  1. Thank for the answer, I should be getting the letter in the next day or two, it was just odd for one claim to show and the other two not showing. I understand about benefits, I have one claim under appeal for a TBI that was rated 0% not service connected and no one at the VA can tell me why. They say it can not happen that way, I told them I understand that but you did it, then they got upset with me. Thanks again.
  2. I had a claim finalized last week. The question is I had 3 issues decided, but only one of them showed up on the disability part of ebenfits and it was denied. the other two did not show up yea or nay, has anyone had this happen. Thanks Ken

Thank you for the help, yes that is date of the original claim , I have a remand on the same case for after 2011 till now at the AMC, that was closed yesterday, waiting to here from them, I can not fine the decision at the BVA site to see what the judge ruled. I got a call from the AMC, the guy I talked to said I got 10 and another 20 on my left ankle, that would make me 100% from 2011 til now. I want to see the paper work first. Thanks Ken

ORDER The appeal for an evaluation in excess of 10 percent for right ankle limitation of motion prior to September 10, 2008, is denied, but a separate, compensable, 10 percent evaluation for right ankle instability prior to September 10, 2008 is granted, subject to law and regulations governing the effective date of an award of compensation. The appeal for an initial evaluation in excess of 10 percent for left ankle limitation of motion prior to September 10, 2008, is denied, but a separate, compensable, 10 percent evaluation for left ankle instability is granted, subject to law and regulations governing the effective date of an award of compensation. The appeal for an evaluation in excess of 20 percent for right ankle limitation of motion from September 10, 2008, to April 2009, is denied, but a separate, compensable, 20 percent evaluation for right ankle instability from September 10, 2008, to April 2009 is granted, to the extent not precluded by 38 C.F.R. § 4.68, subject to law and regulations governing the effective date of an award of compensation. The appeal for an initial evaluation in excess of 20 percent for left ankle limitation of motion prior to March 10, 2011, or after June 1, 2011 is denied, but a separate, compensable, 20 percent initial evaluation for left ankle instability from September 10, 2008, to March 10, 2011 is granted, to the extent not precluded by 38 C.F.R. § 4.68, subject to law and regulations governing the effective date of an award of compensation; the appeal is granted to this extent only.   6. thanks for all the help, but the VA stated in the claim that it was 0% not service connected, it was sent in for a reconderation and came back 0% not service connected . I was told if you get 0% it is service connected. does anyone know if you can get 0% not service connected? Thanks Ken

Chuck75 the funny thing about it is, I work for the military, the same people that cause all my SC disabilities and they do not want to let me off to see the Doc and complain about me being sick.They try and make it hard, I just go by the rules, which make them go by the rules and if they get the rules wrong I point them out to my boss so he can get it right the next time. I am 90% and I work for a government agency and during one of my yearly evals, I was told I took to much time of work for sick leave and almost all of it was for my disability, the only other was from food poisoning and I had a doc. statement for that, I told him he did not want to go that way because I would report him and he backed off. They are picky about my days off for sick leave, they want a letter from the doc every time. Ken
  11. If you were house bound after your spine surgery, you can file for that, I got it for 3 months and it was 3123 dollars I think, I know it was over 3100 dollars, you might want to check in to that. Ken

I just got rating on a clam for effective date on my bilateral claim ankles, it was denied for the back dates, the question is on the same letter, the last line said I did get my bilateral plantar fasciitis service connected and I would be sent a letter later giving all the info. Has anyone else got a letter like that, not giving the rating on it, I have never gotten one like that? Thanks Ken

  15. Pete53 Yes I am working at this time, trying to work as long as I can until I am not able. I work for the a civilian police officer for the military dept, they had to waver me because of the narcotics I take for my back pain, don't know if that is legal or not. jbasser it was the AL that sent in the wrong paper work and yes they are working with me, I think they know there is a big problem they made and are trying to fix it. Berta the audit was requested on the same form as the rest of the calim and thinks for the in on the POA files. I upset one of the raters from the VA when he called me about on of the issues on my claim and was telling what he thought about my claim and told him what I thought about him and the next day all my claims were canceled had to go up to the VA and show them my file from the local county VA office with all the claims and where they had received them, I had to reopen my claims and I think somehow the old claims got opened back up and they are trying to rate me on them now even though I already have ratings on the claims. I also told the AL I talked with my lawyer all ready about this issue and they look at me funny and told me that is what they are for and my lawyer would want part of my money I get form the VA, i guess they thought I was dumb and thought he would do it for free. I guess they did not think a Police Officer had a lawyer, I told them I have a lawyer of my own for legal advice and if something happens at work. Thanks for all the help and advise. Thanks Ken

