  1. Found it !!!,,,,,The C&P examiner stated 4 weeks incapacitating period and my NEXUS LETTER INDICATES a period of 10 weeks. But VA took their decision based on the C&P examiner. What can be done ???

  3. Hi Berta, my appeal is approved, I won the appeal of my case. But they used the incapacitating period of the C&P instead of using the one in the. NEXUS LETTER. Any input ??
  4. MY NEXUS LETTER INDICATES 6 WEEKS OF INCAPACITATING PERIOD, AND MY C&P RESULT INDICATES ONLY 4 WEEKS. ANY INPUT ???
  5. I filled my first claim in 1988, it was denied. Then I claim again in 1995, denied again. Along the xyears I gave up until my lower back hurt again. In 2014 I filled for,the thirdctime for my lower back. It,was denied and had an appeal. The information I have is that I won the case, but I don't know the percentage yet. My question is if the,back pay is from 1988 or from 2014 ???
  6. I just had a multiple C&P EXAM for lower back and hip problems. The C&P examiner stated my incapacitating period as 4 weeks with "AT LEAST AS LIKELY THAN NOT" , while the NEXUS LETTER from my private doctor indicates 11 weeks of incapacitating period WITH "MORE LIKELY THAN NOT". Which one will prevail ???

  8. Can I file a va claim based on my medical records of 1986 for mild depression while in service ??
  9. Sorry. The 10% is for tinnitus only. I filed a new claim for major depression and the only evidence I have while I was in service is the one for 1986. (it was for MILD DEPRESSION)
  10. Hi, I was diagnosed with "mild depression" while in service in 1986. Now I have MAJOR DEPRESSIVE DISORDERS , ANXIETY, etc, etc. Can I claim based on my dignostic from 1986 ??

Yes, 1.She has sent the POA form signed by me but VA hasn't change the representative from VFW to her and the hearing is next month. 2.I believe that she can testify based on that she has my complete file with all the medical evidence (old and new) , she has more information and details than my wife (who wasn't with me when I was in active duty). Yes she has been working with me for a long time (more than 6 months). She instructed me to get some "statements" from family members, co-workers, including my ex-wife, etc. She has also got me in contact with a DR. for my NEXUS LETTER. (The person from VFW has not instructed me of anything she has ). 3.We discuss almost everyday via phone or email regarding my case. 4.The person from VFW I HAVE ONLY SEEN ONCE IN 3 MONTHS. It is impossible to reach him via phone or mail. He does not answer at all.

  14. Yes, my lawyer knows that VFW has the POA. What I'm thinking is to have her as my witness also. According to VA FORM 21-0790 , I have the right to have "witnesses" at my hearing.
  15. Wow ,,,this is complicated !!!......Really. I know I have the right to have a "witness" at the HEARING. What I'm thinking is , instead of my wife, to have my lawyer at the hearing as a my "witness".
  16. She is a VA CERTIFIED APPEALS ATTORNEY among other thinks. 1.The main issue is that when I had no representative at all, I went to VA and they assigned me VFW. In 4 months I have only seen once that person from VFW. 2.My personal lawyer, among other thinks she is a VA CERTIFIED APPEALS ATTORNEY (I found that long time after VA assigned me VFW) 3.Based on that, can she be present at my hearing ????
  17. She is also a VET and handles veteran cases as well. Right now she is putting together a package with all my original claim documents , besides new documents and statements from family members, co-workers, etc. Also she was the one to get for me a NEXUS LETTER for my APPEAL.
  18. Hi to everyone. My representative is VFW for my case with VA. , my question is : Can I bring my personal lawyer to the APPEAL HEARING ????....Ca he be able to speak for me ????
  19. Since all the recent results show everything that is wrong with my back , now I have to wait until the Appeal.
