  1. Draggin VA don't have enough information to vertify your Inservice Stressor. If you don't have a Combat Infantryman Badge (cib) Purple Heart of any medal to prove that you was in combat with the enemy. You will have to prove to va that you was in combat, or you came under rocket or mortars attack, someone you know that got killed, during the time you was there and this traumatic event has to be the reason you have PTSD, you have to give va a date withthan a 30 day period either way that these stressor happen.Va will send this information to US Army Joints Services Records Research center and the research center will try to vertify your stressor and send back to the VA the information they found out. mobie
  2. phillip i understand what you are saying, but he got to let the examiner no that the traumatic event that ocur in service cause his problems. If he is having nightmares, intrusive thoughts, avoidance and etc,and the traumatic event that happen to him while he was in service, this is ptsd, just have to be coroborate with inservice stressor mobie
  3. Gridsmasher11,your stressor was comfirmed, but when you had your C&P,the examiner reviewed your medical records and reported that although you have symptoms of ptsd, but no evidence of the traumatic event that ocur. When the rated receive your medical report from C&P examiner.he/she couldn't coroborate the traumatic event that happen to you inservice. In other words the traumatic event that happen to you while you was inservice, you have to be pretty specific, when you see your psychiatrist, psychologists,of C&P examiner, tell he/she exactly how that traumatic event that happen to you inservice make you feel, for example, you can't sleep, how you avoid situations,no friends and etc all because of the traumatic event (explain) that cause you to be this way. This should get you service connected for PTSD. mobie16r
  4. Anyone who have been sucessful in being granted Individual unemployability under 4.16B Extra scheduler, please post under this topic,it could be helpful to someone. mobie16r
  5. No Phillip,i have never worked for the VA although i have personaly helped a lot of veterans in my hometown and in the state i live in also Ga,fl,In,and OH.Maybe i was wrong for not posting 4.16B but my reason why i didn't post it is because of a veteran that did work for the va and i am going to quote his words about 4.16B Extra - scheduler and these are his words. Quote: I'm not saying that it isn't true, but they are extremely rare. I've been doing this for 35 years now, including 30 at VA, and I have yet to actually see an extra-schedular IU in person. I've heard of a couple, but never saw one. I worked at a fairly large Regional Office and not a single request for an extra-schedular IU was submitted to Washington during that entire time. An extra-schedular IU is probably the rarest of rare birds at VA. Like i say maybe i was wrong for not posting it,just seen like a waste of time,it take long enough as it is to get a claim granted. I really was just trying to be helpful, aren't that what hadit about? Mobie 16r !00% PT PTSD
  6. Sec. 4.16 Total disability ratings for compensation based on unemployability of the individual. (a) Total disability ratings for compensation may be assigned, where the schedular rating is less than total, when the disabled person is, in the judgment of the rating agency, unable to secure or follow a substantially gainful occupation as a result of service-connected disabilities: Provided That, if there is only one such disability, this disability shall be ratable at 60 percent or more, and that, if there are two or more disabilities, there shall be at least one disability ratable at 40 percent or more, and sufficient additional disability to bring the combined rating to 70 percent or more. For the above purpose of one 60 percent disability, or one 40 percent disability in combination, the following will be considered as one disability: (1) Disabilities of one or both upper extremities, or of one or both lower extremities, including the bilateral factor, if applicable, (2) disabilities resulting from common etiology or a single accident, (3) disabilities affecting a single body system, e.g. orthopedic, digestive, respiratory, cardiovascular-renal, neuropsychiatric, (4) multiple injuries incurred in action, or (5) multiple disabilities incurred as a prisoner of war. It is provided further that the existence or degree of nonservice-connected disabilities or previous unemployability status will be disregarded where the percentages referred to in this paragraph for the service-connected disability or disabilities are met and in the judgment of the rating agency such service-connected disabilities render the veteran unemployable. Marginal employment shall not be considered substantially gainful employment. For purposes of this section, marginal employment generally shall be deemed to exist when a veteran's earned annual income does not exceed the amount established by the U.S. Department of Commerce, Bureau of the Census, as the poverty threshold for one person. Marginal employment may also be held to exist, on a facts found basis (includes but is not limited to employment in a protected environment such as a family business or sheltered workshop), when earned annual income exceeds the poverty threshold. Consideration shall be given in all claims to the nature of the employment and the reason for termination. I hope this helps mobie

