  1. Asknod. I have all the VBMS records and I have been assured that. Of course I don’t believe that for one second. I have never been told the truth and can practically prove it, with a few minor exceptions. I’m going public and pleading for a law firm to come forward and represent me with a simple statement of documented facts. I am fortunate that I can still get around, but I have many issues and anyone of them could do me in, so I am as careful as I can be. Move carefully, try to keep balance and not fall and break a hip bone or over exert because at times I get winded when at rest. Everything involving “ physical capacity and stamina “ bothers me, just like documented in Vietnam. I had a P-3 Profile for a reason. The VA is hiding the conditions I developed in the following six to seven months after my return to CONUS. The records are locked away, secured, and separated from the rest in anticipation of litigation. The VA has been expecting a law suit for decades, but I couldn’t get any medical records. I now have enough for an investigation into finding the rest. I want to show they knew I had a stroke and brain damage from encephalitis while on duty. The VA says I didn’t complain and that’s 100% false. Why wasn’t GAS with Pharyngitis treated when I didn’t get better! What did they do for the undetermined organisms in the blood and lungs? I was told I had dry skin so deal by the VA, and that is supposed to explain all the conditions? It’s pure corruption is what it is. Vets with PTSD also have brain damage, and had malaria damaging everything in their body to some degree. I deserve some serious reconsideration that the St. Louis VARO has covered up or locked away and to think the records were lost is absurd when a SM is medivac’d out with permanent medical conditions. No one would believe they were lost when they are continuously needed for reference for any possible future treatment. They figure we are dumber than anyone should be. This was wrong in 1971 and more wrong today than ever. I appreciate all your information and advice, and hopefully my emails get seen by someone with some authority. I am sending the President some documents and explanation of what been going on with the deception from the VA over this last 47 years, and my luck with examiners in my case. Thank you Alex.   2. Asknod. Hey my friend, I did not mean anything personal and that you are not more brilliant than Most attorneys. I just meant that this is so messy, goes back so far, and involves more than I can say here. I don’t question your ability at all, but this is deep and not a matter of claims, but a matter of correcting my discharge, dependents retro benefits, my retro benefits, and then settling the other issues of making this right. I am not ruling anything out yet though. Basically, I really got screwed over and over and over and then over and over again. Despite my dozens of requests in the first 45 years, there were no medical records because they were lost in June 1971 in transit from Vietnam and were not found until 2015. I can’t explain how many stories I was told about the progress of my records being gathered, the times they were sent out and never arrived. Of course it was all phony. I got what I was supposed to get, nothing less, nothing more. I have been snookered the last four plus years, and the plan is to continue the deception til I am dead, so I need to get this going with my family members on all the legal work. DAV snaps it’s fingers and gets Vets claims resolved with decades of retro pay completed in less than a week, but my crap takes more than a natural life time? I don’t think there is anything normal about this process. I wish it was easy, but I don’t think the VA would hide all this and suddenly treat me fairly. They want this, and I don’t care anymore because I will never see the end anyway. They have made it clear that I was never supposed to see the resolution complete. My dependents were never meant to receive their compensation. Could you fix all that? Thank you asknod! victor rayRay
  3. Buck. Thanks for everything, and I wish you all the best too. It’s a shame the VA makes you despise them before they do what they are supposed to do. I gave it 12 years before filing, and only did then because I never got well. The VA still would not respond with any medical records and I have the request from 1972 and again in 1983. They are going to the President next week because the VA is going to do nothing on their own. I go to the Media next week too, but I need to get a few things in proper order showing the VA saying I never complained while I was hospitalized a month in Vietnam from AO Exposure and Malaria. I’ll let you know how it goes and when I hear from our great president Trump. I believe in him and him in us. I will give a good explanation of the VA’s treatment over the last 47+ years, and I’m naming names, dates, and departments, and hopefully some heads will roll because they are not there for us, but are against us even being there. They need to be removed beginning with Mr. Mitzie Marsh in St. Louis. Take care victor ray