I got my brown letter from the VA on Monday and got by Lumbar back raised from 20% to 40% and all other claims were denied giving me a total rating of 80%, the problem is I heard nothing about the audit on my effective dated on the claim on my ankles which should go back 4 years and hemorrhoids 1 year and 1/2 and IBS which should go back 2 years but was only paid back 1 year for all of them. Talked with my American legion Rep about the problem, he checked in to it and found out I had 2 claim going to the Board of Appeals one was the back, ankles, effective dates and plantar fascia and another for IBS and hemorrhoids which I new nothing about, I have 30% for IBS and 10% for hemorrhoids which is the most I can get for it, the VA told my rep I did not have a form 9 for the IBS and Hemorrhoids but they would let me do one even though it should have been turned in last year which I thought was odd, my old American Legion rep sent in the wrong paper work they said. My old Rep also told me to not get a video hearing because it would take to long and would be better if local office did it. Now they are giving me a video hearing even though I turned it down on the form 9 adv. by my American legion rep which I called one day to talk to and was gone really fast and was given another rep. I thought it was kinda odd for them to do this for me out of the kindness of their hearts. Ken

I just wanted to let everybody know heel spurs can causes ROM, everybody is different when it comes to pain and it also matters where the heel spur is on your heel and what ligament or tendon it is rubbing on. I broke both of my big toes in the military I was told I would not be able to walk until they healed, I walked the next day and went to work because I do not walk on my toes like everybody else, I am just saying everybody is different, so what one person has wrong with them can cause them not to be able to function and another person can have a normal life with the same problem. I am not trying to say anybody is wrong about what they are saying, just everybody is different, Make the VA say it is not service connected, don't do it yourself because the most you can give yourself is 0% and they can give you a lot more if you have the problem.   21. alphahec I think you should file a claim on plantar fasciitis it not the same as heel spurs, I have them both also, the plantar fasciitis can cause heel spurs, but you can have heel spurs with out having plantar fasciitis and it a different claim and if you get a % for the plantar fasciitis you would be doing better than the 0 % they gave you. I would also NOD the heel spurs and have them look at it again also see if the Doc will get you a MRI on the foot it will tell you what is really wrong with the foot. I was told all I had was a heel spur on my both feet and my Doc did a MRI and found I had heel spurs, had ligaments gone in both ankles, the Achilles in both ankle had torn a little and had repaired them self and I had plantar fasciitis in both feet, all I say is it never hurt to ask all they can say is no and they have to tell you why or I hope they would. Ken

Have to read the regulation on Surgical/convalescent pay, it has a lot of stipulations in it, like it has to be a major joint or in a cast. you should read it before you send it in and make sure you get everything on the form, they are picky about it. I had ankle surgery on the 6 of April and I sent all the paper work and the doc did to and they have not mad a decision on my clam. I hope every thing goes right on you claim. Ken

I march of 08 I submitted a claim on my ankles, IBS and 2 clams on my feet, the lost my file by July of 08, so I went up to their location and they found it under something did not say what, I also filed for a increase for my DDD on my back. In Jan of 09 they cam back with a decision on my ankle 20/20% and IBS 30%, but not on my back or the 2 claims on my back. I had surgery on my right ankle which service connected on April 6 09 and filed for 100% temp. I talked with my rep today and he said they made a decision on my back and feet but not on my temp 100% on my ankle, he told me the VA had a suspense date of July 25 09 for my temp 100% and it was sitting on the raters desk. The last note was the VA ask for records form the VA in April 09 and received the the 30 of April 09. I just wanted to know if this has happened to anyone else, or if anyone knew what this means.
