his co-worker (another Asian, Dr.) on the way to the room, at that point I was already ready to leave, I have been through this all enough times. Yup, you could just see in this kids eyes how he wanted to F* me and continues to tell me (in his soft broken English girly tone), nah, TBI is this and that and it would have went away by now and gave me a complete physical exam (a rating exam, this was NOT a C&P appt.) for no reason (test pig, as I am sure he was going to do ratings and screw people). He had so much enjoyment, just to F* me. He looked at an old MRI brain scan result notes I had done for sinus pressure prob. four years earlier. So, at the end, nearly shedding tears as I am so disgusted with these privileged kid Dr.'s at the VA. Field reports and after-actions all were never recorded right and most drives deleted or burned in rotation (yeah, accidentally, sure) along with a lot of incompetence, nothing in my medical records just another day in in war then. Anyway, I am older and tired of this nonsense. You can reply back and tell me what I need to do and this and that, but if nobody is doing what they are supposed to be doing and nobody cares and there is NO repercussions and nobody gets held accountable, then nothing matters anyway, it is the vicious cycle within the VA which keeps recycling itself. It is not the system that is bad, it is the people like this Asian kid, one of many, many I could write about. Now, so to speak, I have to continue to live with this, having no idea how to treat it. I am already 100% SC, so not like this would have been anything more for me, I just wanted treated to help keep this under control. And trust me, that 100 was fighting tooth and nail for the last 13 years! This TBI matter will only go back to 2007, ugghhhh.

  7. I like this, everyone should read this. In fact, in my case; (where I will not mention what VSO) sent me a paper form asking for a private money gift after my rating and they did not represent me properly or present my medical records or submit to the VA hardly anything I sent them and I got a very, very low rating. I have had to figure out everything on my own since and will ONLY get an accredited attorney. Without any doubt they were sidelining with the VA against me, I am positive and have no idea why. I am disgusted, treated like I wanted some handout, no consideration of all my medical problems (stuck at home in pain living with parent, in bed most days all day) or what went through in service and combat. I would have never known, you sacrifice your health and potentially give your life for your country and get a whole bunch of injuries and even the VSO's are against you. Someone may look down at this, it's the truth in my case and I am not saying all are like this, the have-and-have-not rule seems to always apply though regardless of your disabilities no matter at the VA hospital or otherwise giving appreciation for what you sacrificed of your health/body(period)
  8. I want to know where I can find the procedures that are supposed to be followed by C&P examiner for an exam. Called VA 800# to get this, all I got was some kid that sounded thug, completely arrogant and ignorant and acted like I was calling the Pentagon (typical), 30 min. on hold for that-so I have resorted here. These people at VA call centers act like veterans are some enemy to the nation-shot like me (who cares), paralyzed like me (who cares) etc.... nobody seems to care the sacrifices we all have made-its' a real shame. Can you even make a complaint against one of those employees? I am so tired of this and pissed I am literally shaking-what I would do to this kid. Afghan vet here. I do not think the examiner followed properly for a condition or else it should have been service connected.