  4. Buck, Thank you. I need to do something because this is like criminal stuff. It’s more than medical malpractice because they knew I became ill in Vietnam and knew I deteriorated all the time because of a devastated immune system. They finally awarded “ Atopic Dermatitis “ which has been pointed out for decades and in the record, but just maintain it was over looked. I don’t think the VA has changed in many ways, but sometimes I am shocked. Girls are claiming rape in Basic Training, AIT, and getting benefits, and don’t need a witness, or need to know the offender. I read a lot of stories of unbelievable reasons some people are allowed VA disability, and it convinces me that it’s who you know, not your disability. DAV, in one week or less got a guy service connected and retro pay for 12 years, but they threw my claim in the trash. I smell corruption there. I have less than 60 days to do something, so I have to act. I will be sending out some emails to lawyers, to see what we can do.   5. Broncovet Thanks again. I knew that they did settle a lot of times, and I probably would too, but considering they withheld the evidence I needed for filing any claim, and that ridiculous medical board they sprung on me, without notice, without know any options and having any legal assistance manipulated me and pulled me into their web. I believe I had high levels of AO and it showed in my blood, and being that the VA was already saying that Agent Orange was harmless to anything other than plants, my conditions would have contradicted their claims, so it had to be suppressed. I know they are making crap up to discourage me, using up time that I don’t have, and hoping I would just go away one way or another. I had to have a tooth pulled because I could feel the jaw getting sensitive. A chunk of bone came out with it because of the degenerative bone disease. All I need is a fall and it’s over if something breaks. It won’t heal. The VA knows my conditions are real. I had bone pain in my legs begin in Vietnam that was terrible and it’s bone degeneration since RVN. I had severe nausea and abdominal pain and liver abnormalities in Vietnam, and had 24 tumors removed and have NALD, non alcoholic liver disease or steatosis. I had a stroke on duty at 19/20, suffered Migraines, and have age-indeterminate lesions several places. I have documented chronic Respiratory problems on duty after RVN and today. I was urinating blood in the hospital Vietnam, and the limbs were swollen, blisters on hands, other oozing lesions, covered in mosquito bites. I had the P-3 Profile mainly for the heart, but they did not give me the “ OVER 120 DAYS RECOVERY TIME “ our RVN doctors ordered. I complained about feeling shocked in my arms everytime I reach for a door knob, legs tingling and I know it is peripheral neuropathy or polyneuropathy. It affect bladder control too. I complained about feeling movement in my eyes and have damage to the back of one or both and they know it. I ignore the kidney pain when I can, but it’s getting worse. I can’t be in the sun but a minute or two. I could go on and on, but no need to. All vets with PTSD should demand an MRI looking for brain damage and post it here.   7. Broncovet. thank you for your advice, but I have done a lot of this and can’t handle it anymore. I had a Tropical Disease on top of any Agent Orange Exposure that affected my heart and every organ and body system. They knew this but withheld it from me, my doctors, and my family. They lied about my records while I was on duty. The P3 Permanent Profile was for my heart, my lungs, my brain, my liver, everything and I submitted current evidence as well as what the NARA would let me have, and their reply was “you did not complain in the service”. They also said “ you were not treated for and was not diagnosed for any condition while in the service”. They said so many lies it’s hard to be polite, so I will let lawyers do my talking as I would not be very happy, thinking this could be the schmuck that lied in the first place. “Undetermined Organisms “??? What the hell is that? “ “Unspecified Urticaria” ??? What would cause that? What affected my heart, lungs, all the other organs for years and years? I have a two foot high stack of records I am taking to some lawyers because the VA won’t talk to me straight. They assigned a lady to me to use up my life, hoping I would die before now, so 100k is peanuts. It would have meant something at one time but they have done me too dirty too long. Please close this thread, and thank you very kindly for the help, but asknod probably wouldn’t want this mess. It’s going to take a team to fix this, and get the truth out.