  16. You need a medical professional opinion from your doctor, and he/she need to explain in detail why your military disabilities, makes you unable to secure employment now and the future. Age dont matter; mobie16r
  17. You can go by release of information where you had c&p and have them send you copys of the results of your c&p. mobie16r
  18. I was rated from 30% to 100% TP without a c&p,but i submit plenty of evidence mobie16r
  19. To get payed a Temp 100% you have to be in the vamc for 21 days of more,i take it when you submit papers for a 100% Temp, the va schedule you up for a c&p to found out if your disability have worsen of got better. You wiil have to have a very good reason to cancel a c&p and if you do it will be re-schedule and if you dont go at all,it possible your rating can be reduced. If va determine that you are unemployable because of your military disabilities you could be rated 100%.My advice is make your schedule c&p appointment and hope for the best.Good luck mobie16r
  20. Hero there is a lot of information on line about the air show crash in Germany 1988, I also send you a private email mobie
  21. Signal, like i said before you shouldn't have a problem getting service connected for PTSD,I am 100% service connected for Posttraumatic stress dis-order myself and i hope this help what i am am posting below If you would like to see a general guide on how the GAF may correspond to ratings here it is:"The rule of thumb for the amounts the VA assigns for psychiatric disabilities is: GAF Percentage 0-40=100% 41-50=70% 51-60=50% 61-70=30% 71-80=10% 81-100=0% Raters may choose to ignore this, but it does give you a general idea of where you stand. What does the Axis mean on my C&P report? The AXIS I through AXIS V are your evaluation. The most important is AXIS I being the diagnosis, or what was found wrong, and AXIS V is the prognosis, or how it looks for future progress. Also you will find it says, "Competent for VA purposes," don't worry about that it's a good thing. It just means that you don't need to be locked up against your will, or "committed" as the doctors prefer saying. AXIS 1: MAJOR PSYCHIATRIC ILLNESSES, INCLUDING SUBSTANCE ABUSE. AXIS 2: PERSONALITY DISORDERS/FEATURES AXIS 3: PHYSICAL PROBLEMS (MEDICAL DIAGNOSIS-AS OPPOSED TO A PSYCH DIAGNOSIS) AXIS 4: PSYCHOSOCIAL STRESSORS (homeless, unemployment, marital conflict, etc.) AXIS 5: GLOBAL ASSESSMENT of FUNCTIONING SCALE, expressed as: none, mild, moderate, severe and then it'll have numbers listed to represent, eye movement, or non-eye contact, tearful, fearful, and these kinds of assessments. --------------------------------------------------------- XII. I filed the claim, received my C&P and the report. How long do I have to wait before I receive my decision? This, as always, depends on the backlog of cases at your regional VA office. The rule of thumb ,I say, is 3-6 months after your C&P exam if and only if the rating board has all the information they need. But remember, especially with PTSD, that it may take longer to hear a reply. Always keep in contact with your service rep for any updates. mobie16r
  22. Signal,i would like to thank you for the service to your country and also the blood you gave for your country. You have a purple heart and a CAB,you are good to go all you need now is the diagnose of ptsd,i see you been diagnose before and i don't thank you will have a problem with that. Now that i said that lets talk about how ptsd is rated,in increments,of 0%,10%,30%,50%,70%,100% in other words you don't get a higher rating because of cab and purple heart, its all about how bad your ptsd symtoms are. mobide16r
  23. If you was a Infantryman with the 1st Air Cav in NAM,you should have a Combat Infantryman Badge (CIB)and if you been diagnose with Post traumatic stress disorder (ptsd)you shouldn't have a problem getting service connected for Ptsd because the cib is a inservice stresssor. If your cib is not recorded on your DD Form 214,you need to apply at correction of Military records and get it updated. mobie
  24. Hello Brother Gate and Welcome Home. Was you a Infantryman with the 1st air cavalry, where was you located in Vietnam and the time frame? mobie
