  3. toddt, So if I'm understanding you correctly, 100% combined Schedular and/ or IU doesn't qualify for SMC's? You have to have ONE condition that's rated at 100%? Allan 2-2-0 HOOAH!

Morning folks, Correct me if I'm wrong: In order to be eligible for SMC's, you must have one condition, or combined conditions that are either 100% Schedular/IU..., AND..have other SC condition(s) that are totally separate from your 100% Schedular/IU that are at least rated at 60% or higher. Q. Can these other SC conditions stated above have a COMBINED rating of 60%+, or must EACH SC condition be 60%+? Thanks, Allan 2-2-0 HOOAH!
  5. broncovet, I did forget to mention that the veteran got retro this morning, and ran straight to his VSO with the questions about SMC(s) he was awarded. My thoughts: Geesh, you just got retro after this long of a struggle, wait a few more weeks for the Letter! Yes, do a "happy dance", but have patience as well! Allan 2-2-0 HOOAH!
  6. Veteran was just notified by his VSO that along with his 100% award, he was also awarded SMC-L.(He doesn't have his award letter yet). Are SMC(s) paid the month following the award, and is there "backpay" for SMC(s)? For whatever reason, the VSO didn't seem to know the answers to these questions Allan 2-2-0 HOOAH!
  7. Thanks brokensoldier244th, Her husband happens to be an RN, so a good candidate for a "layman's" statement in support of claim. I printed her a copy of the Sleep Apnea DBQ so she will know what to expect. Allan 2-2-0 HOOAH!

  9. Morning folks, A veteran friend of mine was just diagnosed by the VA with severe obstructive sleep apnea. She's TDIU with 90% scheduler, and has SC PTSD. So what are the steps, requirements, documents., to get her sleep apnea secondary SC to her PTSD? New claim? Supplemental Claim..? Thanks, Allan 2-2-0 HOOAH!

Berta, Though I only advise veterans based on their "honesty" about their situation(s), I too have come across these "wannabees" who, for whatever reason(s), seem to think that the VA should just give them a SC just because they served their 180+ days, and nothing else! Last summer I came across a veteran who blamed the fact that he served in the Airforce as HIS reason for being denied SC! After questioning the veteran about how he came to his conclusion of denial, he stated "Well, the VA only grants SC to Army and Marines because they are frontline troops, and have more rigorous assignments.." I looked at the veteran in dismay, and kindly reminded him that the VA's criteria for awarding SC is based on FACTS such as medical records, medical opinions, C&P exams.., and has nothing to do branch of service.., either you have documented medical conditions, or you don't. He didn't buy my explanation, and told me to "Go jump in the East River, head first.."! The audacity! I laughed and walked away. Laugh Berta, it was funny! Allan 2-2-0 HOOAH!
  11. @Berta, Yes I believe I have come came? across my first veteran I truly can't help. He came into the Airforce during a time when benefits were slim pickins; no hope for a nexus, no pension.. Today I will advise the veteran to go to a RO and ask for a Higher Level Review, and say a prayer or two. As usual Berta, thank you so much for the help you gave me in winning my case via CUE.   12. @john999, Unfortunately the veteran came in during a time -1960 when you had to have "boots on the ground" to be eligible for a pension. His Airforce tenure was 1960-1963. We tried that route and was shot down by the VA using the laws and regulations, which I researched and found to be true. Thanks, Allan 2-2-0 HOOAH!

Berta, Sadly this 82-year-old veteran has no record of arthritis during the one year period after discharge, and the earliest we can track his documented arthritis is 1994, many years AFTER his 1963 discharge from the Airforce. He is being treated by the VA for various illnesses, considering his VERY low income level, but he has no, not even zero, SC. Think it's worth a shot to get a Higher Level Review? Certainly, don't have anything to file a Supplemental. Allan 2-2-0 HOOAH!
  14. Good morning everyone, Got a veteran who is not SC, and was just denied SC for arthritis. Q. Considering arthritis is a presumptive condition, is the veteran required to show a Nexus to active duty? Veteran served from 1960-1963 if it matters, did not serve IN Vietnam or any war zone. Even though his denial letter addresses arthritis being presumptive, it's vague about the requirement to show a connection. Veteran's active-duty medical records show NO indication of arthritis. Q2. Send it in for Higher Level Review? Thanks, Allan 2-2-0 HOOAH!

