  1. I think you are exactly right. The VA refused to treat me because I wasn’t service Connected. It refused to service connect me even though I had a P-3 (PERMANENT) profile. It refused to give me the medical records in 1972, 1983, 2018, except for “some” hospital records in Vietnam. My calcium score was a thousand 4 years ago. This has been a farce and an experimental joke on me. I’ll see what what happens, and go from there. Thank you! victor
  2. Gastone. I have just briefly spoken to a couple lawyers, because the want $150 from me to see if they want to represent me. I may go that route at some point. where I lived when I discharged was three to four hours to the nearest VAMC and I had insurance. I did not have any medical records at discharge because they were supposedly lost. The treatment records by private doctors and hospitals are not kept longer than 5 an 10 years, so no, I have none, and the VA refused to service connect me in 1983, gave no records at discharge. YES, IT should be a given, and I should have been 100% directly service Connected, and it pisses me off that I was denied and manipulated all my adult life. i don’t know that they conspired against me. I believe I was a test subject more than likely. I was a control, someone that would not likely be exposed, so they made sure that I was exposed to study the effects for comparison to reports from hundreds ot thousands with various conditions. I was intentionally exposed and like clock work broke out with the exact symptoms 2 weeks later and hospitalized for a month after that. I was issued a P-3 profile by a medical board in Vietnam signed by four officers on DA3349, and told I was going home. It was ordered that I have over, “OVER 120 DAYS RECOVERY TIME” to stabilize. I never got any of the recovery time but I was sent “HOME AWAITING ORDERS”, but not separated from the service. I was sent to another station and put before a board of officers. I was told nothing until there. No notice, no announcement, no assistance, no PEBLO, NO RECORDS, NOTHING. I year in the hospital should have been given, but instead I deteriorated. In 1983 the VA fee based dermatologist told me my lungs were scared spottily, and chronic lung conditions were documented in service, but it is not in his record I got from the VA. Now, 20 to 30 FOIAs and 45 years later, I finally got some records, but some have no signatures or form numbers or dates, locations, and conditions are “unspecified “ and others are “organism undetermined”. Just your regular average skin disease causing evacuation and typical permanent disabilities that are documented but denied.
  3. Jeff, Thank you for the information. I think it all comes down to the VSR that prepares the information the rater gets from the VSO or the vet or both. The dirty VSR’s destroys evidence, withholds evidence, and what ever is necessary to screw the vet over, and the VA stands behind them. It is a shame that these people walk among us. I will see what happens in the next little while, and who I need to contact to get the inner workings of the VSO, VSR, RATERS and Supervisors Administrating the manipulation of our futures. They intentionally destroyed mine, but what they do next will shape everything from now on. I may be surprised and get the honest rater who has the ability to correct this mess they’ve made. My records were never lost for one minute but 45 years to get them, or any compensation or benefits? No. It was no accident. 30% or more permanent disability incurred in the Line of Duty means retirement, and they were not going to have any of that, especially for a 20 year old, when they supposedly didn’t know the cause of the disabilities..   4. No. I have nothing in my possession except letters denying access to the treatment records per FOIA Exemption 5 [ 5 U.S.C. § 552 (b)(5)]. They fall under the “Deliberative Process Privilege “, and I tried to get them months before I was discharged. There answer was “They were lost in transit from Vietnam “. In 1983 when I filed they simply did not respond to me or VFWs Request. After 45 years and 20 to 30 FOIAs or more, I got some from My hospitalization in RVN, 21 days at 3rd Surgical and 25th Evac before going to Japan for more testing. I was issued a P-3 permanent profile from a Medical Board in Vietnam on DA3349 for “ physical capacity and stamina “. I was sick, very sick, and I finally have those records, but ZERO MEDICAL RECORDS for six months after my return to CONUS. I guess I know the answers, and shouldn’t have asked the question, but it is very odd that they expedite claims all around me, and four years later I am still waiting since I reopened my claim. They intend to screw me over I am sure. I will be dead before they correct anything. They played me very well and manipulated everything to burn up time. They will go on long after maggots eat me up. I would like to personally meet every VA employee that had anything to do with my claim. I would like to gaze into their eyes and read the soul in that being. I want to feel what it is that compels them to make these decisions for the VA. I’d like to put eyeball to eyeball with the Executives of the VA, to see what kind of person they “really are”.   