  2. wifeofvet,you said your husband was in Iraq,so that put him in a combat zone,now all you have to do is get your husband to talk about how he feared for his life during his tour of duty in Iraq in detail with his VA psychiatrist and if he pulled guard duty in a combat zone,i know he had to have fear for his life. This is how a inservice stressor is corroborate. In other words he can have ptsd and serve in a combat zone,but if he dont explain to his va psychiatrist that he was always feared for his life,because of the horror that he witness in Iraq,he will be denied. I know a lot of veterans dont like to talk about there combat experience,i didnt either,but that is what va want you to do.With new evidence and DDform 214 that show that he served in Iraq and newspaper clipping should be enough to prove that his ptsd was cause do to his combat experience. Hollis,this is just my guess and opinion.after reading some of your post,i see you had a C&P on 11/21/2011 for increase for service connected ptsd and when, schedule a C&P va uasually mail a "VCAA NOTICE TO RESPONSE LETTER" telling you what they have received from you and what they have done and the information they need from you,this must have been the letter they send you on 8/9/2011.So my question to you is,when did you get the call of letter from VA scheduling you for a C&P? also could you download your decision letter,so hadit can better help you.THANKS FOR YOUR SERVICE TO YOUR COUNTRY! mobie16r
  4. Like Berta,said go and get a copy of your C&P. IF you asked for a Increase for your Post Traumatic Stress Disorder,The things the C&P examiner need to know is how your PTSD (combat experience) effects your Occupational and Social Impairments and if you feel like your regular MHD dont seen to be concern about your ptsd,ask for another one

  6. midnight340,this is just my guess,you should be rated 100%,the examiner stated,you are total with chronic,severe symptom of ptsd and unemployable now and in the future and a gaf of 42.I believe you are good to go and if the examiner checked yes,capable of handling own funds for VA purpose,get your fishing pole out and and relax your mind because i believe you are going to have good day. This is my interpertation,you will be payed retro at the 100% rate for September, October,and November of 1994 because you was in convalescent for those Three months and you filed a claim in 2009 for the three months you was in convalescent so you will receive retro for three months at the 1994 pay scale rate and you will remain at 30%. mobie 16r

Ryguy a C&P is a compensation and penison exam and if you asked for a increase,these service connected medical issue was recorded on your progress health notes and you don't have to request a C&P,that is what VA do to to find out if your service connected diasbilities have worsen and in my opinion if your C&P examiner stated that your service connected disbilities have worsen,thats a good thing for a increase,because C&P examiner's carry a lot of weight. mobie 16r

  11. As for as i am concern your claim look good (mobie16r opinion),but if VA dont rate you unemployable,i would not hesitate to file a claim for sleep apnea,because it is documented in your SMR records about your sleep disorder and if you use a CPAP machine,50% rating.

I understand what you are saying Evandc,but remeber a GAF is only part of the equation,jokerwaswild is service connected for his lower back and on his C&P exam it is stated that he had insomnia and depression on his SMR records before and after his employment to desert storm and if the rater take underconsideration,the medical issue he had during his service,He/She could as likely as not rate him unemployable,because with his medical condition he would not be gainful employable. mobie
  13. Jokerwaswild, after i read your post in the C&P forum,that you are 20% service connected for lower back pain, i believe you will get the 100% individual unemployability,because it is all combat connected. mobie

  16. This is Just my opinion on your ptsd from what you wrote that was stated on your C&P,looks like a 30% or 50% rating JUST MY OPINION mobie16r
  17. Like i said before VA is not REQUIRED to give a C&P without the diagnosis of ptsd,"BUT" if he/she at the VA was looking out for the veteran,VA could have order a C&P. It all depent on who you dealing with.Now that you have been diagnose with POST TRAUMATIC STRESS DISORDER, you will get a rating if your combat experience is the reason you have ptsd.Don't know what precentage you will get,i don't thank you have a CUE. mobie16r

USMC,you dont have a CUE,Va did there job when they send you a letter asking for more evidence (VACC NOTICE RESPONSE LETTER).That was there duty letter to assist telling you what was needed to substantiate your claim, although you said you send in lay evidence from your flamily and friends but you didn't get a medical opinion from a Psychologist of Psychiatrist,You was Halfway home by having the combat action ribbon,that was your in-service stressor, but you did't have the diagnosis of ptsd and that was why va didnt give you a C&P.On that letter va tell you to send evidence as soon as possible and if we don't hear from you we may made a decision in 30 days,however you have up to one year from the date of this letter to submit the information and evidence necessary to support your claim and va go on to say if we decide your claim before one year from the date of this letter,you still have the remainder of the one-year period to submit additional information necessary to support your claim. This is how va cover themself from a CUE. I hope this help,good luck. mobie

I understand what you are saying pete,but you know as well as i do that we as veterans don't have any control over va,that's the reason we have to understand va rules, to be able to help our fellow veterans,to get what we all deserve.On the new rule the only thing change, is the instressor,for instant if you was vietnam veteran and, your mos was a cook,clerk, or mechanic and you seen a lot of enemy soldiers killed outside your camp and this cause you to have ptsd and you sumbit ,form 21-0781 (Statement in support of claim for service connection for Post-traumatic stress disorder) and you are a cook,clerk or mechainc,va could not vertiy your inservice,because va would say you was not a combat veteran and your claim will be denied , under the new rule if you was ln the area where the enemy soldiers was killed,va would vertify that you was in that area,this is where the do or doubt come in and when it is just as much postive as negative it goes to the veteran.If you been diagnose with ptsd,the VA psychiatrist,or psychologist have to corroborate your ptsd with your inservice stressor.   20. Larry post :Mobie, they have already turned in a claim, and been denied. They need to read their SOC and see WHY they have been denied. They say that they have been diagnosed with PTSD and have a verified stressor and yet were denied. The SOC will have to come up with a reason WHY. Then, and only then, can they righteously fight this thing. Gotta know your enemy before you can beat him, right? You right,you need to no your enemy,thats the reason we are here to help him win.To get service connected for ptsd you got to have three connection. (1) YOU GOT TO HAVE A DIAGNOSE OF PTSD (2) YOU GOT TO HAVE A VERTIFIBALE INSERVICE STRESSOR (3) THE REASON YOU SUFFER FROM PTSD (BECAUSE OF INSERVICE STRESSOR) (1)GridsmasherII been diagnose with ptsd (2)His inservice stressor been vertify The rater agree with his diagnose of ptsd and also his vertify stressor,if he would have stated how his inservice stressor(indetails) affected him in his daily life,He would get service connected for ptsd.What i said in a early post,you have to tell the C&P examiner everything about your inservice stressor and when his medical report is forward to the rater and he/she corroborate the three things together its a SLAM DUNK! My word

Bravo6 if you can prove that you was disable in 2008 because of your service connected disabilities and only your service connected disibilities,and corroborate by medical evidence from your medical provider you have a chance,but to be honest with you,and i am very sorry for the lost of your home during Hurricane katrina,but i don't see the va considering the lost of your home,because of hurricane katrina.I quote,you have to be total disable because of your service connected disabilities.mobie
  22. UPDATE: The veteran claim was granted,back to August 1 2006,the date he was medically retired.He wishes to thank everyone on hadit for there help,because there was a lot of input from the people at hadit to help in getting his claim granted. mobie16r
