Bwaveteran replied to Mieka26's question in Appealing Your Veterans Compensation Disability Claims NOD, DRO, BVA, USCAVC
Shoot, that would be a record and if it does get decided in 30 days, I’m not sure if that’s good news. Maybe I’m wrong and it works out in your favor. Keep us posted. -

Bwaveteran replied to Mieka26's question in Appealing Your Veterans Compensation Disability Claims NOD, DRO, BVA, USCAVC
No telling when the decision will be rendered. It took 10 months from grant to decision for my BVA Grant/ Remand. More than likely your appeal is still at the AMC, since there is a remand. Hopefully it will be sooner than later, til then there’s not much you can do. -
It could be 3 months or up to a year. There really isn’t any right answer to this. I really hope you get a positive outcome on your appeal.

Reimbursement for Loan Origination Fee Question
Bwaveteran replied to McRay's question in VA Disability Claims Research
I read that OIG report and what your lender is going to do, is recommend for the refund funding fee. ”A plan to consistently obtain documentation and verify lenders apply funding fee refunds to veterans’ loan balances in a timely manner.” You could ask the lender not to apply your fee to your balance and rather take a refund instead. -
Granted on Sept 2018, implemented award June6th 2019.

Medical discharged during basic training
Bwaveteran replied to MrStryker's question in VA Disability Claims Research
Probably he got an ELS discharge? Honorable for basic training is like unheard of but, it was the 70s so who knows. -
BVA Rating increase and remand issue
Bwaveteran replied to Gemini88's question in VA Disability Claims Research
Are you still unemployed? I know it’s a dumb question to ask, my BVA grant from September 2018 was just implemented last month for the grant( PTSD) and IU. Have they implemented the increase? -

Pending a Rating Decision
Bwaveteran replied to Rock1982's question in VA Disability Claims Research
It took 10 months for my BVA grant, got my first check of the new amount yesterday. Mine was for PTSD grant and IU remand. So your looking ( hopefully not) awhile. -
I hired Bosely and Bratch, after my initial case failed in late 2012 after filing in 2011. 2 claims for PTSD and Lumbar strain and went for the DRO route in 2013. one claim granted, the other denied on 2015. My attorney said, f eff were going BVA. Well it worked it out, 4 yrs after the DRO review to the BVA. Funny thing is after I got my award this month, that the AMC used the same evidence to grant and rate my award, that the RO denied..how weird is that. well now they owe me 8 yrs of back pay, so the joke is on them.

Yeah, call em. I was 3 sheets to the wind when it was all said done. PTSD granted IU remanded for my case....took 10 months to resolve. They gave me %70 from 2011 and retro the date for IU to 2013, then increased the rating to %100 back in May2018,P& T...I had to read my award letter 10 times to make sense of it all. prior I was %20 for lumbar strain in 2015.

Yeah, when my BVA appeal was granted/ remanded in Sept 2018, it was sent to the AMC. I didn’t get my award til June 6. The remand was for IU but, it was retroactive effective and deem moot since the grant put me at %100. I thought the same thing for awhile and never got any true answers until I got my award. Whole time I thought it was sent back to the AOJ ( TX) but, it was at the AMC, go figure. What they have been doing lately is is working the remand before implementing the grant. Which shouldn’t be that way. what issue is being remanded?

If you happen to have your last award letter or rating decision, it should say. The norm is 5 yrs but, some vets have RFEs like in 18 to 36 months.

Strange backpay amount for TDIU
Bwaveteran replied to Mrn16's question in TDIU Unemployability Claims
Wait til the decision letter, unless you already received it. as for the retro amounts it should state it and payment dates it would state that also. -
Change effective date for VA compensation
Bwaveteran replied to allencunningham's question in VA Disability Claims Research
That is gonna be difficult but not impossible. The VBA usually only grants on the filing date but, to go back that far when the DX happen. I would suggest talking to a experienced attorney or some fellow members here that could help shine some light on a EED for your case. -
Strange backpay amount for TDIU
Bwaveteran replied to Mrn16's question in TDIU Unemployability Claims
Yeah, they will do strange amounts but, it should even it out. wait for the decision letter also. If the claim was open on Mar 7 th then the pay effective date will be April 1st. also is he retired? Have to ask. -
Is the NOD for increase at the BVA?
