  1. Interesting, although my paperwork states that I am not scheduled for anymore C&P's. I guess they could always call us back update: Spoke with a prior VA lawyer and by law, sure they can call you back in for a C&P exam, even lower your rating; however, if you are 100% permanent the VA cannot reduce the amount of your monthly monetary amount. Hence “permanent.” This is why they do not call you back in!
  2. Thanks, although looking at the numbers the 50 % for Sleep Apnea just carried me over to 96 points. Question: It does say that it is permanent and total.. could the VA call back in again for a C&P review?
  3. Latest Update: Received notice last eve through E-benefits that I am now 100% P&T and am not scheduled for anymore C&P exams. . . . FINALLY after 15 years. Retired in 04.
  4. Update: E-benefits has moved my appeal to the "Prep for Notification" Block with a new complete date between 3/8-3/10. which could be tomorrow? I was also told that that Sleep Apnea was approved (yea)! That being said, I was not told that I was at 100% although I was told that I would be 'presently surprised'. Question: If it is at 100% how will I know if it will be Total and Permanent? Thanks P.S. excited!!!!
  5. I did the same thing for my appeal. I did get he same response and spoke with a VA rep and finally case is under the claims column vice the appeals column in E-benefits. It has been moving back in forth from "reviewing evidence to Prep for decision" . It is recently in the Prep for decision column as of this AM. Of note, when I went under the RAMP appeal system, VA sent me out for another C &P exam (weird in itself) and I am told that I do have sleep Apnea and that the DOC during the C&P agreed it was attributed to my mil service. . Now, I was already at 91 points, so , I am hoping this decision whenever it happens will get me to 100%. I have been dealing with the VA for 15 long years! Sooooo tired. The only advice I can give is to hang in there and they will get to your case much sooner that the DRO review.

  7. Update: Well the VA sent me back out for a C&P for the sleep apnea appeal case. I read the doctors assessment from the visit they agreed with the original assessment that more likely than not, that the illness is from my military service. I guess that is good news? Now just waiting on the final rating if I will be awarded 0 - 30 or even 50% for the sleep apnea appeal. This RAMP appeal case encompassed an in-crease for wrist, shoulder, and of course the sleep apnea. It is in the "Prep for Decision" Stage with a completion date between May-Sep As prior posted, I am presently rated at 90% (91 points) and so it may carry me over to 100%?

  9. Yes Sir, Doctor told me he has tied this to current conditions and more likely than not this was caused by my service time and stated that a CPAP is necessary. So, I guess I will wait and see how this overall appeal comes out.... The VA also combined this sleep apnea with an increase for my wrist and shoulder so hopefully this total appeal is positive.
  10. My apologies for the late delay. Was rated at 70% for Depression and Anxiety overall year ago, and now overall rating is at 90 percent (91 points). My doctor also had me do a sleep study and and with a prescription for a Cpap machine . My lawyer is tying this to the secondary issue during my service years and hoping to get the VA to issue a Cpap machine so hopefully I can get a least 0 percent? Ebenefits states that the VA is currently "reviewing all the evidence." I guess if I received 50 % it would take over the top for 100%?
  11. So to answer your question, I am going through the same thing; however, mine is now in appeal under the RAMP system and it has been pretty fast. I had mine service connected through a secondary illness and had prior ships doctor write letter stating such. I am told this is getting ready to be approved but not sure at what rating? The interesting thing is that I am 59 years old and presently at (90% with 91 VA points ) which means that 50% would put me over to the 100% catagory, but everyone knows the VA will try to avoid this. I also had a few other things wrapped in this appeal though so we will see? I wish you all the best in your quest.
  12. A few options, mental health claims normally, rate at 10, 30,50,70,100. If you can prove that you cannot work than thak changes the game at 60% getting paid at 100%
  13. No, my 80% is from knees., gerd, wrist, and shoulder issues. The depressive and anxiety disorders are the pain syndrome as secondary issues from the associated.
  14. Good Day All Just a question: I am presently rated at 80%, and was recently by my outside PSYCH doctor with Depression Disorder and Anxiety Disorder and was wondering how this would affect my overall 80% disability rating?