  8. Buck Thanks for the info and for staying in touch with me for so long. I do have one option left and that is the courts, and then that will be final I take it. I can’t get my records myself, and I can’t prove anything without them, so I have no choice but to sue for the records, then sue for the compensation and benefits that’s been withheld, and if the VA would have done the right thing, my kids would have been receiving medical through the VA and their own entitled monthly compensation because of my disabilities. This really has been a case where they have been waiting me out, and I am stroke prone now with such a high calcium score, and lucky to still be here. Nobody knows when their time is up, but it’s not right having to live feeling like the end is the next panic attack, or chest pain, or blood pressure hitting 230/110 again and again with all the other crap. It’s one thing to be concerned about your heart condition, or blood pressure, or cancer metastasizing some other place, but to have this many for so long when they all started in Vietnam, never being given a believable reason for any of the conditions, and being denied access to all medical records smells of something very wrong. I cant put all the details here, but you can see in them how my conditions worsened, but me not having any reaction to the Chloroquine treatments, and after three weeks of treatments the “skin disease “ was actually clearing up. I was treated in the infectious disease ward in Chicago until I was sent “ HOME AWAITING ORDERS “, and I learned that that term is only used when a service member is to be medically separated or medically discharged. In my own opinion, I had malaria because of the coma from cerebral malaria one year after being hospitalized in Vietnam. I had a stroke on duty and suffered migraine headaches and have records of cerebral infarction and basal ganglia infarction with a 13cm x 5cm hypodensity. the Army knew my heart was affected in Vietnam, but hid it all these years. They need to pay BIGTIME.
  9. Bronchovet, I have tried them all pretty much, teenager, young adult, and old man. NPRCx12, NARAx4, VAx6 at least, RMCx3, VSOs x3, Even Vietnam Vet and Ranking Member xxxxxxxx Blumenthal x1, who then referred me to Senator Claire McCaskille x 2+, and none of them can acquire my medical records. Yes, it is my healt conditions and retro benefits I will sue for. I was deceived and done dirty since June 1971, and the records of the stroke and parasites from then would possibly have more likely than not contributed to my lung conditions, brain hypodense, incontinence, bone deterioration, heard disease, malignant skin cancers, the acne/Chloracne, liver damage, blood coagulation disease, esophagus issues, artery occlusion, peripheral neuropathy, renal pains, the painful enlarged prostate, the respiratory problems, the dozens of abdominal tumors they have removed, and the eye damage from parasites. I have some of those after 45 years of the records being denied up tp 2015 when I was service connected. Another condition was granted by the BVA last August, “Atopic Dermatitis” after they denied it since 1983, but of course it was at 0%, but of course!!! Why wouldn’t it be? Retropay maybe? I want them to eat it for lying and deceiving me and withholding the evidence all my life. I am done with the lies and bull if it takes me putting it all out there, then so be it. They are liars and deceivers, picking and choosing who is service connected, and if it refers to actually being contaminated, you are buried in unnecessary forms and paper work. I have a permanent P-3 Profile signed by FOUR Medical Officers, made non-deployable on a world wide scale, permanent defects in my “ “physical capacity and stamina “ , documented skin disease with unspecified cause, medivac’d out of Vietnam “because of the disease” after Chloroquine treatment and being hospitalized 21 days in Vietnam, spent another week in the infectious disease ward, sent “HOME AWAITING ORDERS “, taken to a surprise second medical board without any notice, without knowing the reason, without any records, without any advice or legal assistance, without knowing there were options available, had Migraines, suffered stroke at 19/20 yrs old, pain in and behind eyes, soaking night sweats, excruciating itchy skin from inflammation, swollen limbs, urinating blood in Vietnam and six months later again, rehodpitalized with “undetermined organisms” causing repeated Upper Respiratory Infections, developed Group A Streptococcus with Pharyngitis turning to Rheumatic Fever because they didn’t properly treat it. I believe I had Staphylococcal infection from the parasites too, but tested positive for GAS w/Pharyngitis. These doctors seem to have just said “oh, I see he has Undetermined Organisms in his blood and by the way, they are in his lungs too. No wonder he’s feverish. Lunch time, good deal.” They left it at that? Several months after discharge, I was in a comatose state after treatment at our local ER with 106+ fever, convulsions/seizure and multiple ice baths in 1972 and again in 1980/81, but my wife did the same the second time, but I was delirious eight days that time. In 1984 and 1991 there was similar situations. I never had a skin condition, or any of these before RVN, but I never recovered, and have been deceived ever since. The VA denied any connection from my Vietnam service and medical conditions even though they nearly me. They were content to let me die without hesitation and are only honest when forced. Shameless, corrupt, and own most everything and everyone government connected. They did me dirty. victor ray