5. Gastone. i should be directly service Connected. I complained while on duty and some months after being medivac’d out of Vietnam. The VA refuses to release the records for the immediate seven months after my return. They would call it something else though and not PN. They called the Chloracne around my eyes and neck a “papular rash”, the swollen limbs and large wheals and extreme pruritus was a skin disease, and chronic Upper Respiratory Infections was systemic and undetermined organism. I had Group A Streptococcus for months, swallowing problems, and every symptom of connective tissue disease, which may have affected my lungs. This is all documented while on duty, but I have been put off all my life, only getting some treatment records two years ago. They are withholding the results from Japan and seven months after my return. Well, I will see what they do now, and go from there. thank you all. I am editing this because I forgot to add, that I am still treated for PN, as well as degenerative disk disease, stenosis. They was considering testosterone therapy, but the cardiologist said no, because The heart couldn’t handle it. I am 100% blocked in my left carotid artery, and have been maybe since the Army days. The migraines began after several months back from Vietnam and led to comaright after discharge. I was a genuine example I guess. In Japan, they said I was number 5 to have this condition and we were all sent back to the states, but don’t know of each other’s identity. They are looking at this again, so they may make it right, but I don’t know. Thanks Gastone and all. victor Ray
  6. Vetquest. i didn’t explain my self very well, but I didn’t mean sue the VSO( all I wish I could), I meant sue the VA for malpractice in order to view my records. I have been denied access to them since Vietnam, and spent a month hospitalized in Vietnam and Japan with this skin disease, erratic heart rate, bone pain, abdominal pain, which developed into Migraines and coma. The coma came just a few months after being discharged, and I never did stabilize on duty. I think I had a stroke too, and the records are hiding peripheral neuropathy, Chloracne, and I am almost positive Al Amyloidosis. I filed in 1983 because of the skin issues, not even realizing the chest pains or anything else was In anyway was related to Dioxin. The VA never did not respond to the VFW’s request for my records, and I have filed 20-30 FOIAs over the years. 2 years ago, I got some of the records finally. It shows being medivac’d to Japan for more testing after 21 days already in the hospital in Vietnam. They said I was number 5 with this condition, but had no clue what caused it, and could not treat it. My real problem has been getting any medical records. Seven months immediately following my return are withheld, and they told me they would not release them because they fall under the “Deliberative Process Privilege “. I wont be here in 10 years. The VA manipulated my access to evidence. That alone should be a crime. My esophagus malfunction may be related to my swallowing problems I had on duty, or heart problems related to improper treatment of Group A Streptococcus with Pharyngitis never getting antibiotics and having it for months, or the unidentifiable organism in my lungs may be related to the COPD ISSUES now. It’s hard to file properly when they won’t treat you, or let you see the records where you were treated. The VA didn’t service connect me in 1983 intentionally so records would not be created and kept as evidence by civilian providers.   