  2. States six months have passed, we have not completed reconsieration I thought if you were over 75 you got first service?? The state I can file suit or wait (their favorite) What sould I do?

Thanks, hope Berta chimes in, I do have the report the surgeon made describing every step but there are no times stated between events or actions nor amounts of blood loss etc etc in the report, seems fishy to me, during my surgery the surgeon accidently cut my jugular vein and I nearly bled out, resulting in my being in a coma for two months, considering the severeity of this messup, I would think that times, amounts etc etc would be of paramount importance (unless the times are horribly wrong or the blood loss too severe?) to protect against libality?? Actually the report sounds more like a madman with a hatchet was working on me by the amount of damage that was done? The "noted" surgeon wants to just throw me under the bus, and VA seems to be shielding him!

WHen the guy who wacked my jugular, wrote his description of the event, there were absolutely no mention of times between procedures, amount of blood loss, percentage of blood losss, etc. In this day of malpractice defense it would seem that these events should be noted to the second as to how the procedure progressed, as well as the percentage of blood loss and actual amount of loss and units of blood used to replenish? Thanks in advance for all input. Also the VA will not disclose the incident report, if any was made>>

  7. Since the bozos are playing hardball I think I will go on tour as " I survived UPMC and VA Pittsburgh Invasive Heart Surgey" complete with before and after photos. Maybe a counuslting service, I could even do a YouTube
  8. Weird stuff, I just pulled up the VA home page, then appeals, then link to customer service, then link to inspector general and got a "page not found"?
  9. Actually folks, my hopes are that the current guys in the White House will actually care about Veterans, rather then being just pawns for profit as the past administration did. Or is that thought beyond reason? http://www.cardiacsurgery.medicine.pitt.ed...2&pnavcat=2 the good doctor at the beginning of this fiasco was going to perform his "specialty" (minimually invasive) on me, sort of showing off type thing. My joke wzs that the only reason they noticed my blood loss was that their shoes were filling up.

I would chose to communicate "over" the lawyers, I have a letter from the VA attorney stating that the doctor (s) were not VA employees, in addition I was a "warm body" which they needed for their interns, which were taught by Dr Zenati, who seems to greatly value his public image. The young lady who repaired my artery made the statement that the artery was so badly mangled she had to sever it, then stretch it to repair it. So the initail mistaken laceration was the first mistake, the failure to discover the laceration until a severe blood loss occurred was the second mistake. I would think this would be a slam dunk in a court of law. I really had no chest pain or other sympthoms, just a pain in the leg occasionally, the did the heart valve tests in Altoona VA then again in Pittsburgh VA, why was that. Could I as a little added pressure compose a resume about my experiences with these folks get some before and after photos on some tee shirts, purchase a little Ad space in the Pittsburgh papers and lean on these folks a little? It seems their main concern upon recovery was brain damage, since one of their "testers" made the remark, "see you don't have brain damage", when in fact I had never mentioned that and at the time was asking about the loss of use of one arm!!

Hi Pete: Thanks for response: My initial email to the Dr was simply asking if he wanted to discuss this, why would he immediately forward it to his malpractice guy. seems this would not look good in a court setting presented to the folks in the jury? At no time did he show the least bit of concern to me or to my wife, my wife made the comment that he was an arrogant SOB. Wouldn't it be necessary in the beginning stages leading up to the operation for them to CLEARLY STATE that the Doctors involved would not be liable for any mishaps? Especially since I have severe hearing issues (VA supplied hearing aids both ears.. I emailed the OGC (tort) two times, no responce, is that normal?
  12. Strange behavior! I emailed Dr Zenati a day or two ago, asking if he wanted to discuss my VA case I supplied him with the Va case number he did reply stating that I must have the wrong email, my responce was "Hardly". a day or two passed and I got a cease and dissest email from a Malpractice lawyer with the Univercity Of Pittsburgh Medical Center?

I reviewed all the correspondence between myself and the VA including their attorney, I have followed their instructions as to how to file a claim to a "T" it is sort of laughable how they drag their feet and delay, I even had to forward copys of my med records to the VA attorney, when she was in the same building as the records, after I went through all that crap, she emailed me saying that she got them from the hospital. I filed a complaint with VA for their slowness, have copys of that also. I have safe copys of all correspondence in several computers and a in a seperate USB drive. I even have copys of emails where the atty says I have done the required forms correctly.

Letter states that the doctors are under contract with the VA for cardiac services, they are employees of the University Of Pittsburgh but they are not part of the federal government and its employees are not VA employees and are not covered by the Federal Tort Claims ACt. True of False. Thanks
  18. Thanks Pete, Should I email the doctors information to her and then send a traceable letter as Berta suggested, or not email her, just send the letter? Thanks again to all.
  19. Thanks Berta here is what is confusing, The letter is signed by the person under the signature it says "Staff Attorney" her emails say "From the office of Regional Attorney"
  20. Thanks Berta, should I email it then follow up with the traceabe letter, she is in the VA hospotial where the screwup occurred. Or should I just mail it certified return receipt?? Thanks a bunch
  21. Should I forward the information about the doctor being the Chief of Surgery at the VA hospital to the VA attorney who I have been in contact with?? Thanks in advance, Happy Veterans Day to all.

  23. Thanks Berta: The attorney I am dealing with is the one who sent a letter saying that the doctors were not VA employees, should I send her the information or the General Counsel in DC?