Berta Yes, I did ask NARA for any and all medical records,records, reports, and they did send about 42 records which were for just the 21 days I was hospitalized before being evacuated to Yokota Airbase Hospital in Japan for further testing. No test results from Japan, and no records for 6 or 7 months immediately after my return. I believe I had a stroke in that period and had been suffering terrible with killer migraine headaches, confusion, delirium, and I had parasites in my eyes. That’s probably the undetermined organisms they found in my lungs and blood. They are such liars, and I think this is way over my head, and need to turn it over to legal minds. The BVA is the same way and lie for the VA. It’s all part of the establishment that President Trump is fighting, and the BVA holdovers are ignorant or didn’t see the records. It should be Board of VA Attorneys. It’s hard to respect any board you believe to be biased, and I believe completely that they are. Most all lawyers do too and just look at the number of derogatory rulings and court proceedings and it’s pretty easy to see. Too bad I won’t be here to see the results, and I can only hope my survivors pick it up and squeeze a little Honor and Decency out of the VA, if that is possible, because they won’t do the right thing unless they are forced.   11. Berta, Thank you. That’s a lot of good information and I wish I was more able to dig like you can, but I am worn out. I am physically tired and mentally exhausted and in my case, it’s as though every agency has my name high lighted when I call or write, saying “Lie to this guy”. I’m going to send my stuff to an attorney and ask him to sue for everything we can, and he will know. As far as deadlines, I tried to stay timely, but in some cases all I got was we sent you everything,. They told me that 15 times before I got a single medical records from Vietnam, then I got like 42 records they had been sitting on. They are doing the same thing now, and I have a request in, but expect nothing but lies. The VA is full of lazy evil people running it and I have no respect for any jerk there, well, maybe a few, but some are so lazy, that moving their lips is a chore, and I don’t have enough life left to wait on their answers. my case is different than most, because they were hiding the evidence while I was still on active duty, ignoring the permanent profile, and pretending my records were lost. They withheld them in 1983 as well, and I didn’t get one medical record until 2015. I, by myself, can not even get pay records, morning reports, nothing. Nothing that puts me in a particular place at a particular time, and I believe because of the experimental nature, I will never get them, except through an attorney defending the United States in a malpractice suit. thanks for the info though Berta.   12. Can I sue the VA multiple times, like for each condition they have lied about and withheld evidence of existing, but denied knowledge of. Like knowing I had a Blood Disease but not admitting the parasites origin was malaria from Vietnam. That by not treating the Group A Streptococcus with Pharyngitis it turned into Scarlet or Rheumatic Fever causing many organs to be affected. Or the skin disease and acne was Agent Orange, not dry skin? Or the Migraine Headaches, stroke, and brain damage at 19/20 years old, were because of service in Vietnam causing carotid artery occlusion from rapid cell death? The VA has made this drag out, deceiving me my entire adult life by withholding all evidence, all medical treatment records, and all medical care. I have to assume to deprive vets the knowledge of others with their same conditions, and prevent them from filing any claims like it did me. PTSD in a lot of cases, if not most cases, is due to malaria or some other parasitic infestation causing rapid cell death and physical damage to most all organs, especially the brain. This has all been a complete crock of crap, and I want to sue on individual events if I can, or will they all be lumped together? Then my kids will have their turn. It’s a mess of lies and deception and I thought the BVA would look at the evidence presented and it would be enough, but no. I have to sue to get those still being withheld for the immediate six months after my being medivac’d out. All this was done to use up my life time it seems like, and with the Vietnamese people watching the claims, it feels it has to keep lying and covering up. I guess I answered myself basically.   13. Wayne TX. Hey, if you’re comfortable with it and don’t mind giving up what you have already invested then go for it. I probably would too if I only had a short time invested but the VA has screwed me around by lying, cheating,manipulating records, hiding the records and all evidence for 47 years, completely avoiding the agent orange issues that caused them to evacuate me out of Vietnam. Most of my time was spent in the hospital and they say I didn’t even complain, so it’s impossible for me to lay down and let this go. Young guys just now getting discharged and old guys just now having a problem should probably go this way. My medical care was refused by the VA and all service connection since 1983 and they were completely in the wrong. The VA is still withholding my records. Why would they? I will see in the next month or so what my rating is, if it changed, or if legal action is required. I would use it for new claims, and it just depends what you don’t mind giving up. You gave up two years or what ever time you’ve been waiting, but heck, that disability may kill you tomorrow. good luck brother...Victor Ray