7. DAV told me there is no expediting claims anymore even for Vietnam Vets. Only terminally ill vets, homeless, or going to be homeless are expedited, so it took DAV 5 months to get my claim into the system because they trashed it the first time because they are a corrupt organization. Mr. Edwards in St. Louis for DAV got Mr Stephen Kelly his 12 years of retro pay in one week without even filing a claim, the way I read it. Dan Knabe For DAV got Mike Franko’s claim “Expedited” after he had been denied once already, also got him service Connected, got his retro pay, and got him a job with DAV as well. There was no mention of homelessness, or illness besides ptsd and knee injury. Mr Kelly was just before me and Mr Franks was just after me and none of us fit the requirements except Mr Kelly and myself were Vietnam vets, and Mr. Kelly and Franko were Gulf War Vets, as best as I remember. I was permanently damaged by something affecting my entire internal body and skin(AO), and records hidden all my life. Edwards and Knabe got their clients records, scoured through them, and completed and closed the claim in one week. The VA is still withholding my records, I have used a VSO (now VFW) for the last four years, and still waiting. VFW told me it would be at least 3 or 4 years before the BVA gets to mine. Minimum 3 to 4 years, and I probably won’t even exist by then. This sounds like picking and choosing who is expedited, which is nepotism or being prejudiced against my claim. I filed in 1983 because the Army lied about my records in 1972 or I would have filed then. Total manipulation to keep me from Justice per Exemption 5 of FOIA. Any recourse? Is a malpractice suit the only recourse, unless they make it right with this last attempt? Thank you! victor ray
  8. Buck. Thanks again. You always have good advice. I did email an attorney and he said vets cannot sue if they were injured in service under the Federal Tort Claims Act per the FERES Rule or law, something like that. I swear, you just have to guess your way through this process. They all lie to fit the need. I will call around, but losing faith in Shulkin, and beginning to believe the “SWAMP” has gobbled him up as well. I thought he had some back bone, but maybe he is just a little finger digit in the skeletal system of the government. It’s a shame it is so corrupt. Thanks again, victor Ray

Buck, I have had 2 ischemic strokes that are documented, along with CAD, atherosclerosis, and arteriosclerosis, a brain hypodensity 13 x 5 cm with a basal ganglia infarction, a Cerebral cortical infarction, and got a letter a week ago taking me off disability retirement and putting me on regular retirement because I have reach full retirement age. I guess that is the law for everyone? I’m not any better, but just older, turned 66. The longer I live the more I realize just how corrupt the VA is. I thought they had a “good Department”, but I was completely wrong. You can show them a 55 Chevy and they will argue and deny that it is a car and you have no basis for you saying it is and dismissing it. They will claim it is an automobile and cite a hundred articles where it’s called that instead of a car, therefore your claim of your 55 Chevy is denied, and was never a car, and never produced as a car. Thats an ignorant analysis, just exactly like the VA does. The Army could not determine the cause of my outbreak of chloracne so they sent me to Japan for more testing to find the cause, and when they couldn’t, they pulled the “Chloroquine Rule” out of their uh, uh, bag of “How to Medically Dump A Patient When YOU Are Over Your Head and Don’t Know WTF to Do Next Book” book. Then after the tests leave numbnuts scratching their heads, they go ahead and use the ONLY retrodated rule THAT CAN SAVE FACE when you “don’t know WTF to do next” and are over their heads. I had no reaction to chloroquine, but was broke out with a papular rash around the eyes and temple, back of neck ears, with swollen ankles, legs, arms, like amyloidosis, urinating blood like kidneys were screwed up, liver and abdominal pain with abnormal liver labs and pain, but “pain” is not a reason for disability the VA told me. The angina and bone pain, and palpitations and erratic heart rates must have been the reason that “over 120 days recovery time” was ordered to get me stabilized. Of course the Army ignored all of that, and put me right to work, skipping the DES and kicking me out for getting exposed to AO. It’s a dirty job to lie, cheat, mislead, deceive, pervert, and twist the truth, but that’s why we have the VA supervisors, the raters, and VSOs. Somebody’s got to do it, and who’s in a better place than the only people that have the evidence? Nobody. Win + Win for the Army, VA, DoD, and the truth gets buried with the VET. i guess I am saying that I don’t believe the evidence matters as much as the bonus scumbag raters get. It’s pathetic that the evidence is useless, and the raters are all a POS scum.