  16. @Mr cue, Totally agree! Even with the "Three Step" process used when veterans have 20K+ retro coming to them, which should take 4 months max.., a year is just ridiculous! Allan 2-2-0 HOOAH!
  17. @Sweetie, Appeals decisions can take awhile. Did you ask your attorney for a timeline? Allan 2-2-0 HOOAH!

The "240%" was used to give broncovet a clear picture on the various and numerous conditions the veteran has SC as it associates with possible SMC implications, and wasn't meant as a rant or rave, or bragging about "who's got the most SC conditions" I never come in here bragging, I'm here to gain knowledge and to get assistance. Allan 2-2-0 HOOAH!
  19. broncovet, We still have to get the veteran's TDIU decision from 2017; as I mentioned earlier, her decision paperwork burned up in a fire. We are going to a VSO today or Monday to see if we can get BOTH copies of her TDIU and her newest 100% SC decision. She-veteran has at least 20 SC conditions listed as of now, but which ones were used for TDIU, we don't know at this point. She has a wide hodgepodge of SC conditions ranging from spinal problems, bladder problems, hearing, knees, shoulders... In our math, which we all know the VA doesn't use, her total combined SC conditions add up to 240%. Allan 2-2-0 HOOAH!
  20. @broncovet, We don't actually have the decision itself in hand, she -veteran, saw she had won her 100% SC on her Ebenefits page. A few others here suggested we go to a VSO and request a printed copy of the decision instead of waiting MONTHS to get it in the mail. As far as "applying" for SMC(s) if needed, what VA form is used? Allan 2-2-0 HOOAH!
  21. Thanks brokensoldier. Another question: Does the VA usually use ALL the medical conditions when awarding TDIU? She-veteran has probably 20 conditions ranging from back issues, hearing, knees.... Allan 2-2-0 HOOAH!
  22. Morning folks, Hope everyone had a safe and fun holiday season. So, after about 5 years of fighting I was finally able to help a veteran get 100% disability-100% schedular. She previously was TDIU with 90% Schedular, and at this point we are not sure what disabilities the VA used to get her TDIU(her past written decisions were lost in a fire). Questions: Does 100% Schedular automatically come with SMC(s)? Yes, I know the criteria, have to have other conditions not associated with the 100%, has to be 60% or more.... Other than waiting months and months to get a copy her PAPER TDIU ratings, how can we determine what conditions were used to get to that TDIU? Example: Lower back problems, tinnitus, GERD... IF her 100% Schedular letter doesn't include SMC(s), then how do we apply for them? Thanks, Allan 2-2-0 HOOAH!
  23. @GBArmy, Um this isn't a BVA claim, For myself, my pending is a secondary claim awarded due to misconduct stemming from a previous C&P exam. The veteran I speak of, this is his FIRST claim. Allan 2-2-0 HOOAH!
  24. GBArmy, We did request that the veteran be advanced due to his age and terminal conditions. We applied for SC on September 17th, 2021, and haven't heard anything yet. Considering he's over 80 years old, think a C&P exam will even be used? Thanks, Allan 2-2-0 HOOAH!
  25. Yes, we requested his case be expedited due to his age, as well as terminal illnesses such as COPD.. Sadly, this is his first claim! He came in during that "grey" period between 1960-1963 that doesn't qualify him for a pension, which was denied. I would be willing to bet, without getting his hopes up, that even though he doesn't have a NEXUS for any of his claims(arthritis is a gimmie), he will get 100% for his terminal conditions thanks to that St Louis fire. Like you wisely say "Wait for the decision.." Allan 2-2-0 HOOAH!
