  1. Fyi....e benefits status can and probably will change several times so don't freak out. You could still be waiting months to get your decision.
  2. They did not require anything from me (no C&P) when I filed fdc for reopen my PTSD. It got approved in like a month to a month and half. Just depends on your evidence really.
  3. Andyman I totally understand. It will be a few years before the education benefits kick in but I love knowing that I don't have to worry about that. I needed that peace of mind. Nothing like knowing that your children's futures are looking bright!
  4. I have written on here about myself. I filed for P&T even though they had only just given me 100% with SMC-S a couple of months before (backdated 2 years). My case is that I felt that I should be P &T for my PTSD which they awarded me 100% scheduler alone for. It only took like a month for them to approve my P&T application. I might be a rare case here. It took me a very long time to get to 100% though ( started at 10% for my ptsd and fought for the next 10 years to get to 100%). I filed a 526EZ along with my 21-4138 stating why I felt I should be P &T and I also attached my SSDI award letter and a social security statement that showed that I hadn't worked in over 5 years. Everyone is different so I don't think there is a sample letter because no two vets are the same. If you are planning to file go for it. Be prepared for the worst but hope for the best. That's what I did. The biggest relief was the benefits received for being P&T because I have an almost 13 year old and a soon to be newborn that I needed the additional benefits for.
  5. Thank you. I hope your journey ends in success. I know that it was really hard for me to get from that 90 to 100%, I was shocked when I looked and I was granted the SMC S. I did not even know that existed. God is Great! Remember to fight the good fight and never give up. You have this!
  6. @Flores I know it takes a lot of stress away when you have children knowing that college will be taken care of. I have a soon to be 13 year old and a newborn on the way. I just needed the stress to be somewhat alleviated. I have been fighting with the VA since I left active duty. It took me 10 years to get to this point. It was nice to get back pay though..hehehe....but I knew that by now my PTSD was not going to improve. After several hospitalizations you would think they would have done it all on their own but not.
  7. God is Great! I asked for P%T and well I just went on Ebenefits and I got it!!! I applied for P&T after they awarded me 100% schedular in October. Last month I applied for P&T because I felt that I should have no future exams and that my PTSD should be considered static. I filed the 526EZ in November and asked for P&T shortly after they bumped me to 100 % percent schedular (October) and they awarded it to me. Thank God I do not have to worry about my childrens health insurance and college now. I can only say that it does not hurt to ask. I was prepared for them to say no but I so happy and blessed that they said yes.
  8. Not sure where this goes and feel free to move it. I just wanted to give hope and good news for my fellow VETS. I am 100% schedular with the VA and sent in for student loan forgiveness. I just got my confirmation today that my Student loans were fully forgiven! YAY......I am NOT P&T or TDIU either. So as long as the VA considers you 100% you qualify for the student loan forgiveness. GOD IS GREAT!!!
  9. Okay. Well I hope to find out soon so that at least I will know. really tired of going back and forth with the VA. would be nice to not have to worry about future reductions. And I need e benefits because my husband is stealing my mail so I don't get my VA info unless I know it's coming.
  10. Well for those of you that have followed my story, you know that I filed for P&T recently. I knew that filing for this could subject me to reduction. The current status of my claim on ebenefits is now: 11/09/2016 Compensation Pending Decision Approval Attention: Status Has ChangedStatus Has Changed Could this be a sign that they approved my P&T request? I hope that it is because I really need it. I should have an answer or rather completion no later than December 1st according to ebennies. Please wish me luck! Will keep you updated......
  11. I am not going to argue over backpay either. I just want to at least get the P&T rating. I will probably lose 2 years of backpay but I don't even care at this point. I think the benefits I will gt from P&T outweigh the argument for backpay that I probably wouldn't even be granted anyway.
  12. BTW, how does one file a CUE and can that be done on ebenefits? What evidence is required to file a cue?
  13. I still think I have a fighting chance for the P&T with the right documentation. If the reconsideration fails I will file an NOD and start an appeal. I would have to wait until 2024 for the 10 year rule which would be crazy. I just need for them to hurry and send my c file so that I can see what the BVA stated in the 2012 decision because I never received that BBE.

  15. I received my retro 5 days or so before I ever got the BBE. I only knew that I got it because I randomly checked my bank account and it was in there. I then went on ebenies and saw an increase in percentage and about a week after that I received my BBE.
  16. Gastone they said that my IU claim was moot because they awarded me scheduler instead. I feel that should not be the case (moot) because I have not been able to work since 2010. This proves that my SC disabilities have prevented me from employment also my SSDI (based solely on my SCs since 2008).This should prove my P&T. Since they denied my IU I am hoping that the Voc Rehab denial letter will serve as proof of my P&T. If not, I will file a formal appeal and have am IMO/IME done. Congrats on your win as well!!!