  10. I need a lawyer at this point, rather than appeal the reconsideration. I was awarded 10% for GERD, 10% for Tinnitis, 10% for Sinusitis, which is a total of 10% for the three on top of 70% previously awarded the last 3 years for 80% Total. I need a lawyer because they have every intention of screwing like they always have. They intentionally lied about my records being lost. They didn’t make a mistake, or misinform, or misspeak, they plain old lied and deceived, with every intention of me dying before now to expose them. Even Vietnam vets that weren’t involved in firefights have a large section of the PTSD segment or awards, but why? The have infectious disease residuals. Hundreds of thousands are diagnosed with PTSD when it it untreated malaria’s. Most of those young doctors had no idea what malaria was or what to look for. Your kids may inherit defective genes from the infectious diseases, not necessarily your bad attitudes. I had no reaction to Chloroquine, but they used that to get me medivac’d out. To “dump me” because they were lost with Agent O. You aren’t gonna get the truth without fighting for it, and don’t trust the lawyer either. They like to settle without a fight, and short change you. I need a lawyer myself, but one that won’t sell my claim out. victor Ray

Well, i can tell you this as of February 1st 2018, my strokes were denied and I have 2 documented after the service documented and possibly one in the service, but they are hiding the evidence per Exemption 5 of FOIA. THEY TOOK MY DISABILITY down to regular retirement because I turned 66 also, even though i’m Disabled from strokes. I have the Hospital records in Vietnam showing the immediate results of contact dermatitis which they call Atop dermatitis, and I have the papular rash around the eyes, ears, neck and trunk, with swollen ankles, arms,. I have the symptoms of exposure, but they used the Chloroquine rule to “medically dump” me, which is illegal, but who challenges the Army?
  12. I wish they would. I’ve had about 4 of them so far, and probably one in the service, but Exemption 5 of FOIA 5[552 (5)(b)] keeps them from releasing most of my medical records after Vietnam. I need a lawyer pronto. Got the reconsideration on the Feb.1st. I have one I am gonna call, but he is on officer in the Army Reserves. Isn’t that clearly a conflict of interest. I don’t want just back benefits, I want damages from a malpractice suit. the VA said that is the only way I might get a copy of my records withheld. I’m looking for a lawyer that doesn’t work for the VA. One that will seek millions in damages for lying about my records being lost for 45 years. The best in the country. the VA is full of deceitful liars that need to be called out, and I am now ready. Any help? Thank You, victor ray
  13. Buck52. many thanks to you, Broncovet, and all that listened to this broken record, lol. I realize this is a very difficult case to help with, and I don’t think anyone can help except the courts, if it is possible to find an honest one. The VA knows exactly what they are doing and has known for 47 years. I’m convinced they have flagged names that pop up when requesting information, and we flagged individuals are directed to certain personnel when we do call. They have a successful system that has very few challengers, and no one they have to answer to so they will continue to do as they please. When the Department of Justice and FBI are corrupt at the very top, how does a piss ant fight back. The DVA have the evidence, the Liberal Rule, letters from siblings, current medical conditions, documented Line of Duty in Vietnam, the hospital records in Vietnam provided to them by the NARA Chief, and there is nothing more possible that could prove anything. Nothing is needed. It’s all been proven so it’s a wait and see how many reconsiderations, and how many completion dates they will keep pushing the date beck to. Time is on their side and will be here in 500 more years (probably), but I have days to a year, maybe two at best. They were sure I would be dead by now and rid them of any pain in the rear or liability, but I am here for my kids, grandkids, and because they have dishonored my word, and the truth. They are calling me a liar, and I will prove in court who the liar really is. I hate this and gave the government all my adult life to come clean and do the right thing, but those overseeing my case do not have it in them. If they don’t correct it this time, then the law will squeeze the truth out of them. I just hope to see it in my life. Please close this thread if you don’t mind. You have given all the advice anyone could possibly need and I appreciate all of it. I think because of the amount of retro benefits involved, and the exposure of more evidence in veterans favor of other unapproved contracted conditions in Vietnam Veterans, they balked, and again attempted to cover-it-up.   14. Buck. Thanks again, and yes, I have done most of this, but the hospitals and doctors only keep records from 5 to 10 years. I believe the documentation the VA is hiding concerns thousands and thousands of other vets, and they will do anything to keep it from the public. I had way too many issues and way too much evidence