  14. Yeah, I heard enough. They have reworded the process calling it lanes, and eliminated any process that benefits the veteran, kind of smiling at you while they twist the knife in your back. The VA is as trustworthy as ISIS, but just slower. They are corrupt, deceitful, and manipulative, destroying or hiding evidence and I am sympathetic to those that believe in the VA judges to. The BVA is just as corrupt as any organization, maybe worse. These are just words and a waste of paper because nothing is enforced. The old system was good enough, but the law was misinterpreted and misused to uphold one goal, deny the truth. This backlog is self made and unnecessary; all these appeals are due to corrupt raters kissing the rear end of higher up corrupt officials overseeing the disbursement of benefits, and the judges pervert the law in favor of the government in most cases. The most corrupt VARO has to be St. Louis, home of the records centers. They hide the evidence when told to and release it when told to. They are biased and corrupt, another way of calling them liars. I have 0 respect for the person running it too. I guess I despise the VA for its lies and deception, and hiding the evidence concerning the phony medical board and lying about my records being lost and withholding results from Japan and six months after my return, and the refusal to treat me after issuing the P3 on DA3349. It knew I was forever screwed and made me get by without acknowledgement of those conditions being incurred in Vietnam. I don’t trust anything they do. Nothing. I don’t need any response, I just wanted to give my opinion of the way the VA thinks.
  15. PS. Agent Orange was one of if not the biggest cover up in American History. I was sacrificed because I was a documented case. The DoD is still withholding my evidence of stroke, brain damage, Rheumatic Fever, Permanent blood and organ damage documented by a Permanent level 3 Profile, but they all lie and ignore its existence. Don’t wait on the liars like I did. I didn’t file within one year, so they say it’s old age now. In 1983 they just said my Evacuation wasn’t service Connected, neither was the exposure, malaria, the lung damage, the brain damage, the liver, the intestines. They have the proof, but they are all liars and deceivers here to deceive you. If you are dealing with St. Louis, you have my utmost sympathy. They will screw you when the VSO’s are done. Never use DAV or VFW in St. Louis. Again, GOOD LUCK.
  16. What I have found is that the VA has the most dishonest employees on earth working in the VBA department. They think nothing of perverting the facts, destroying evidence, withholding your records, and causing the murder by suicides of thousands of vets every day. They lie and deceive a vet they have wronged or owe a large settlement. I just had everything denied except “hives” after being medivac’d out of Vietnam with a skin disease 47 years ago. 47 freaking years they lied, and the BVA, the “Board” itself in on the deception, the masters of deception. I have 0 respect for the VA. None. Everything they do is deceptive, and designed to benefit the government, NOT YOU. Every change is dreamed up by a moma’s college boy that is a professional kiss *ss, and will one day run the VA. Call the White House hot line because they are screwing you. Call them immediately. 1-855-948-2311. They have screwed you for 4 months already, after the 30day guarantee. Imagine having 2 or 3 years of waiting then going with RAMP. It’s all thrown away.   17. Martell, i believe the RAMP is good for new or recently filed claims, but no everyone is eligible. I take it you must have a certified appeal on the docket before the BVA to qualify. I just got there and it’s taken four years. Also, you can not submit new evidence and you can’t go back. You keeping your effective is a shady statement at best. What effective date? It sounds like you keep that one you filed 7 years ago or what ever, but i’ll Bet you anything that that effective date is the new one you get for signing up for the RAMP Process, not the one you had for years. Thats my take on it and the call center don’t even know the facts. NO WAY, would I agree because I was lied to 47 years ago, deceived all that time, so distrust is ingrained in my blood and damaged brain. I would rather die and my kids pick up where I leave off, and each one file a suit, for each condition, in separate cases, and include hundreds of others in a class action suit. I’m hoping I am close, but I won’t wait years. Lawyers can work it out together and make an offer or go to trial. Thanks for the reply. victor ray
  18. Me too Buck. I’m not waiting long either and shouldn’t be waiting now, and wouldn’t be if I had not been deceived in 1971. It was dirty on the VAs part, but now that it’s in front of the judge I will give them a bit and think it is moving. No, I don’t have the years to wait, and supposedly advanced, so I am going to call Washington to see if I can get some information on it. I really think something may be done soon, or it won’t. If it’s not, I will go public and have a law firm, or several of them, help me out, along with the press. I am anxious to see what the VA considers honest, and soon too.

