  1. I'm actually rated 100% P&T per VA. So I guess that helps clear up a few things. Sorry about not being very clear. The VA has my rating for cervical radiculopathy at 40% static. They moved the claim from Gathering of evidence to preparation for decision then back to gathering of evidence. When I called they said they needed clarification. Not sure what they mean by clarification of evidence, but hopefully it is due to the fact that the C&P Exam was contradicting itself.
  2. It is for a increase due to loss of use of hand. The VA paid for me to have a ACDF Surgery for the service connected C7 radiculopathy. The surgery was not done very well to the point I have lost use of my hand. I had my treating outside doctor fill out a DBQ that indicates that, but as you can see the Nurse Practioner stated otherwise. That is why I'm having issue's with that C&P Exam. contradicting herself. I have had other surgeons tell me I need another surgery to remove the bone spurs and leftover disc material that is now not only deforming and dislocating my spinal cord.
  3. The DAV as my VSO submitted this claim without me knowing, but it was for a increase for Radiculopathy upper extremity associated with Cervical Disc Disease of C7. I'm currently rated at 40% and my private doctor indicates on a DBQ that hand/fingers are complete paralysis where as the Nurse Practioner at the C&P was all over the place as far as sensory, muscle, reflex diagnosis. That is why I'm confused and was wondering if the VA will look at a doctor over a NP when opinions come forward?
  4. Can someone give me a little feedback on this C&P Exam. If I'm reading this correctly it seems like there is a lot of contradicting statements. Thanks for any input. Also the scanner did not pick up the last 2 pages. One page ask if a EMG test have been preformed and the Nurse Practioner said no, but the VA preformed a EMG test less than a year ago. Also the final issue is she stated: The Veteran is limited to functional activities that include frequent grabbing, grasping of objects due to Peripheral Neuropathy condition. The Veteran can preform general activities without significant restrictions. I also have a DBQ from my treating doctor who states the obvious of complete loss of use of right hand and limited use of right arm. IMG_20171114_0003.pdf
  5. Sorry about the lack of info. I had a C&P Exam for loss of use of right hand. The Examiner stated things that contradicted herself so I guess now the question should be is there a way to dispute this exam. I had my treating doctor who did a DBQ indicate that not only in the DBQ but also a nexus statement that I have loss all use of my right hand. He also indicated in the office notes that I can not grip nor grasp. The Exam states I have limited functional activities that include frequent grabbing, grasping of objects due to peripheral nerve condition. Then the very next sentence say's The veteran can preform general activities without significant restrictions. This makes no sense to me maybe someone here can explain. Thanks for any input.
  6. Hello, I recently had a C&P Exam for peripheral nerve condition causing loss of use of hand. I had a doctor do a DBQ before the C&P was scheduled. I have called the 800# and spoken with the DAV and they all said that the RO did not see the DBQ so that is why they scheduled the C&P. Anyway after looking over the C&P exam I have realized there are many contradictions. I was wondering not only did the Nurse Practioner states that I have sensory in the right hand/fingers and it states absent. Then she states I have muscle strength of 3/5 in Elbow extension and flexion, 3/5 wrist extension and flexion, grip is 3/5 as well. Problem I see with this is that she never raised my right arm to do test. Especially with the grip portion she never tested my grip since my right hand/fingers do not move at all. Also in her notes she states under Functional Impact: The Veteran is limited to functional activities that include frequent grabbing, grasping of objects due to Peripheral nerve condition. Then right under that she states The Veteran can preform general activities without significant restrictions. This is way off base. Any outside input would be helpful. Should I consider disputing the C&P Exam?
  7. Hello, I was wondering if anyone has experienced a "General Medical" C&P Exam. I have a increase claim in and had my doctor do a exam and submit a DBQ for the condition. Even with the DBQ the VA has contracted out to MSLA and ordered a c&p exam. I have looked into the different types of C&P Exams and noticed that this type of exam is for the complete body. If anyone has any input I would greatly appreciate it. Thanks