for this to be ignored and denied this long. They gave No acknowledgement at all until 2015, and in 2017 I got enough hospital records to the prove Direct Service Connection that they denied and still do deny. It isn’t about my disabilities in my opinion. I think it is about thousands of others having the same conditions or similar enough to guarantee a common problem with all Vietnam vets, and their offspring, and I believe the runaround I’ve received from the VA and DAV is extraordinarily weird. I have 100% proof of Permanent defects acquired and beginning in Vietnam, Four medical officers signing the DA 3349 making me non deplorable to most of the world, the records of continuous deterioration except those being withheld, proof of a tropical disease, the concession that I was exposed to Agent Orange by the VA’s own disability board, proof of current disabilities now that began in Vietnam or while still on active duty. They have it all. All that they need, and told me so. It is just more runaround to drag it all out, intentionally delaying completion and save the interest that should be given to us. If they were hit with some heavy heavy damage awards, they would not drag these out for decades. Since I first tried to get my records I have had children, grand children and one great grandchild, cause it’s been 47 years on February 4th, and still getting screwed. They should have to explain to the world how this evidence has not qualified me for medical care ever since discharge in 1972 or medical evacuation from Vietnam in June 1971.   15. Buck. They say I have all that they have, and sent them to me on a CD. BUT! They also withheld all of them from the first request on Feb 4, 1972 to spring of 2016/17. I filed over 20 FOIA’s in that period, and hand wrote many as well. I know they are lying, but it will take an attorney I guess, and hope he is not in their pocket, and sell me out like most of them do. The lawyer pockets a pay off and tells you, that you should take this deal or lose it all. So convenient and quick for him. Since Dec 16 2015 I have received at least 2 letters saying they are withholding all information that if disclosed would fall under the Deliberative Process Privilege per FOIA Exemption 5, [5 U.S.C. §552 (b)(5)] From: General Counsel (024) Again on August 14, 2017 Exemption 5 [ 5 U.S.C. § 552 (b)(5)] then on January 3, 2018 : In our previous correspondence dated August 14 2017, we incorrectly cited that we were withholding information that if disclosed would fall under FOIA Exemption 5 [ 5 U.S.C. (b)(2) ]. Notice the (2) instead of (5). They go on to say they gave me the CD and consider this appeal closed. I don’t want to keep bugging you Buck, because it has to be seen by the right person, which is probably a lawyer. I just can’t get it in my head that they are such crooks, liars, and thieves. No wonder our country nearly fell under obama. Pure corruption from the president down through the VA. Pathetic. thanks for the help though, it is greatly appreciated.   16. I will take your advice too Buck. I feel I am limbo, and they are holding me there, intentionally and maliciously, and someone ought to go to jail here. I read about a vet ever now and then getting greedy and creating a scam to get over on the government and getting jail time for it, but the people at the VA are untouchable. They screwed my life over, and it’s almost a miracle I am still alive. I hate to sound like a baby, whining, but the DNA got screwed up, and it’s being buried and forgotten. If they can hide the facts in my case, it is 100 times easier to hide my kids issues, or grand kids. One granddaughter has Hip dysplacia and the other a heart issue, and they will lie and cheat any vulnerable vet or dependents they can. The Army initially hid my records because I’m Sure the dioxide levels showed what they feared so the cover up was priority and the secret maintained for over 30 years. They have my entitlement history dated in 1994, and called me in 2014 to tell me they were awarding an increase in this and an increase in that, but I had never received one cent, ever. Someone using my name did though it appears. I think it was a rater in St Louis that is scamming the system. They had all the right ID info on me, but the money went to someone else, but that’s a different story. the point is that it’s so corrupt they themselves don’t even know what they do. I have the documentation showing the complaints, treatments, and diagnosis in the service records, but they say they are not there. I’m gonna write the OIG and let them know of fraud and abuse of power in their VA. Thanks Buck victor ray