I hope they come around, and I hope they do have the missing records to review, but from what I understand, the only way I can possibly see them is through a malpractice lawsuit. I think the would have to use them in order for a fair judgement. If they don’t use them as evidence, then I am getting the shaft and will call to see where this can go.   20. Buck. Yes, I was well over the 30% needed to qualify for 100% retirement because I was 100%. They knew, and I believed in them, that they would not lie to me. I never thought the VA was deceptive, but I was young and gullible. glad you finally got 100% and SMC K . I FILED FOR E.D. and developed a painful enlarged prostate about 6 months after returning, and am still taken meds for hyperplasia. They documented it in 1972 but denied it as being service connected aft being medivac’d out of Vietnam. the Army lied about my records in 1972, but I filed in 1983, and still couldn’t get any medical records, nothing until 2015. Twenty or so FOIA REQUESTS got nothing, but finally in 2015 a phone call got some of them from hospitalizations in RVN. Enough to prove boots on ground. I’ve inched my way along, but I hope the judge is straight at BVA,,
  21. I looked up the car 4.16 Buck, and mebeing 70% PTSD and 30% CAD, should have qualified me, but other issues that were more than 30% were hidden while I was still on duty. If you looked up the conditions that the “P” in P U L H E S covers, I had all of them, except the female issues of course, and never recovered from them. I should have been a P4, but they left themselves some wiggle room to not pissoff their superiors I guess, or just didn’t realize the depth of the permanent injuries. They knew they were permanent, and bad, just not how bad, at the moment. They realized later, probably as more results of deterioration developed. Hiding the evidence cost me a lifetime of anguish, and I hope it’s made right. That CFR was helpful. T You victor ray
  22. Buck. The VA has just been screwing me over as well as my dependents because I was a documented case, but just haven’t died yet. I don’t feel from it, but thankfully I am still here. I think they know now that I finally have enough evidence to prove most all of my claims, at least enough to prove 100% service connection, but the VA still don’t want some of the conditions connected to Vietnam. I had a stroke at 19 years old, brain damage, abdominal tumors by the dozens, Chloracne, skin rashes, liver problems, kidney problems, peripheral neuropathy, and so many other things including Agent Orange being used every place I set foot, but because of Agent Orange being hidden from the public, I had to be denied and all the traces of evidence hidden as well. Enough is known now that it can’t hardly be denied, but the raters in St Louis(Monsanto’s City), are hard at work lying about Agent Orange and it’s connection to even those presumptive conditions that are now proven. They still insist they are only presumptive, but these raters are the most dishonest spineless people in the VA. Washington DC hopefully has much more intelligent people than the Regional Offices. I do have 2 appeals pending and they will determine what happens in the future, but I am just thankful that I am still mobile. I understand their math, but not their reasoning, or how they can see the evidence yet say it isn’t so. It’s unforgivable that a rater can see it in their face and deny it. They should not have that job or authority. I’m looking forward to honest judges, and at some point the law will show that it’s the male that caries the determining factors in offspring dna damage and disabilities.   23. Buck. i have an appeal that is supposedly before a Veterans (VA) Law Judge, but take that anyway you want, but not with more than a grain of salt. The VFW snickers and says he has now idea how long this could take, another week, a month, a year or three, or ten years. I had 200k ahead of me and asked for an advance on the docket, they granted it due to my age, conditions, and waiting 47 years for the records I have been deprived of. Then I called the VFW and he said it hasn’t changed and (snicker) you just have to wait your turn like everybody else. Now this is St. Louis, the most powerful and most corrupt of all VAROs. They manipulate everything they want in their favor. A few more days will determine when I go public. Thanks Buck. victor ray
