  1. I've never heard of a 4-6 hour evaluation before. 1.5 hour max. Whether it's good or bad? It depends on the results. It sounds like they're finally taking you seriously and thus the long evaluation. If the VA is willing to put you through a 4-6 hour evaluation then they are taking your condition very seriously. In my humble, non-expert opinion, I'd say be honest and not minimize your symptoms and you should be ok. But other more experienced people may have more detailed advice. Personally, I'd consider this an opportunity to let yourself be heard and go for a possible increased rating, if it's called for.

  2. My mom said she'd be the fiduciary for me if it comes down to it. I'm single with no kids. The medical evidence they're using is from a 2016 C & P exam. The doc asked if I pay my own bills and at the time my parents were helping me out financially so I said no my parents pay them. So he marked down that I couldn't handle my own finances. I didn't realize the consequences of that question at the time. I didn't realize this was so serious until now that I've done some researching. I'll get a lawyer to help me out. Thanks to everyone for helping me!

  3. I got my BBE in the mail today. It says schedular 100% p&t, but also says I'm incompetent and have to have a fiduciary manage my finances... Anyone know how to change this? They said I have 60 days to submit evidence. What kind of evidence do I need to prove I can pay my own bills? 

  4. Wow! This was unexpected! The BVA granted my appeal March 1 2019 and I got my rating today on eBenefits and VA.gov stating 100% P&T! The Alaska RO worked really quickly. I was expecting 6+ months waiting then a lowball rating, but this is terrific! Once I get my retro check (which they gave me the correct retro date too) I'll be making a donation to Hadit because you all have been so helpful! Thank you to everyone who has helped me get here!

  5. Thanks Broncovet! I'll just have to wait and see if they want to play games or not. I think I have a pretty strong case for a higher rating. I'm on SSDI for my service connected disability and the last c&p exam they gave me in 2016 was a strong 70% exam. The doc checked off almost all of the symptoms from the 70% list. So they'll have to get really creative if they want to low-ball me on the rating.

  6. Hi all, here is the BVA's decision on my appeal. I originally filed a claim for depression back in 10/2007 but was denied. Then I opened a claim for Bipolar in 11/2015. I hadn't even considered the 10/2007 as an EED, but in the decision the judge keeps referring to the 2007 claim and says that my Bipolar claim is new and material evidence that reopens that claim. Am I reading this right that I may be able to get an effective date back to 10/2007? Thanks for looking over my decision and helping me out.BVA Decision 3.1.19.pdf 

  7. I just checked VA.gov today and it says the judge granted my appeal for service connection of bipolar! I don't know the details yet, but this was the major hurdle I had to get over. It's been about 3.5 years and I wanted to thank everyone who has helped me along the way! All of your advice has guided me to success and has helped me keep my sanity through this process. Thank you all! I'll update as soon as I know what percentage I got. Thanks again!

  8. Thanks Buck! It's been more than a year, but it's a new claim with a different condition than the original claim. So I'm hoping it'll be ok. I was under the impression that the VA is supposed to "help" you with your claim if you get the diagnosis wrong, instead of denying you right away. Like if you file for depression but it turns out you have PTSD they don't deny you because you put depression they just "help" by switching it over to PTSD.

    Vetquest, I'm trying to get my bipolar service connected. They discharged me with a personality disorder and later on I was diagnosed bipolar.

  9. Hi all, and thanks in advance for any input and advice! I'm considering filing a new claim but am not sure if it's worthwhile. While I was in-service I had chronic bronchitis. I just went through my medical records and they circled acute bronchitis every time except one, where they circled chronic. It lasted for like 9 months. After discharge my primary care physician told me I had significant scarring form the bronchitis and it caused me to have a lower than expected PFT, so I should file a claim, which I did. However, I put pneumonia down instead of bronchitis and they denied me right away saying I didn't have pneumonia. And I left it at that. Now I am having a harder and harder time breathing and have asthma. I had asthma when I was in elementary school but it went away when I was in middle school, and it appears to have come back some years ago. Anyways, is it worth filing for some kind of respiratory condition? I'm not sure what pulmonary scarring is called or if that's the cause or my asthma, and if my asthma was aggravated by service. I was exposed to chemicals once for several hours. My Sgt made me and my roommate mix bleach and ammonia and scrub the floors with hand brushes, which got us pretty sick. I'm not familiar with pulmonary issues, my claim I'm fighting for right now is mental health related. Thanks again and sorry if I rambled a bit.

  10. There's a lengthy discussion of this under a different thread. Apparently it happened to a lot of people, including me. I think it's some sort of glitch in their system. I sent IRIS an email asking about it and this was the response:

    Your file has been uploaded to an electronic filing system that allows multiple offices to access your file and develop your claims at the same time.  According to the Board's database, the Department of Veterans' Affairs Regional Office transferred jurisdiction of your appeal to the Board on 1/23/18.  After reviewing your appeal for readiness, the Board will, if appropriate, consider the appeal according to its place on the docket as required by law.

  11. Here's what IRIS sent me:

    "Your file has been uploaded to an electronic filing system that allows multiple offices to access your file and develop your claims at the same time.  According to the Board's database, the Department of Veterans' Affairs Regional Office transferred jurisdiction of your appeal to the Board on 1/23/18.  After reviewing your appeal for readiness, the Board will, if appropriate, consider the appeal according to its place on the docket as required by law."