  17. Buck. yes, now at 70%, 50-PTSD, 30-CAD. 50+30=70%. IU—-Remains denied because the evidence does not show that you are unable to secure or follow a substantially gainful occupation as a result of service connected disabilities. I have been totally disabled due to Stroke w/cerebral infarction, 100% blocked anterior carotid artery, calcium score over 1000, atherosclerosis, claudication in legs, broken coccyx, fibromyalgia, arthritis to name a few since 2009. Blood Disease-Denied since this condition neither occurred in nor was caused by service. Your service treatment records do not contain complaints, treatment, or diagnosis for this condition. The evidence does not show a current diagnosed disability. I was hospitalized a month in Vietnam, Japan, USA infectious disease wards. Six months after my return I was rehospitalized with an Upper Respiratory Infection that was acutely, diffuse, with undetermined organism. At Discharge-Lungs/Respiratory was marked as ongoing illness with chronic cough and wheezing. I take Plavix as a blood thinner/anto-coagulation medication. P-3 profile on DA3349 including blood disease. Migraine Headaches—claim for service connection is considered reopened. However, the evidence continues to show this condition was not incurred in or aggravated by military service. In June 1971 I was sent “Home Awaiting Orders”, then ordered back to Duty. The medical board proceedings and all medical records of inpatient, outpatient, lab work, X-rays, dr’s reports of any kind disappeared until January 10, 1972, when I was rehospitalized. DoD or VA removed that period of about 6/7 months because of evidence of stroke, migraine headache, malaria, or high Dioxin levels. I had Chloracne and Porphyria Cutanea Tarda, and Peripheral Neropathy among others. They word it in a way that the actual coded medical term is avoided. Prostate pain-SC is denied because prostate pain is not considered a disabling condition. This was obviously a female rater, because the closest pain imaginable is trying to work while she is giving birth to breeched baby, but the birthing is not as bad. I was 20 years old, not 90. Atelectasis, chronic causing respiratory/COPD lingual remains and bilateral lower lobe opacity—-Denied since this condition neither occurred in nor was caused by service. Your service treatment records do not contain complaints, treatment, or diagnosis for this condition. As I stated above, I was hospitalized for a systemic Upper Respiratory Infection, and little over a month later ordered to stay in quarters after testing positive for Group A Streptococcus with Pharyngitis and was discharged a few months later while still ill with it. Carrying that Group A for 2-4 weeks it becomes rheumatic and I have rheumatoid arthritis.The bones ache. Ive developed benign and malignant cancers, sun light sensitivity, really really thin alligator skin, 24 abdominal tumors so far, enlarged prostate, another stroke in right basal ganglia, and a brain hypodensity(dead white brain matter) 13x5mm, fatty liver, on and on.
  18. Thank you Buck. I will try to get in contact with them Monday, and hope for a little luck myself. Yesterday I was at preparation for decision and had been setting there for a month or something like that. I had been checking daily as I was told to do by the lady assisting me, and she told me they had everything they needed and was just waiting for a rater to rate it. Today, I went back to “gathering of evidence “ and new completion or suspense date of March to the end of May. The old date was January 15 to February 10. Everytime I get to the decision time, it goes back to the beginning. This is about the 4th or 5th reconsideration and I don’t think there is such a thing as reconsideration. I think it is a VA term that’s made up in order to drag out any completion and hope the vet dies before completion. They are all liars, deceitful, manipulative, and hid my records all of my adult life, and I don’t believe a word they say, none of them, not one, even Secretary Shulkin. I wouldn’t believe any of them even if they were in my face. the secretary of the Army in 1971 was a liar and a cheat as well and can go to he*l for all I care. HADIT is exactly how I feel about the slime in the swamp, and I hope they get what they deserve, right up the wazoo. I’m sick of the disgusting slime heading the VA, the VBA, the Board of Appeals, and all the crooks that feed them. They are all cheats and lying POS.   19. Berta, I see my reconsideration just got put back to March-May 2018. I have been lied to for the last three years I guess, and am still the dumb naive trusting fool I was in 1971. Maybe this will finally get through to my thick skull, that the VA is here to screw the militaries survivors. I'm going to write some folks while the VA starts the gathering of evidence all over again for the 6th or 7th time, and I wondered why some VSO's say there is no "reconsidersation", lol. They are right. It's just a myth, used to delay any claim payments and I did not think the VA was that dirty, but they are indeed the lowest. Scandal after scandal, fear and intimidation.   20. Berta. i’m sure the FOIA are good things when they work. I’ve sent about 20-30 and a year or two, I finally got some medical records, enough to prove my case, but the raters or those gathering the information hid it from them, but they say there is no record of it and it didn’t occur in the service, but I have the proof in my hand. How can a rater do that, just flat out lie? How can they get away with that, and why would they even try, if they have the proof in their hands. Did my assistant destroy my evidence? Did the lady assisting me for the VA hide the evidence? It’s St. Louis, so . thanks Berta, I will see what happens this week, before I do anything, even a FOIA Request.