  24. Buck. I qualified for disability from the time I was 19. I was 100% by law even then, but the VA is corrupt. They ignore what they want and lie about the rest. I am now over 55, (67) i have the same permanent disabilities I developed in Vietnam and some have worsened, but none are likely to improve. it’s been over eight years without substantial improvement, actually worsened. i am at 90% now, one at 70%, one at 30%, three at 10%. That’s not good enough for IU. The VA is putting it to me like they always have, hiding the evidence. Thanks victor
  25. Buck. I’m no authority either, but there are 3 lanes added to chose from, the higher level, the supplemental claims level, the appeal level in Feb 2019. You have a limited time to submit evidence to the lower two. You can not submit new evidence to the higher level, and you can never go back. The VA puts out two or three letters on the same subject, but all different. I remember reading that you have to give up your right to reopen a claim, as you can with the traditional. this says you have a “POTENTIALLY “ faster & earlier resolution. Maybe yes+maybe no. the same “POTENTIAL “ effective date. It is possible, but you know how the VA moves your effective dates to the most current date possible every chance. I’m the same way Buck. I have thousands of papers and envelopes and letters and boxes full of correspondence and threw away the other part to this letter I guess. This I know, you will not be allowed to submit new evidence, you will not be able to go back to traditional, you lose the “duty to assist from the VA”, in the higher level, and AFTER you receive a decision from the higher level you have another year to review your decision notice. Personally, all this in my opinion is only a stall and delay tactic. The backlog is purposely created. It’s all phony. My claims have been looked at by lawyers for the VA from DAV and VFW, and from Georgia, to Nebraska to Missouri to Texas, and back. It a game amongst the raters and supervisors to “kick the claim” like we did the can. I know what I read and then tossed, because it was a big ripoff. Good luck to anyone using it. Remember, I was non deployable, issued a Permanent level 3 Profile for permanent limitations, a disability in itself, was medivac’d out of Vietnam for conditions with “Cause Unknown” unknown,!!! Lungs infected by “Unknown Organisms” after Vietnam. They are “Withholding information “. Why? Why would they withhold any information from the time I arrived back here to th present time? What reason could they possibly have? Because it proves Agent Orange causes Brain Damage and strokes as others have claimed. It opens up another can of worms the VA doesn’t want known, because autistic children, slow learners, mentally handicapped, physically deformed and two and Fifty other conditions are also covered up and records like mine are the key to new suit. If the gowill lie about the records while I am still on duty, and 12 years later, and 40 years later, and finally cough some up 45 years later, but tell me the others are locked away in anticipation of litigation, something is terribly rotten in that organization. They are hiding the facts that many PTSD rated vets had diseases that went untreated, like malaria, filariasis, liver flukes, and other parasitic diseases the military didn’t even know about. These young doctors didn’t know what arsenic would do to a person, let alone Dioxin that they had never heard of, so it had to be allergies. That’s their story anyway, and they are sticking to it. I wish they were looking for more records Buck, but they are altering existing records if anything. They have always had them and always lied about them, period. They enjoy pushing and bullying the vet, “abusing their power”, and in my case, because I was a bonified Exposure case survivor (so far, but it getting scary now). The VA denied every claim I filed, even though I was hospitalized a number of times saying “You never complained in the service, you were never diagnosed nor treated for any conditions, and these conditions were neither incurred in service nor aggravated by your service. Claim Denied. My documented medical treatment records say that’s a lie. Anyone can try what works for them, but I know how they have lied and manipulated me. That’s what I know