I want to add that they stated that future improvement may be expected or something but that seems ludicrous to me because I was rated at 70% (since 2008) for over 5 years and bumped to 100% for over 2 years now. Where is the expected improvement in that? I have tried very hard to overcome this and wake up cured but it has never happened. The cause of my PTSD has and will never go away. No amount or treatments and medication has cured it thus far. My therapist even says that there is no magic pill or cure for this. She reminds me of this every appointment. I feel like the future re-evaluation is just a way for them to stall in giving my P&T. Your book idea sounds like a great idea. Hopefully you get it completed in the near future.
  18. That is exactly what I am doing. I never wait for the VA to give me anything. I was asking if the voc rehab letter was new and material evidence for the increase to P&T. Seminole I have been 70% for over 5 years according to the back dating and I have been 100% for over 2 years according to award date. Hopefully that will be enough to justify my request for the P&T. Thanks for responding. A little encouragement and advice can go a long way.

  20. I am 100% schedular for my PTSD but I need to get P&T. I understand that the VA believes that I will get better because MH conditions usually improve but mine has not. I went from 10% to 70% to now 100%. It is steadily getting worse. I don't understand why the VA wont give me P&T. I have been getting SSDI solely for PTSD since 2008 when it was rated at 10%. I have recently filed an intent to file asking for reconsideration of P&T along with a 21-4138 and denial letter from vocational rehab. I am also willing to do a C&P in they want one. I was just taken off of a suicide watch list about a week ago due to my extreme suicidal ideation and mental impairment. I also go to therapy weekly with a civilian provider that the VA pays for. I just hate having to jump through hoops for something that has no end in sight. I'm never going to wake up and be cured of this. I am also SMC S1 housebound since 2014. Was just awarded the 100% and SMC S1 recently (back dated to 2014). Is the Voc Rehab denial considered new and material evidence or do I need more (just got denied voc rehab like 1 day ago)?   21. You made a statement that had (Emotion & Feelings) in it, regarding your PTSD Rating 2012 70%, "should have been getting paid for it since 2007." Were there prior Denials that were Appealed. No matter what you think or feel about anything related to your Initial PTSD VA DX, you didn't officially have PTSD until the C & P Psychiatrist made his DX, in 2012. To answer this No. I got out of the military already diagnosed with PTSD in 2007. The VA had me rated at 30% for PTSD at that time. I filed an appeal for the rating and was BVA approved and bumped to 70% in 2012 with retro back dated to I believe 2007 or 08. I never received the BBE due to wrong address so I missed the deadline to appeal that and was stuck with the 70%. I only filed for TDIU and NOD at the same time in 2014 which both were stated to be invalid recently (September 24 2016) so I had them reopen my claim about a month ago and that is when they have just now awarded the 100% with SMC and backdated it to the original TDIU claim I filed in 2014. What Medical Evidence is in your C-File that makes you believe you should be Rated as T & P for your PTSD? How about posting a redacted copy of your 2012 & 2014 PTSD DBQ's and their respective Award Letters. Did the Rater address the T & P issue at all? Did you NOD the 14 Award in 2015? I would if I could but I wont receive my c file for at least another year. I never even knew what those were until I joined this forum and only recently requested it. I plan on NOD the 2014 award when I get the award letter in the mail (any day now) only to request the P&T rating. I was hospitalized twice during the appeal process for suicide attempts and was told by the VA doctor on the ward that I should be at 100% (I know that means nothing unless she puts it in writing which i do not think she did). I think that the reason they did not award P&T is because they think that PTSD will get better. Mine has not and will not. I have progressively gotten worse as my ratings increases indicate. I am going to try and get a IMO that states that it is permanent. Any discussion in either 12 or 14 Award Letter, regarding Future Exam Scheduling? If your not 55+ or North of mid 60's getting a New Award, or T & P, your C-File will be Diary Dated for a Scheduled Re-exam in 3 to 5 yrs. Don't have it yet but I am pretty sure they have addressed it and state that they have scheduled a future exam. If I'm recalling this accurately, Per VA Reg, your 70% PTSD Rating gets locked in, no possible reduction after 10Yrs, that's 2022, right. Same goes for your other 2012 SCs. Well they have now changed my PTSD date since they awarded it at 100% to 2014 so I think that bumps that to at least 2024. **I should also add that I have an appointment with Voc Rehab on the 7th of Nov. Will a denial from them help with my P&T claim?
  22. Oh I have been receiving SSDI solely based of my PTSD since 2008. I guess I just don't understand why I am not P&T by now.