  21. I was just reading about this, and recently signed a petition going around. I am going to request to be tested due to urinating blood in Vietnam and terrible abdominal pain, with abnormal liver labs in Vietnam. I now have a fatty liver, but not due to alcohol either. I don’t know if they would give me honest results though. You can not trust anyone, especially our government.
  22. Berta. my case is unusual in that “the fix was in” or “the cover-up” was in effect, discrediting, denying, delaying, misdiagnosing, mislabeling, and falsifying medical records. I developed blood coagulation problems after Vietnam, a cough and wheeze that would not go away, a painful sensetive prostate, Chloracne, an itch inside the skin that scratching til it bled didn’t help, and the migraines were so bad I think I had a stroke at 20 years old. I was hospitalized for a Upper Respiratory Infection that was systemic with the organism undetermined. Really, undetermined? Then tested positive for Group A Streptococcus with Pharyngitis but not treated to my knowledge, and smells of dapsone. They had a medical board in Vietnam with the commander over the facility and 3 other medical officers (that’s 4) signing a DA 3349 stating I had permanent defects in my “physical capacity and stamina “ limiting my ability to perform. Yet, they said all my records were lost in transit from Vietnam when I requested a copy several months before my discharge, and 8 months after my return to CONUS. THEY WERE NEVER LOST. THE AGENT ORANGE COVER-UP HAD ALREADY BEGUN. Only decades later and when science forced them to admit AO devastation. Now, it’s the offspring that will have to force them into honesty because that is not part of their job description. They withheld all my medical records (all of them) until the last 2-2.5 years. They still are withholding all of them from June 15 1971 to January 19 1972, and some I do have are altered. victor ray ps..I spent 28 days in the “infectious disease wards”, and that may mean something to someone.
  23. Berta, Thank you very kindly. The VA sent me several letters stating that they were withholding certain documents per FOIA EXEMPTION 5, that fall under the “Deliberative Process Privilege “, and from what I gather it seems to means “withhold in anticipation of Litigation”. It seems they knew before I was discharged, that a lawsuit at some point would follow. I believe the 6/7 months of records that they are withholding contain evidence that would document or be evidence for other similar claims. I was told I was the 5th service member to have those conditions in June 1971, while hospitalized in Japan. i read that the only way for me to get those documents is to sue the government for malpractice and only a government attorney defending the United States Government could release a copy, but I may never get the blood smears, X-rays and ???.. i guess I had better be looking for a lawyer that won’t sell me out, if that’s possible. I just read about it a month ago, and just days ago it was thrown out. In 1983, the local VA denied my claim before they even received the medical records for the decision, lol. Before computers, fax, and all that. Less than 90 days from filing to complete. i tried to delete this, and thought I did. It is a rediculous thing to ask, because we all know. I am in denial, I guess. 47 years ago in June I was medivac’d out of Vietnam with permanent damage and it got worse. I hope to hear something soon. victor ray
  25. Berta. it is on the internet and anyone should be able to find it. I just use google as the search engine and it pooled up. Yes, it was in the press, by I just entered “ lawsuits against VA”. Maybe “Kansas City man sues VA for $35million” would be better. Hope you find it
