  1. I will see about getting the IMO scanned and up on here either tonight or tomorrow. Today we requested a DRO hearing. Does this typically help turn the outcome to a positive one if the DRO has sent us a denial? How long should we expect to wait for a DRO hearing?
  2. Thank you so much Berta for taking the time to respond. Our lawyer did finally receive a statement of the case in which they denied our Independent Medical exam because they stated the Independent Medical Examiner did not state these issues were service connected. However, it is mentioned several times that they are and the real kicker is that the VA already service connected them(40%) we were just pushing for an increase. Our lawyer said we were denied "reconsideration" but we filled out paperwork for a DRO so the two of us are stressed and confused as to what the heck is going on. Does this mean we had the DRO review and they denied us and are sending us off to wait 5 years for a BVA hearing or that they denied our reconsideration and are now sending us off to the DRO? Our lawyer seems confused as well and considering he was a workman's comp judge for many years and has done several VA cases I don't think he is confused easily. I spent my weekend in tears over this. I can't get anyone on the phone or through email to help us. We've sent several inquiries through IRIS and never received a response. Finally I called the 1800 number and requested a supervisor call back. Finally a week later when they did call back they said they put in a request as to why no one sent us an email via IRIS. Then a week later we received an email stating they had received our email and were working on it but did not say where it was in the process at all.
  3. My husband, a Marine combat vet, was awarded 40% service connected. We appealed and requested a DRO review last September 2014. We hired a lawyer, had an extensive independent medical exam done proving he deserves a higher rating, and got all our evidence documented. We have heard nothing from the VA in a year's time until this past week when my husband's lawyer was faxed an I-9 form and nothing else. His lawyer was under the impression that this means we have lost our appeal at the DRO level as they are sending us the I-9 form to fill out to send us on to the BVA. My husband called the 1-800 number on two separate occasions this past Friday and asked two different reps why they sent us the I-9 form. One stated they needed it before the DRO review is done and the other said his review was complete but couldn't talk about it for 10 business days. So two entirely different answers. Gee thanks for the assistance. We are so confused at this point and so very discouraged as my husband is in pain daily and we have waited and waited with no correspondence at all. If anyone knows why they would fax our lawyer an I-9 form and can help us out it would be greatly appreciated. Does this mean we lost at the DRO level or do they just need this form before they complete the review for some reason? After all this with the VA I really feel for veterans. It's so unethical how our vets are treated.
