  1. I have a question regarding a RATING DECISION I received a while back.On the last paragraph of page 3 they state “As you did not specifically claim these conditions, they are not inferred in this Rating Decision.” What does “inferred” mean? Are they saying that I was not denied for these conditions so I can still file a Claim?

I have so many medical conditions that were caused by diabetes (AGENT ORANGE) and I am confused with what medical conditions I should file claims for because some happened before my effective date but they have become worse since the effective date and some happened after the effective date. I don’t want to pay for a DBQ or Nexus letter and not be able to claim them. Can you recommend someone that could review my records and recommend to me what medical conditions I should file a claim for? I would pay whoever would do this.
  5. I review VA Form 21-526EZ and instructions on how to complete this form and nowhere did it say that DBQ forms had to be submitted. I thought a DBQ had to be submitted with each claim.
  6. Per CFR 4.97 there are a lot of ratings for the respiratory system. Can I get a rating for MORE than one rating say COPD,, EMPHYSEMA & SLEEP APNEA?
  7. On Sep 15, 2015, VA denied 3 medical conditions that were secondary conditions to Diabetes Mellitus: 1. Artery & vein conditions (Vascular diseases including varicose veins). 2 Heart conditions (including ischemic & non-ischemic heart disease arrhythmias, vascular disease and cardiac surgery). 3. Hypertension. I did not appeal in time but now all 3 conditions are worse. Can I again file as secondary conditions or file as a REOPENED CLAIM” showing new evidence? I know I have been asking a lot of questions regarding this matter but this one may be one of my last questions.
  8. I never filed a claim but in Aug of 2016 VA doctor did 3 C&P exams on me but I never received any decision letters. Shouldnt I have received at least 1 letter?
  9. On Jan 8, 2016, I had 3 C&P exams completed at the VA Medical Clinic, Orlando FL. that were done by the same doctor. All 3 medical conditions were secondary conditions to Diabetes Mellitus: 1. Artery & vein conditions (Vascular diseases including varicose veins). 2 Heart conditions (including ischemic & non-ischemic heart disease arrhythmias, vascular disease and cardiac surgery). 3. Hypertension. On all 3 DBQ’s the doctors MEDICAL OPINION were the same “IS LESS AS LIKELY AS NOT PROXIMATELY DUE TO OR THE RESULT OF DIABETES MELLITUS.” My question is, somewhere I read that to be rated separately for secondary conditions or complications the conditions must not have been considered in your initial rating decision. When they say “INITIAL RATING DECISION” are they referring to the about 3 C&P exams for are they referring to the ‘RATING DECISION” they mail you? I never received a RATING DECISION for the 3 C&P exams. I want to file a claim with a DBQ along with a medical opinion on all the secondary conditions they said were likely as not proximately due to or the result of diabetes mellitus. What do you suggest I do?

When I previously posted this question, it was a little garbled and I meant to say, that on March 24, 2003, I filled out a VA form called “HEALTH HISTORY FOR PRIMARY CARE ASSIGNMENT” and give it to the VA hospital in Michigan so that I would be eligible for VA medical care. On this form they had a question called DIABETES and I checked YES. I eventually filed a disability claim for diabetes and VA granted me 20% disability for diabetes because of Agent Orange on August 11, 2015. I have some secondary conditions caused from this diabetes and my questions is, can I claim Secondary conditions that happened after March 24, 2003 or only the conditions that happened after the effective date of my diabetes disability August 12, 2015?

I received my rating decision from the Department of Veteran Affairs and their decision was “Evaluation of prostate cancer, which is currently 100 percent disabling, is proposed to be decreased to 40%”, Before I send them the following would you please check this out to see if rating should be 80% rather than 40%. You should not make this change to 40 percent because you based it on : 1. Awakening to void five or more times per night. 2. Daytime voiding interval less than one hour. 3. Requiring the wearing of absorbent materials which must be changed two to four times per day. Pursuant to 38 CFR & 4.115a Rating of the genitourinary system dysfunctions. 1. Requiring the wearing of absorbent materials which must be changed two to four times per day has a rating of 40%. 2. Daytime voiding interval less than one hour, or; awakening to void five or more times per night also has a rating of 40% so total rating should be 80%.
